Reginald Peggins Reflective Paper on the Bench Trial
The judge covered the courtroom procedures very well stating a solicitor is here for the serious cases and the judge will 99% decide to go with the recommendation of the accused and the solicitor. Also, on the bad side of the courtroom was the unprofessionalism of some of the officers and with some of the lawyers. The courtroom is to be taken seriously, because people lives are on the balance, not knowing where their future lies. The people are asked to be quiet in the courtroom, but the officers and the lawyers are not held to the same standard. I observed a few interesting cases which is the one where the inmate was brought out and she was before the judge for fighting. Her mother was there for support, in which, I believe made a difference with the judge. The inmate was found guilty and was fined, but the fine was suspended for time served. The judge seems to be very engaged with the inmates as well as the people who were asked to be in court to present their case before the judge. Another inmate was charged with Driving under the Influence with an open container. The judge asked the young man if he wanted an attorney and if he could not afford one, if he qualified a public defender will be appointed to him, but the young man still refused the help of an attorney and wanted to represent himself. Based on interring a plea of guilty the judge found the inmate guilty of driving under the influence with an open container. The inmate has already served eight days in jail. The inmate was fined and half went to time served, community service, a drug and alcohol assessment was imposed, twelve month probation plus fees, ninety days to complete the community service, and fined $745.00. I believe this inmate should have gotten the support of an attorney and if he could not

...To die or not to die, that is the question. In the Seventh Amendment it states that; “…the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States” (Staff 2010). This means that any trial a person may have a trial by their peers if they choose too. The jurors make the decision in whether or not the criminal will go to jail. Capital punishment is when a person is legally authorized to say that someone should be killed for the crime they committed. Then there is capital murder which “means murder for which death penalty may be imposed” (). In many parts of the world they are sometimes called “My lord” or “My lady”. He/she is the one who presides over the proceedings of his/her court room. The judge sits on his bench and listens to the both sides of the parties, and the witnesses, the attorney opening and closing statements. If you need to give the judge anything then you would pass the papers to the bailiff who is the middle man between the judge and the attorneys, he always maintains order in the court room in case the judge can’t control his/her courtroom. They have to prepare the case and follow through with their finding so they will be able to convict or even have their case heard. The way a judge is chosen for the state varies from state to state, and there are a few ways they are put on the bench. One way for a judge to be put on the bench is to be appointed by the Governor or state legislature (FindLaw, 2012). A second way to choose a judge is through a merit selection. A merit selection is where a judge is chosen by a legislative committee based on each of the potential judge's performance in the past (FindLaw, 2012). A third way to get a judge on the bench is by a partisan election; in which a judge is selected through partisan elections that are voted in by the electorate, or voters registered to parties, because judges often run as part of a political party affiliate (FindLaw, 2012). A Non-Partisan Election is the final way to get on the bench. ...My Day At Court On November the 3rd I decided to take advantage of the extra credit opportunity and take a trip down to the city courthouse. After driving around looking for the courthouse; I find a parking spot, and enter the Caddo Parish Courthouse just before 9 a.m. Through the security check point I went, and on to the information desk, where I was told to head upstairs and talk with the bailiffs. Upon discussing with the bailiffs which court room would provide the most interesting cases; they informed me to try court room H. When asked why that particular room, the bailiff insisted that they would all be similar, and court room H was to start shortly. As I entered court room H and looked around and then took a seat. At this time there were only two other people sitting in the gallery. Behind the bar stood the prosecutors, defense attorneys, bailiff, court reporter, and a female police officer there to testify. Upon walking into the courtroom at 2pm when the doors opened, already my expectations of what a courtroom looked like differed from what I was seeing. Originally, I had always envisioned all courtrooms to have the judge’s bench in the center of the room along with the bailiff standing to the side, and space for someone to testify along with a podium for a plaintiff and a defendant to speak; pretty much what you always see on television.
