Introduction
Gelato is a nationwide cheesemaker that may need to update its policies in order to ensure fair treatment and protection against discrimination. The organization currently requires its cleaning crew to have a high school diploma. The city the organization is located in is fifty percent white with a seventy-five percent high school graduation rate, and the other fifty percent are minorities with only a twenty-five percent graduation rate.
The fact that Gelato requires their cleaning crew to have a high school diploma may be a violation of the Civil Rights Act of 1964. In addition, seventy-five percent of its employees are between the ages of twenty-five and thirty-five, which may be a violation of the Age Discrimination in …show more content…
Currently Gelato cannot prove that the practice of only hiring employees with high school diplomas is a necessary part of the job, for a cleaning crew. Since this requirement is in question, and a strong case can be made against it, Gelato should re-write their policy. In a study of human resources best practices regarding equal opportunity, researchers found that organizations with clear communication and managers committed to zero discrimination had the best practices over other organizations (U.S., 1997). It is clear that at the very list, to minimize lawsuit risks, Gelato should do a policy evaluation and audit to ensure total lawfulness (Tips, 2010). In addition, they should document why they have specific policies because age and race discrimination is in question (Tips, …show more content…
For example, Pacific Bell offers their employees tuition assistance to obtain their degrees (U.S., 1997). Not only does this help the employees to become successful, but their employees are learning new techniques, ideas and gaining new training experiences, which in turn helps the employer (U.S., 1997). Not only would helping with education remove Gelato from scrutiny regarding the Civil Rights Act, but it would also win them good faith and favor from the public. In addition, organizations have found that by not limiting hiring to a single group, to be the most successful they need to “draw talent and ideas from all segments of the population” (U.S., 1997).
