An Ethical Dilemma.
1. Discuss the advantages and disadvantages of each candidate.
The first candidate mentioned in the case is Liz who is 34 year old African-American. After analyzing her situation in the company and her personal life, it seems that in her case disadvantages outweighs her advantages to be considered as strong candidate. The only factor that could be considered an advantage would be the fact that she is African American and her promotion to the managerial level means she would be the first African American to be a manager at the level. Her academic credentials and job experience is not the plus point in fact those 2 factors might be even considered as the disadvantages since other competing candidates have far better academic qualification and longer job experience. And also to make the matter worst she has had family problems in the past that lead her to lead a single life with one child.
The second candidate is Roy, who is 57 year old happy father and husband. He has been loyal to the company and his position in the company for past twenty years and has had the job experience of nearly thirty years. The fact that could play for him to be the favorite would be his time of retirement.
He is retiring and he could get the sympathy vote to be promoted from the concerned people or person for the last time before he retires. Although he has had long job experience, the fact that he is now old to be handling the stress of the promotion and the greater responsibilities could play against him. He was not the highly energetic of the trio and also his performance has not been consistent, he has had times of glory but they were sporadic.

Shirish Singh

And the last candidate who is vying eagerly for the promotion is Quang Yeh. She is young AsianAmerican with strong academic qualification. She is consistent, laborious and highly focused individual. She is determined to be successful and can go any distance to match her actions with her goals. She is the idle candidate with all the qualifications needed but her disadvantages would be her strong hot headed character. There was a piece of evidence in a case that stated that she has had some problems keeping the older accounts. This is because she likes to be in control rather than being controlled and this very thing could be her greatest disadvantage.

2. What are the ethical and legal considerations for Lael?
Her action to consume four aspirins and two antacids is completely understandable. The situation would not have been any different if anybody else was in her shoes. She has a decision to make and that is her own to make although her superior has hinted on the repercussions if she made the err in the judgment. She has to let her brain work instead of her heart. Lael has the power and she has to make sure that she uses that wisely to make a good decision and not let her reputation and job on the line.
And most importantly she has to be sure that her decision would be totally free from the influence from anybody or emotions or anything. The ethical and legal considerations for lael to choose one of the three candidates would be the candidates ability to better the company. She should be unaffected by the candidates personal connections to the big guns of upper management or her emotional attachment to those candidates. She cannot be biased or prejudice against anyone regarding any type of discriminatory grounds. Liz needs money to support her family, to be precise she needs money to take care of the medical expense and the promotion might be a help to her but the thing to be considered by
Lael is not the benefit to the individual but benefit to the company. Also Lael's decision to appoint roy as a Manager on the basis of his service would be commendable but she should not be grateful to him

Shirish Singh just because he is retiring. If he deserves the promotion then he gets it otherwise there is no ground for sympathy to choose a able candidate. And Lael should be very sharp while making any decision about
Quang Yeh because she is most elusive of the bunch. She is qualified and competent but her relation with boss's son might shadow her performance based promotion. There might be air of discord in the company if Lael does not become objective about the decision.

3. Identify the pressures that have made her promotion decision an ethical and legal issue.
4. Discuss the implications of each decision that Lael could make.

Lael is in an ethical dilemma. She has been in constant pressure since the time when her superiors asked her to make the decision. The pressure being the foreboding warning of repercussions if she made a wrong choice. Lael is emotionally attached to Liz. She knows her pain and feels bad for her son's health and really wants to help her out in any way possible. They are more of friends than colleagues at work. Now if she promotes her then she is taking the risk of favoring her friend. She wants to help her as a friend but her hands are tied because lael is superior to Liz at work.
The senior manager who referred Roy as a favorite is intimidating Lael by stating Roy's presence in the company. The manager is trying to exert unnecessary pressure on Lael to appoint his favorite candidate as a manager. And also Roy's son is getting hitched to Vice President's daughter. The significance of this conjugation might play negative role in her decision to appoint Roy. People might perceive that she made her decision under the pressure of risking her job. And finally in the decision to appoint Quang Yeh she would acting under the influence of her senior who is willing to bribe Lael.
All of the three choices are mind boggling but there has to be one choice and that is inevitable. Hence no matter how daunting the task seems Lael should be composed and be ready to justify her choice which should not have any hint of unethicality.

