Backseat Lawyer, 2007, a lawyer views on the News. “Broadcasting the trail of Michael Jackson doctor Conrad Murray. Should this be? Do the Pros Outweigh the Cons?
The trail of Dr. Conrad Murray is being national televised, and he’s being charged with manslaughter charges for the death of Michael Jackson. It is argued that putting the event on such in Los Angeles seems to be no big deal. The lawyer understood the huge profits that will be gain in Los Angeles – large audience, large advertising would bring capital into the city, and he got that. Even with that he argues that he didn’t feel capital gain in the city would be enough, and it’s not a good idea to televise. As in any trial the defense attorney will disclosed many unknown things about Michael and he would be tried in this case. It is the attorney position to bring in as much evidence to put Michael immoral stat in defense of the action that Dr. Murray made that day. In the article the attorney feels it’s not fair to the kids and Michael’s mom. There will be things announce in the trial that will cause twinge to all of them.
CONS
Grant pain will be received by those family members, but I argue that broadcasting has very little bearing on those that are in sorrow with his death. It was reported that Michael’s kids and family members are schedule to testify and will be presence during the trial. I argue, would it be the right thing to have his kid’s presence throughout the trial. Now that would be anguish for the kids. Michael had thousands of fans nationally all over the universe and I’m sure broadcasting was warrant by each and every one of them.
Broadcasting this trial will bring great revenue to the city, with gain of respect to those grateful adored Michael Jackson. Hearing and receiving second hand information is not always the best. Michael fans warrant hearing the facts

...Article Rebuttal: The United States and Syrian War William L Johnson BCOM/275 September 10, 2013 Article Rebuttal: The US and Syria War My rebuttal article is the story of the Middle Eastern war in Syria. Syria has decided to turn over all of the chemical weapons to Russia and eventually have Russia destroy them so that the war between the US and Syria will not commence. President Obama is still trying to convince Congress to have an airstrike on Syria but more than half of Congress is oppose to this war because we the people of the United States just finished two wars one in Iraq and the other in Afghanistan. CNN has posted, ” A new diplomatic solution in the standoff between the Syria and the United States surfaced unexpectedly Monday as the war-torn country said it supported a proposal to hand over control of its chemical weapons(Shoichet & Crawford, 2013).” “President Obama told ABC News anchor Diane Sawyer that the Syrian reaction was a "modestly positive development" and a military strike would "absolutely" be on pause if Syria's chemical weapons were put in the hands of an international body (Padia, Schifrin, & Hughes, 2013).” For, the most part of this case I think that this case is a good form of argument of authority. Because based on the facts that President Obama is trying to force Syria to do something that he has no proof of or any knowledge of. The article is also part of Argument from Ignorance or Non-Testable Hypothesis based on President Assad...

...Article Rebuttal Brandon Harris BCOM/275 Instructor Keisha Dean January 15, 2015 Article Rebuttal The legalization of marijuana has been a controversial topic for many years now. Do the pros of the legalization of marijuana outweigh the cons of the legalization of marijuana? I believe so. The fact is Marijuana legalization would have an abundance of positive effects for not only the U.S. but for the world as well. Cannabis is not a deadly plant. However some choose to argue that the crime rate would rise as of a result of the legalization of marijuana. However legalization of cannabis would lessen the prison population, allow marijuana to be table and create billions of dollars that would be used in the United States and other countries. Marijuana legalization would allow cannabis to become it’s own industry. Marijuana legalization would reduce the impact of gangs in the streets. Cannabis would be become more effective and better for ones health because the Government would be in control of regulation. The Alaskan Association of Chiefs of Police Inc. posted an article against the legalization of marijuana stating numerous preconceived cons against the cannabis plant. The statement in the article I didn’t agree with was “After medicinal marijuana became easy to get in Colorado, seizures of smuggled marijuana quadrupled in roughly 4 years as legal marijuana was diverted to other markets. No comparable studies have been found addressing this problem in Alaska, but if...

