Before Judges MICHELS, MUIR, Jr., and COBURN. Vincent J. Apruzzese, Warren, for defendants-appellants and cross-respondents (Apruzzese, McDermott, Mastro & Murphy, attorneys; Mr. Apruzzese, of counsel; Mr. Apruzzese, Sharon P. Margello, Richard C. Mariani, Warren, Jerrold J. Wohlgemuth, Westfield, and Daniel P. Murphy, Newark, on the brief). Bruce P. McMoran, Newark, for plaintiff-respondent and cross-appellant (Barry & McMoran, attorneys; Mr. McMoran, of counsel; Mr. McMoran, John J. Barry, Colleen D. Shiarella, and Carmen J. DiMaria, on the brief).
The opinion of the court was delivered by
Defendants Schering-Plough Corporation (Schering), James Reed (Reed), Ronald Martino (Martino), and Jerome A. Sherman (Sherman) appeal (1) from a judgment of the Law Division entered on a jury verdict that awarded plaintiff Ferdinand C. Maiorino (Maiorino) (a) compensatory damages in the total amount of $435,000, consisting of $180,000 for back pay, $200,000 for front pay, and $55,000 for pain, suffering, and humiliation, and (b) punitive damages in the amount of $8,000,000 against Schering; (2) from an award of attorneys' fees and costs totalling $396,989.35; and (3) from a post-judgment order that denied their motions for judgment notwithstanding the verdict, a new trial, or a remittitur in this age discrimination suit brought pursuant to the provisions of the New Jersey Law Against Discrimination, N.J.S.A. 10:5-1, et seq. Maiorino cross-appeals from that portion of the judgment that awarded him attorneys' fees and costs totalling $396,989.35, contending that the trial court should have applied a contingency fee enhancer to the lodestar to increase his award of attorneys' fees.
The proofs at trial established that Schering is a manufacturer of pharmaceutical products with a net worth of approximately $1,820,800,000 and an annualized 1994 net income of $987,800,000.

...El Presidente, The movie was part of the MMMF and landed second. It’s somehow a great movie but it was lacking a lot of things. It works on a plan whether on what Emilio Aguinaldo did and what he did to become the first President of country. The attempts of the movie was epic, it’s like you didn’t knew that was coming and anything. There are movies that are related to this like ‘Asiong Salonga’ but in El Presidente it’s more excited than Asiong. El Presidente is a movie that will reflect to kids of this generation because, I don’t know how many kids are interested about the First Philippine Republic, but this movie will bring them to being from ‘ngur-ngur’ to being a bit interested about the Philippine Government. I believe in this movie, it depends on which side you’ll go with if it is Aguinaldo or the other one. It’s at this lack that I guess I can make a jab at Jeorge Estregan’s portrayal of Aguinaldo. I understand his acting limitations, and, he couldn’t register that much facial expressions. Aguinaldo here is a wooden character, idealized as the best leader. There’s more time spent dressing him up in different costumes, and there are so many “photo-op” moments, where at times the movie actually goes into stills, rather than any time spent exploring his character, seeing what makes him tick. First off, the film is loose with its history. It draws mostly from Aguinaldo’s memoir, but that is only one perspective, and an obviously biased one at that. (This might be a...

It enables educators and trainers to author, schedule, deliver and report on surveys and quizzes, test and exams online with real time results. It has many advantages over the traditional (paper-based) assessment. Wed-based Entrance Exam embraces a wide range of student activity ranging from the use of online testing/e-learning software to on-screen testing. Sportsmanship

...Devon Warntz English 202 B James Brasfield October 15, 2013 What Is Sportsmanship? Sportsmanship can be looked at in a few ways. In the sports world it can be viewed as either positive or negative by us fans. The actions behind sportsmanship can be good or bad in nature. Merriam-Webster defines good sportsmanship as: “fair play, respect for opponents, and polite behavior by someone who is competing in a sport or other competition.” In contrast bad sportsmanship would be considered the opposite of good sportsmanship. Sportsmanship can be seen throughout the history of sports in both good and bad forms across all sports at all level of play. I associate good sportsmanship most closely with Respect. Showing an opponent respect is something that I was always taught by my coaches growing up. I played baseball, football, and I wrestled. The sport where I feel sportsmanship was taught to me the most was football. I started off playing pee wee football when I was seven years old. My first coaches were a father and son who very much understood what sportsmanship meant. From day one, I was always taught to respect my opponents and for the most part I always did. When I didn’t I learned my lesson. One instance I can recall is when I was playing midget football (a step above pee wee) and I had a really strict coach. I was a running back and had got stopped on a 4th down play. After I got stopped I slammed the ball on the ground in frustration clearly showing disrespect...

Apollo Space Emergency

...Many people believe that the number 13 is an unlucky number but the space program didn’t depend on luck. There were many American astronauts that went to the moon in Apollo 11 and 12. The mission began on April 11, 1997 Apollo 13 lifted off at 2:13pm from the launch pad in Cape Kennedy in Florida. It was an hour earlier at mission control in Houston (Cole 5). Lovell and Haise were supposed to land on the moon in an area named the Fra Mauro uplands. The Fra Mauro uplands were the site of a huge meteor crater near the moons equator. They were trying to see if that meteor millions of years ago had blew samples out of the moons insides. They wanted to get samples of the moon. Earth’s orbit had to put on a route to make it to the moon in three days (Cole 6-8). For the next two days the flight was going along very well then suddenly they heard a very loud bang on the spacecraft. The oxygen in the tanks was also used to react with hydrogen in the ships fuel cells. The energy produced by this chemical reaction within the fuel cells which provided all the electrical power in the craft 2 out of 3 fuel cells had shutdown. Mission control was working on the plan to get them down safely (Cole 10-12). Mission control realized that there must be oxygen leaving from the spacecraft. This escaping gas was causing enough power to push Apollo 13 off the route. Engineers began calculating course correction that would have been made later...

