(3) (A) Client believes that she was a victim of employment discrimination under the Equal Pay Act based on gender which occurred at Rikards-Hayley investment firm. Ms. Bennett was employed at the investment firm for approximately four years and although she was promoted as acting manager during her employment, it was a temporary position. When the position was to be filled permanently Ms. Bennett applied for and was subsequently denied promotion and eventually terminated shortly thereafter. Based on Ms. Bennett’s time with the company and her position prior to termination, she was not compensated equal pay to that of the male employees. When male employees in Ms. Bennett’s position are terminated, they commonly receive a severance package consisting of one years’ salary. Ms. Bennett received a severance package consisting of only six month’s salary. Rikards-Hayley has been deemed to have been engaged in an unlawful employment practice by not providing Ms. Bennett the same benefits as it has to its male employees.