...Article Rebuttal BCOM275 The subject of this paper is a rebuttal to an article that focused on Proposition 8 that was introduced to the state of California in 2008. This paper will argue against the statements that the author said and give insight into how the author’s statements were misleading. First Statement “Now, two years later, though a federal court has declared Proposition 8 invalid under the U.S. Constitution, it nonetheless remains in effect. This state of affairs persists even though most people now support equal marriage rights…” (Brill, 2011). Brill is making a misleading comment here by saying that most of the country is in support of equal marriage rights. By stating that most of country now supports equal marriage rights is a bit of an exaggeration. According to the Pew Research Center, Americans for the majority are still opposed to same sex marriages by the tune of 46% against it (Pew Research Center, 2011). The results from the poll also showed that there was 9% that voted “do not know” and they were counted in with those that were for same sex marriage (Pew Research Center, 2011). Second Statement “The initiative proponents, however, have appealed. Now the California Supreme Court must decide whether unelected and unaccountable initiative proponents have the power to trump the judgment of the democratically elected attorney general” (Baume, 2011). This statement by the author is a way of classifying or assuming that all the people...

On August 20, 1995, Shirley Phelps-Roper, attendee of the WBC, heard an explosion outside of her home in Topeka, Kansas sometime after 11:00 pm. After going to see where the noise came from, she called the police department to report the explosion. The police department told her that they had already had news of the blast and that it wasn’t from her house, yet a mile away from where she lives. She had to call them back several times before an officer finally responded to investigate the situation and gather evidence of the crime. IED debris The family was eager to gather their own evidence and do their own investigation, since that is how they were used to being treated in the past. They found orange plastic debris from the bombing in other yards as far away as the length of a football field. News stations reported that the blast was not aimed at WBC since there were other blasts that same evening around the town. Interviews and questions Throughout the next few days, Shirley...

...Article Rebuttal BCOM/275 Dr. Howard Samuels has written an article in he Huffington Post about his stance on the legalization of marijuana. He states he is against the legalization but not the decimalization. Dr. Samuels proceeds to state that legalization would be a nightmare on the fact that marijuana would be available in stores across the country, and that it would mirror the alcohol and tobacco industry. In relation he states that “alcohol has created so much dysfunction and destruction in our society, why would we want to introduce yet another drug that gets people high.” Ok, so I do agree that alcohol does create dysfunction and destruction. This I agree with 100% . I do not agree that introducing marijuana would do the same. Alcohol creates destruction not only to society but to the body as well and cannot cure much of anything compared to the healing properties of marijuana and marijuana is less addictive. “Alcohol's addictive qualities are well-documented. Approximately 17.6 million people, or one in every 12 adults, suffer from alcohol abuse or dependence, according to the NIAAA and t he addictive qualities of marijuana are not yet fully understood. The National Institute on Drug Abuse estimates 9% of people who use marijuana will become addicted to it. For comparison's sake, cocaine hooks about 20% of those who use it.” (Is marijuana as safe as -- or safer than -- alcohol? ...Article RebuttalArticle Rebuttal This learner thoughts about the anti-abortion group, called Personhood USA, who are in a push to move a bill through congress called (refined life) stating that life starts at the moment the sperm meets the egg, even though the medical community has long been in agreement that fertilization does not mark the beginning of a pregnancy — fertilized eggs must first be implanted, and only about half of fertilized eggs actually result in a pregnancy. (Diamond, June) This would potentially take away a woman’s right to choose what she can and can’t do with her body and could potentially outlaw contraceptives so no more morning after pill, birth control pills, or condoms. First this learner doesn’t agree with abortion, however the learner feels it starts here with the government telling women what we can and can’t do with our bodies, one might also think that the government would want to tell women what they can and can’t eat and how much they can eat by saying things like if women or men over eat and gain weight, then Americans’ will not be eligible for health care because government has mandated that American’s can’t gain weight. One would believe what women choose to do with their bodies is a woman’s business and no one else. If a women needs to have an abortion because of health reasons for herself or in the case of the baby having terminal health problems or in the case of a rape she should have the chose to terminate the pregnancy if she so...

...As a whole the United States set the legal minimum drinking age at 21, but expectation such as drinking for medical reasons, consumption at home, under adult supervision, and many other reasons do exits depending on the state. In an article called "Should the Drinking Age Be Lowered From 21 To a Younger Age?" argues the legal drinking age for Americans should be lowered because, "Turning 18 entails receiving the rights and responsibilities of adulthood to vote, serve on juries, get married, sign contracts, join the military--which includes taking on the responsibilities of life and death--and be prosecuted as adults. Adults from the age of 18 should therefore also be trusted to make decisions about alcohol consumption"("Should The Drinking Age Be Lowered From 21 To A Younger Age?", n.d.). In this rebuttal using valid arguments, supporting data, analyzing the reliability, credibility, and validity of the data used by the author, and identifying any logical fallacies in the argument it will be explained why the minimum drinking age should not be lowered. The legal minimum drinking age was not always 21 for the United States. At one point in time different states had the legal minimum drinking age set to age 20, 19, even 18. The main reason the legal age for drinking should not be lowered is safety." Federal transportation authority's viewed this hodge-podge of state laws as a real highway traffic safety problem. Alcohol-related traffic injuries and fatalities were increasing...

