Engel v. Vitale

Introduction of Case: Engel v. Vitale (1962) went before the Supreme Court. Several families claimed that it was unconstitutional for their students, who attended a public school, to have to recite a prayer created by the New York State Board of Regents each day before class.

Citation: 370 U.S. 421

Facts of the Case: The Board of Education of Union Free School District No. 9, New Hide Park, New York, mandated that a school prayer created by the State Board of Regents be recited in front of a teacher at the start of each day. “Almighty God, we acknowledge our dependence upon Thee, and we beg thy blessings upon us, our parents, our teachers and our country. Amen” (Engel …show more content…
Christians are called to disciples others. Educators are given the task of growing students. Christian educators are facing an ever-increasing Godless society. Because prayer is no longer allowed in classrooms, sporting events, etc. does not mean that prayer doesn’t exist or even happen frequently in the school walls teachers serve daily. Silent prayer is happening on a daily, hourly, and even minute-to-minute basis by administrators, educators, parents, and students alike. However, walking in and out of classes or up and down hallways you will not hear the prayers being recited out loud.

Prayer in School

...Groups such as Moms in Prayer are for having prayer in schools. While the American Civil Liberties Union are against having prayers in schools. "To secure the people's right to acknowledge God according to the dictates of conscience: Neither the United States nor any State shall establish any official religion, but the people's right to pray and to recognize their religious beliefs, heritage, and traditions on public property, including schools, shall not be infringed. The United States and the States shall not compose school prayers, not require any person to join in prayer or other religious activity." Congressman Ernest Istook (R-OK). Prayer in school is a debate that has been going on since the 1960’s with the landmark case of Engle V Vitale. The case found that a school wide solicited prayer recited by the students was unconstitutional. This ruling led to other litigation where school sponsored prayer was not allowed, such as during sporting events and graduations. Those that are for prayer in school will argue that it allows for the Freedom of Religion. Will bring back morality in the schools. And will allow students to express their First Amendment Right. Those against prayer in school will argue that one religion may go against other religious views. Violating the separation of church and state. Also, students will be chastised...

...Name: Course: Tutor: Date of Submission: Prayer in Public Schools For a long time now, there have been debates on the issue of prayer on public schools. Tracing back the issue of prayer in the public school as presented in various court cases and the issue of prayer from a personal perspective shows the correct argument towards prayers in public school prayers. The first court case on school prayer can be traced in the Engel V. Vitale case that happened way back in 1962, where there was the banning of praying in public school by the Federal Supreme Court. Weiler says that this happened after parents in a public school at New York protested that the voluntary prayer at the school was not in line with their religious belief (Weiler). To spice this up, other religious groups came forward to support the parents on the same issue, which they argued that it was against the amended constitution. After a long consultation with various concerned parties and religious group, a firm confirmation was made that this was unconstitutional. Therefore, the court issued an opinion stating that there were not supposed to be prayers written by the government for recitation in the public schools. To justify this, the court stated the existence of the separation between the state and the church, where it revisited the history of the matter. Besides this, the court argued that a school prayer is a religious activity since it has the nature of a prayer. Therefore, prescribing a prayer for children...

Position Paper

...Position Paper Introduction Looking back over the past two hundred and seven years, every session of the United States Senate has been opened with a prayer. Doing so has reaffirmed the Senates faith that God is the Sovereign Lord of our Nation. Barry C. Black currently serves as the spiritual advisor and counselor for the United States Senate with the title of Chaplin. Over the years, this position has ranged from part time, to now a full time position (United States Senate, 2011). Ever since Engel v. Vitale, people have been upset that God has been kicked out of the classroom. Engle v. Vitale was a landmark Supreme Court case, in which it was ruled that the public school could not be started or concluded with a formal reciting of a non-denominational prayer (Bill of Rights Institute, 2010). The following information will show both sides of the argument of if prayer should be allowed in schools. Background information will be given on the history of prayer in school and prayer in congress, and my personal thoughts on this important position. Argument There are many different viewpoints on the argument of prayer in schools. We will begin with the argument of allowing prayer in schools. The United States Constitution protects religious freedom under the First Amendment. The First Amendment states that Congress should not make any law respecting the establishment of religion or prohibiting the free exercise of religion (U.S. Constitution Online, 2010)...

Religion in the Public Schools: Public Prayer or Private Action?

...Religion in the Public Schools: Public Prayer or Private Action? The differences between private and government sponsored religious speech can be difficult, but necessary to determine when dealing with religion in the public school system. In Kountze Texas, a group of cheerleaders are suing the school district because a ban was placed on their usage of religious banners before the local public school’s football games. The cheerleaders created banners, like many high school cheerleaders do, but the message painted on their signs were statements such as, “And let us run with endurance the race God has set before us” The messages on the banners are religious speech and a violation of the First Amendment of the Constitution. Yes, the United States Constitution does allow for the freedom of religion, but it also separates Church and State. The cheerleaders painted these signs for a school organized football game; the educational institution is a public one and must abide by the United States Constitution and the separation of church and state. If the school were private, religious connotations would be permissible, but being that the school is public, the signs created by the cheerleaders would be considered government sanctioned. The Establishment Clause in the First Amendment states, “congress shall make no law respecting an establishment of religion.” Throughout our nations history there has been much debate of what the framers of the Constitution meant by establishment...
