Explain whether Jake’s actions are in or out of “his scope of employment.”
Jake’s actions are in “his scope of employment.” Herman is reprimanding Jake for making sure he performs his job correctly and thoroughly. Even though Rally Motors is offering free oil changes, it is important to make sure the basics are checked also. The basics include checking the brakes, tires, and also checking the transmission. Herman seems to think that the oil should just be changed in the cars to get the customers in and out so that he will be able to service as many as possible. Herman informed Jake that the way he was changing the oil was to prepare the cars for the Indy 500 and that he wanted him to do a lousy job. Herman also informed him that what he learned while receiving his auto mechanic certification is for aircraft mechanics and not car mechanics. In the video while they were having the conversation about the way Jake was performing his job, his thumb was bleeding. Herman seemed not to care about the fact that Jake was injured and just wanted him to continue to perform his job to make the company have more business. Jake became more irate because Herman seemed not to care about the fact that Jake’s thumb was bleeding Jake took it upon himself to decide to go to the doctor because Herman wanted him to keep changing the oil despite of the situation. Jake had every right to choose to go to the doctor instead of staying to change the oil on cars. It is not fair that Herman would hang Jake’s job over his head because he is not working as fast as Herman thinks that he should and he also has an injury that Herman does not seem to care about.
Explain whether or not Herman is responsible for Jake’s injury. It is important that from the conversation that Herman had with Jake, Herman requires Jake to work long hours for the promotion that Rally Motors is running. Jake is not responsible for his own injury because if he was not required to work so many overtime hours, then he would not have been so tired and would have been able to pay more attention to what he was doing. Because Jake was tired from working overtime two straight days in a row, he tightened his thumb with a torque wrench. Herman is responsible for Jake’s injury because he expects him to work overtime for the free oil change promotion regardless of the promotion that Jake received for him to become service manager. It is wrong for Herman to have Jake working all those hours knowing that he was going to be the only one working. When companies run a promotion, it is important to make sure that there is enough coverage for it. When management requires employees to work overtime, it will naturally be more room for error and accidents on the job. Herman should have other employees to help with the promotion and let overtime work be an option because overtime may easily make individuals too tired to be able to perform their jobs, when not well rested.
Explain whether or not Jake should be paid the overtime. Jake should be paid overtime because Herman is requiring Jake to work overtime while Rally Motors is running the free oil change promotion. Jake stated in the video that he wanted to be compensated for his overtime hours. Herman informed him that he has been promoted to service manager and the Rally Motors management does not receive overtime pay. However, no one else that is part of the Rally Motors management is working overtime like Herman is making Jake work. Also, after being promoted to service manager Jake should not be working as hard as he is. There is no other member of the Rally Motors management that is required to work as much as Herman is making Jake work during the promotion. Since Jake is the service manager he should not be treated as a regular employee. Since Jake is being treated as an employee then Jake should be compensated for his overtime hours just as a regular employee would be. Herman would not want to be treated the way that he is treating Jake. Jake is injured because of the overtime that he had work due to Herman and Herman wants to still treat him unfairly. Jake should make all of the employees of management work required overtime without compensation just as he is making Jake.
Explain the rights Jake and Herman have individually in this scenario. In this scenario, Jake has the right to be upset about the fact that Herman does not want to pay him overtime for all of the work that he is putting into this free oil change promotion. Jake also has the right to be upset because he injured his thumb because of all the overtime that Herman has been making him work. Jake is a very good employee that is sixty years old and has arthritis. There is no reason that Herman should be making him work as hard as he does and still requires more out of him. Jake had the right to leave and go to the doctor because he hurt his hand and Herman wanted him to stay and work anyway. He knew that Herman did not care about his well-being and took it upon himself to make sure he was going to be fine and attempted go to the doctor. Herman at first did have a right to become angry once he saw that there were about twenty cars waiting to be serviced. Once Herman spoke with Jake as to why the oil changes were so backed up, he should then have showed more concern about Jake’s thumb and also tried to make himself more available to help assist the situation. There is not much more that Herman had the right to do in this situation. He should have been more understanding towards Jake especially because he hurt his thumb due to working so much while the promotion was running for the free oil changes. Herman should not have made Jake work all of those extra hours especially because he is the service manager. There are no other managers that are required to work those long hours while a promotion is going and if they are required to work a few more hours than they are not still doing the same work that they were doing while they were regular employees.
Conclusion
Jake was in “his scope of employment” because he was working as hard as he possibly could to make sure he serviced every car properly. Jake worked so much that he was too tired and injured himself accidently. He also worked overtime and felt as though he should have been compensated for it. Herman on the other hand, felt as though he should not have been compensated and that he should receive the same salary that everyone else receives that is on the Rally Motors staff. To make matters worse, Herman wanted to try and pay Jake under the table for all of the extra work he was doing just so that he could stop complaining about not receiving overtime pay.