...Article Rebuttal Mary Colene Book BCOM/275 December 11, 2012 Susan Jolley Corporal Punishment in School In an article written by Shailynn Krow , for eHow, she supports the benefits of corporal punishment in the class room. The assumption is, “Some children come from families that are too permissive”. The article contends that “Corporal punishment in schools is a firm type of discipline that teaches children right from wrong and that there are consequences to bad behavior.” Other practices of suspensions and time outs are regarded as rewards, take away from learning, and in as much are not effective. Prospect of physical pain, as a result of misbehaving, is thought to act as an effective deterrent. Seeing other children spanked or paddled will strike fear, and motivate students to obey the rules. “The American Academy of Child and Adolescent Psychiatry opposes the use of corporal punishment in schools and takes issue with laws in some states legalizing such corporal punishment and protecting adults who use it from prosecution for child abuse.” (http://www.aacap.org/cs/root/policy_statements/corporal_punishment_in_schools) Spanking and paddling teaches a child that aggression and inflicting pain to an acceptable way to solve problems, and get what they want. Don’t limit freedom to marry?” This was in the Minneapolis Star Tribune on September 23, 2012. In the article On November 6, Minnesota voters will decide whether marriage should be protected in the state Constitution. “The human race's two sexes -- male and female -- have much in common, but they also differ in fundamental ways. In the bearing and rearing of children, men and women complement one another physically, socially and emotionally. Women give birth to babies, and men beget them. Mothers tend to nurture, while fathers tend to encourage risk-taking. Boys and girls need -- and deserve -- both a father and a mother to model how to live.” (Kersten, 2012 ) Rebuttal There is no documentation stating that a child needs to have one of each sex as a role model to grow up. There are many stories out there of 2 women or 2 men raising a normal health child. You may recall a young man that spoke at the National Democratic convention, by the name of Zach Wahls. This young man was raised by 2 women and now his name is a house hold name. “I'm a sixth-generation Iowan, an Eagle Scout, and I was raised by my two moms, Jackie and Terry. ...Article Rebuttal xxxxxxxxxxx BCOM/275 – Business Communications and Critical Thinking March 4, 2013 Joel Maier Article Rebuttal A major question that is asked frequently every year is “Should I get a flu shot?” As the flu season gets closer, people start asking this question and wonder the same thing “Will I still get the flu even if I get the shot?” Can one assume that if you if an immunization is received, that there is no possibility of catching the flu? Because medical insurance is yet another controversial issue, what about those who do not have coverage? Is there an affordable plan for the shot for these individuals and if not will these individuals definitely be plagued by the flu? The Mayo Clinic states that “Flu shots are the most effective way to prevent influenza and its complications” (Mayo Clinic Staff, 2013, pg.1). After reading the entire article, it shows evidence that the shot has been effective anywhere between 60-70% of the time, not 100% of the time. The article is contradicting in stating that the most effective way of fighting the flu is getting the flu shot. What about those individuals who fall into the 30-40% ineffective? Research shows that the flu immunization needs to be administered annually to have the most effective results. One has to question how researchers can be certain what the next string of flu may look like. The Mayo Clinic states that the circulating strains of flu virus can be close but not always an identical match to the...

...Article Rebuttal Many people say that Marijuana should not be legal, not even for medical use. For decades there has been an ongoing debate about whether or not marijuana should be legalized for medical purposes and or for recreational use. This debate is now out in the open, and for the first time Americans are seriously considering legalizing marijuana throughout the United States. The controversy regarding marijuana is. The first and most important reason marijuana should be legalized is for medical purposes. In 1972, the US Congress officially placed marijuana in Schedule 1 of the Controlled Substance Act because they considered it to “have no excepted medical use” and carries a risk of addiction. However, recent studies have disproved this over and over again. Marijuana has been proven through countless clinical trials to alleviate symptoms of many chronic debilitating medical conditions including cancer, HIV/AIDS, fibromyalgia, post traumatic stress disorder, adrenal disease, inflammatory bowel disease and glaucoma.(1) The Council of Science and Public Health conducted a series of clinical trials and concluded that marijuana use significantly reduces neuropathic pain, improves appetite and caloric intake especially in patients with reduced muscle mass, and also relieves spasticity and severe pain in patients suffering from multiple sclerosis (MS). It is undeniable that marijuana has been used to treat a variety of severe medical conditions for centuries and has helped...