Since Samuel Smiles invented an industry with his 1859 book Self-Help, it has been a project of the capitalist age to abolish the idea of luck. Smiles, who outsold Charles Darwin and John Stuart Mill that year, opened with a line that said it all: "Heaven helps those who help themselves." The dogmas of self-help have remained religiously rigid. Since 2006, more than 21...

Luck in the Ancient Mariner

...with the rest of his crew in the South Pole. As a result, Death and Life-in-Death, two spirits that follow the crew to punish them, are to decide his fate, his life, to a game of dice. Entities beyond mortality gamble the future of a guilty, yet helpless man. Doesn’t this sound familiar? Don’t our lives seem, sometimes, the result of a game of dice being played by someone/something bigger than ourselves, even bigger than life itself? Just the fact that we are who we are is nothing but a result of chance. This statement, beyond its recklessness appearance, has an explanation consisting of three moments of existences that are determined by the roulette. The first one goes back to before we’re born. Have you ever thought of how many billions of chances were there when your parents’ genetic material mixed to create you? I, for instance, could’ve been blond, tall and smart. Or short and dumb. Or anything. But, somehow, I turned out to be me, out of what appear to be infinite chances of who I could’ve been. And this process follows no logic or intervention from our part: is the work of randomness. The second moment, chronologically, involves our environment. Where we’re born, who our parents are, and the rest of conditions that welcome us to this world are the sort of aspects I include in this side of this pyramidal die. The third and final moment is composed of the things that are choices in our lives. This is also a consequence of luck because the construction of ourselves...

Becoming A Forensic Anthropologist

...As a Forensic Anthropologist, I don’t get lucky very often, but since I have become a Forensic Anthropologist, the concept of luck has changed drastically. For example, when my dog found a dead body, I felt like the luckiest person in the world. The first thing I did after consulting another Forensic Anthropologist, was lay out and examine the bones. This was in order to develop a profile for the victim. After laying them out, I was able to look at certain features of the bones. In cases where the victim is older, the vertebrae appears worn out. This victims vertebrae wasn’t worn out, and it was also shorter than the average adult. This tells us that our victim was young. Next, we looked at the many features of the skull, which would help us determine more about the victim’s race and age. The skull was definitely of a younger female, but there were too many features consistent with many races to narrow it down to a single one. We could tell by the state of decomposition that the victim had only been buried for about eight years, just long enough for the body to deteriorate to only a skeleton. After learning what we could by analyzing our victim’s bones, we looked at identifying features that could be used to hastily find the identity of the victim. In the article “Giving Faces to the Lost”, Angela Libel says that if the victim has had dental work, dental records may be found. This is why we consulted a Forensic Odontologist to match dental records. Libel also says that identifying...

...Dripping black oil began to puddle around my feet as I stumbled out of my 2000 Ford Toyota 4Runner. The smell of burning metal and gasoline began to seep into the air. My entire right side was numb and I could barely feel my face. The strong metallic taste of blood began to fill my mouth, as I bent over to spit out the amount that had now pooled at the bottom. I struggled to remember how I got to this part of Interstate 270, when I started off on the East Side of Columbus. I slowly hobbled to the front of my car to survey the damage. Fighting to keep my footing, I noticed my hands were violently shaking. Never in my life had I flipped a car before, but during those rolls my heart skipped many beats as my SUV searched for steady ground before coming to a rest. Finally, stumbling to the front after grabbing ahold of the hanging bumper to stabilize my steps, I noticed the extreme amount of damage. My truck was totaled, no question. How could I put my life and those around me in jeopardy without so much as a second thought? Earlier that night, I hopped out of the shower eager to go out and celebrate the end of another work week. After ironing the clothes I picked out earlier that day, putting on some cologne, and admiring myself in the mirror, I darted out the door and threw the car in reverse. Drinking was always on the agenda, but I had the motto that the more I drank, the better driver I became. I decided to make a quick stop at a bar before proceeding onto a nightclub for the...

