All of the criteria considered when determining the nature and seriousness of an offense are very important. I feel that most people would believe the most significant is “Counterfeit goods or services that endanger the public’s health or safety deserve the highest consideration for prosecution”, which makes a lot of sense because safety and health are crucial to well-being, which the law works to protect. When individuals can be extremely hurt, violated, or put in a really dangerous situation, this should definitely be a prominent factor. Therefore, I am not discrediting that criterion or any of the others because they should all play a role when determining the nature and seriousness of a crime.
However, I feel that in low-threat, low-risk cases the most important criterion is “The more strongly …show more content…
This is because of the large number of victims who do not take actions to protect their intellectual property yet are surprised and offended when it is stolen or tampered with. I feel that courts should take a hard look at protective measures (or lack there of) that the victim took to protect his or her property. If a victim put little or no security in place, I do not feel as if prosecutors should feel a lot of pressure to prosecute the suspect(s) to the fullest extent possible. I don’t believe it is reasonable or fair to allocate time, money, and resources to cases that could have been completely prevented from the start. Of course, it is always wrong and illegal to steal or violate another person’s intellectual property, but some owners do not take the responsibility that is necessary to protect their intellectual property.