...Article Rebuttal Maybelline Torres University of Phoenix BCOM/275 April 17, 2012 Prof. Lourdes Lebrón Bayrón Article Rebuttal In this article rebuttal an analysis will take place on the authors, reliability, credibility, and validity on the account of Noah’s flood. The rebuttal will give emphasis on the claims young earth creationist have on the earth’s existence period. Additionally, address old earth and young earth theories. Finally identify any fallacies in the argument.  For centuries creation theorists have given emphasis to Noah’s flood as enough evidence to a universal deluge.  Nevertheless, it is understood the ark presented in the Bible had a higher credibility to a local flood. According to biblical studies all humankind assembled in one local region in the Middle East, before the Tower of Babel. For this reason God had no need to flood the whole world.  The flood was universal to Noah it was a fact that Noah was floating on water and that when he looked out there was nothing but water surrounding him. Noah’s complete atmosphere was flooded therefore Noah believed the world was flooded. According to the bible all humankind drowned excluding the inhabitants of the ark. Article Rebuttal After, evaluating the information and observing absence of factual scientific proof of geologic documentation for a universal flood. ...Article Rebuttal BCOM275 February 18, 2013 Ellis Gun control laws have been the outrage among many Americans since the Sandy Hook shooting. Referencing the following article “Congress Takes up Gun Violence” from the New York Times on January 29th, 2013 for increasing more gun laws (2013). We don’t need more gun control laws because there are over 20,000 gun control laws currently on the books in the U.S. Many of the same localities which have strict "gun control" laws also prohibit ordinary citizens from owning and using chemical defense sprays or stun guns, and the rationale is the same. Law-abiding citizens are disarmed of any possible effective means of self-defense because of the possibility of criminals obtaining and misusing these weapons. Ironically, not one of these laws has done a single thing to reduce crime in this country. Quite the contrary, history has shown that with each passing of these laws crime has increased (“A National Crime Victimization Survey Report,” 1992). Had there been one armed citizen at Sandy Hook Elementary School this tragedy may have had a different outcome. Point in fact Connecticut already has a ban on an assault weapons purchased after October 1st 1993 (NRA-ILA), but since an “assault weapon” was not used, which was in fact found locked in the trunk of the car of the shooter and misreported by the media for their own purposes. This current media frenzy is nothing more than an attempt to push through stringent...

Since the ratification of the Bill of Rights, including the Second Amendment in 1791, our right to bear arms has been under attack. This article rebuttal will focus on an USA Today article titled “Epidemic: Guns kill twice as many kids as cancer does.” This article attempts to use biased statistics to provoke demand for further restrictions against our second amendment right. In the article, the author provides some staggering statistics which he uses to substantiate the claim “guns kill”. Here are a few; “guns still kill twice as many children and young people than cancer, five times as many than heart disease and fifteen times more than infection, according to the New England Journal of Medicine.” The article goes on to state “in 2010, 15,576 children and teenagers were injured by firearms – three times more than the number of U.S. soldiers injured in the war in Afghanistan, according to the defense fund.” On the surface, these statistics are alarming. Beyond the statistics, the article makes the claim “guns kill”. The remainder of this rebuttal will put into perspective the statistical claims on gun related deaths among youth, as well, debunk the implication “guns kill”. First, let’s place a level of perspective on the statistical...

...Rebuttal Article Jodi Eckert BCOM/275 November 14, 2011 Rebuttal Article I recently read an article from the Miami Herald about a Florida judge who overturned a death penalty hearing. I was never interested in law before but thanks to my son who is in training to be a police officer in the sheriff department has sparked my interest. This article is about a judge that has taken upon himself the role of telling juror that they should be the one to state whether a guilty person should get the death penalty or not. A U.S. District Judge has ordered that a case should go back to a new sentencing hearing and that the jury should make the decision on death or life in prison. You see Florida is one of the few states that allow juries to issue the death penalty, and the vote does not have to be unanimous, the majority vote is the decision on life or death. Trial judges in Florida have the authority to override jury recommendations on death penalty cases. It would appear that they rarely do according to the writer. His article points out that because of the judge overturning the jury verdict that their will be more appeals hitting the court system from others in prison for the death penalty hoping for new sentencing hearings. I completely agree that the jury should be the one to determine life in prison or death row, by reading this article it would appear that the author is not to keen on the judges decision either. If would appear that the Florida law is going...