...Mac Miller vs. Donald Trump Facts: In August 2011, shortly after the music video to the song reached 20 million views on YouTube, Donald Trump tweeted about Mac Millers song “Donald Trump” claiming that he would be the next Eminem and there were big things ahead of him. Mac Miller went on to send Donald Trump a plaque for the songs accomplishments after it began to do good. The song was part of his 2011 mix tape entitled Best Day Ever. The issue is still at hand with Trump recently posting a new status against Mac Miller, instead of Mac arguing with Trump he has chosen to kill the issue with kindness even posting that he does not want negative energy but rather to be friends. Mac in an interview revels that the reason behind Trumps tantrum could be due to the fact that he stated Trump was a douche in an interview with complex magazine. Issue: Mac Miller went on to get over 75 million hits with the song alone which Donald Trump noticed. Donald Trump then claimed that he needed to get paid due to the fact that Mac Miller used his name illegally and took to tweeter to further threaten Mac Miller. Some statements made by Trump include “Little @MacMiller, you illegally used my name for your song “Donald Trump” which now has over 75 million hits.”, “Little @MacMiller, I’m now going to teach you a big boy lesson about lawsuits and finance. You ungrateful dog!”, and “Little Mac Miller’s next album may bomb. He can’t use my name again for sales.” Judgment: unresolved Reasons...

Varoom Model of Leadership

...Discussion Summary of the Vroom Model of Leadership Christine Cambruzzi MGT/230 Management Theory and Practice April 6, 2015 Professor Quinton Murphy Discussion Summary of the Vroom Model of Leadership The Vroom Model of Leadership places various points of situational questions on a scale to be rated high or low. Then it places styles of leadership along a continuum of potential leadership behaviors and bases them on the degree of authority exercised by the manager and the degree of importance to employees in making decisions. The theory finds that successful leaders have a clear understanding of the organizational forces and have good personal awareness. The Fiedler Contingency Model was created in the mid-1960s by Fred Fiedler. He was a scientist who studied the personality and characteristics of leaders. His model states that there is not one best style of leadership. It states instead that a leader's effectiveness is based on the situation. This is the result of two things which are the leadership style and situational favorableness. The Results With the Vroom method the researchers found there were three factors that influence the choice of a leadership style.  They are the leaders own personality, beliefs, values, knowledge, experience and confidence in the employees. Next was the employees need for independence, ability and readiness to take feedback about the importance of the issue. Lastly was the organizations culture, pressures and...

Why Is Donald Trump A Good President

...A lot of people think Donald Trump isn’t a good president and a lot of people think he is. I think he is a great president. A couple of reasons why I think he’s a great president are, he enacted historic tax and regulatory reform that has unleashed economic growth. He enforced President Barack Obama’s red line against Syria’s use of chemical weapons. And those are just some examples of what trump has done to make our country better. Very many people have their opinions on trump, people think he is a racist towards mexicans when really he’s just pointing out, all of the things they’ve done wrong. Like coming across the border without permission. People from Mexico are constantly trying to come over. So many people just assume “oh, yeah...

Media Influence On Election Essay

...How the media influence gave rise to Donald Trump In this new era of globalization, the media has more power and influence than it has ever had in the history of technology. The role of media over the years has become very important when it comes to political election. There is an interdependent relationship between politics and media, when it comes to the political elections. The media affects political elections and campaigns by communicating the agendas and beliefs of different political parties. The strong influence of media on political election can seal the fate of any electoral candidate or party. That is what happened in the case of Donald Trump, when he won the Republican primary votes. Prior to the Republican primary votes Trump had received too much media coverage compared to other presidential candidates, which eventually led to his unexpected victory in the race for the Republican presidential nomination. The media’s rules of an election change the face of the election itself. From my experience of watching the debates, I would say that each channel of media has its own bias. For example Fox news is known as the conservative cable network while MSNBC as the liberal one. Nowadays, it is almost impossible to hear story or news coverage without some twist. In the current election, the media has been (either intentionally or not) biased about the Republican presidential nomination. They had been an unlikely ally for Donald Trump, fueling his campaign...

A Study on the Hbr Article - E-Loyalty “Your Secret Weapon on the Web” by Frederick F. Reichheld & Phil Schefter

...A Study on the HBR article E-Loyalty “Your Secret Weapon on the Web” by Frederick F. Reichheld & Phil Schefter Introduction This study is about the Harvard Business Review article “E-loyalty - Your Secret Weapon on the Web” written by Frederick F. Reichheld & Phil Schefter. In the first section, an overview and summary of the article are presented. The overview includes the main points and examples that are considered important. 1. Overview 1.1. Importance of Loyalty in Internet: Reichheld and Schefter has been analyzing the Internet companies, their websites and applications for some time and they have concluded that , contrary to the common belief, today’s Internet users in both business-to-consumer and business-to-business worlds show high loyalty and they do not easily leave the companies that they have tried and trusted. According to the studies of the authors, acquiring a customer in e-commerce world is 20-40% costly than traditional retail channels. Therefore the losses in the early stages of a customer are bigger. But in the following years, the companies earn more from a loyal customer in e-commerce than that they do from their physical retail channels. Therefore the opportunity is bigger, but the risk also seems higher. If the companies end up with low retention rates, than they can face with bigger losses in e-commerce. It is also observed that loyal customers in the real world tend to be more profitable when they switch to web purchases. The idea...