Mr Ngwenya

...Question (b) Equal opportunity is a stipulation that all people should be treated similarly, unhampered by artificial barriers or prejudices or preferences, except when particular distinctions can be explicitly justified. The aim according to this often complex and contested concept is that important jobs should go to those “most qualified” persons most likely to perform ably in a given task and not go to persons for irrelevant reasons, such as circumstances of birth, upbringing, friendship ties to whoever is in power, religion, sex, ethnicity, race, caste, or involuntary personal attributes such as disability, age, or sexual orientation. Chances for advancement should be open to everybody interested such that they have “an equal chance to compete within the framework of goals and the structure of rules established. The idea is to remove arbitrariness from the selection process and base it on some “pre-agreed basis of fairness with the assessment process being related to the type of position and emphasizing procedural and legal means. Individuals should succeed or fail based on their own efforts and not extraneous circumstances such as having well-connected parents. It is opposed to nepotism and plays a role in whether a social structure is seen as legitimate. However, equitable responsibility ascertains that all members of a society and organisation, regardless of wealth, class, or importance are equal partners entitled to equal responsibility and participation in the affairs...

Turtles of the Saharah

...“Luck is a matter of preparation meeting opportunity." Have you ever heard people talk about the things they would do if they won the lottery, and yet a large percentage of these people never go out and buy a ticket. These people have exactly a zero chance of winning, while the ones who went out and bought a ticket have a chance, albeit slim, at becoming lucky. This is the scenario that came to mind when I first read the quote “Luck is a matter of preparation meeting opportunity”. However, the more I thought about the quote, the more I realized how easily this could be applied to many real life situations. The author of this quote is trying to tell the readers that preparing yourself for opportunity is the key to being lucky, or successful. In order to prepare yourself for success, there are certain steps that must take place. First, you have to believe in yourself. You must believe that you can pick the lucky numbers, or you must believe that you are capable of competing in, let’s say a marathon. Second, you have to set goals for yourself. In the case of the lottery it’s pretty easy; Goal #1, buy ticket. Goal #2, wait. In the marathon scenario, much like most other scenarios, it’s a little more complicated. You must train both physically and mentally, and make many sacrifices along the way. Finally, you must be optimistic about the result you achieve. In the case of the lottery player, they probably didn’t win. But at least they can try again in a few days, right? The marathon...

Outliers Reflection

...Tronlyn Thompson Alsobrook AP Lang 23 March 2015 Outliers – Chapter One Reflection In chapter one, Gladwell discusses the importance of opportunity and chance in the role of success. It is really interesting that trend of hockey players’ birthdates was relatively common, and amongst other sports as well. I never really understood that cut-off dates played a huge role in a person’s success, but that success isn’t just because of their birthdate, it’s because of the extra bodily maturation, the extra instruction, and the extra time spent perfecting a talent. My brother was born in July, and I’m now interested in seeing what his path will be, athletically. Gladwell really touches on how society chooses to ignore the fact that a child’s birth month ultimately determines if they make it or not. After this premise was found, there should have been some discussion about making the chances even. Gladwell’s language and word usage makes the book an extremely easy read, and his breakdown of different topics keeps the reader intrigued and also ready to move along to the next circumstance. I’m sure he structures his chapters the way he does because he wants the reader to blatantly recognize the different situations. Titling the chapter “The Matthew Effect” was clever. Once making the connection between the actual biblical passage and the true actualities of success, one can see that success has been a universal goal for quite some time. It’s also reassuring to see that the...

Luck or Opportunity

...Luck or Opportunity "Luck is a matter of preparation meeting opportunity” is a quote from Oprah Winfrey, a famous American talk show host. The speaker is trying to tell people that good preparation for opportunity is the key to be successful, not luck. Luck is really being ready for something, perhaps unconsciously, so that you recognize it when you see it. When whatever it is comes along, it will seem to be a stroke of luck, but in reality it is not luck at all. It is something you have strived and worked towards, maybe without even knowing it, so that when it presents itself it seems second nature. I agree with Winfrey because I believe that preparation is more important. My agreement is based on the following reasons. The first reason is that opportunity is very transient and rare, so we must grab it whenever we meet it. In my opinion, grabbing opportunity means to get ready and be well-prepared. Take Oprah Winfrey for example. Before she became a well-known national TV host, she worked in a local station for many years and had gone to uncountable interviews. Without her experiences, she could not have gotten the interview for national TV host and become successful. Second, preparation is always advantageous and never harmful to us. Preparation requires motivation, activity and carefulness. Those who most frequently experience outcomes viewed by society as unlucky live lives which exhibit little evidence of motivation, activity and care. When preparing for something...
