ETHICAL DILEMMA An ethical dilemma can be defined as a complex situation that often involves an apparent mental conflict between moral imperatives. In this movie context, an ethical dilemma is a debate between two moral principles, where two sides can argue about what is wrong or what is right. This is simply because each person has their own self-interest. However, there is no real answer to an ethical dilemma. It is simply a matter of what one believes in. In this movie, it tells us the story of parents who conceived a daughter which is Anna through genetic engineering in purpose to save her elder daughter Kate who was the patient of leukemia by donating her sister the blood and other body organs like kidney and marrow all over her life span. The ethical dilemma issue was portrayed in the movie started when Anna want to protect her own body from medical procedure by engage a lawyer and filed a law suit of medical emancipation against her parents. Now the question arises who is ethically correct? Whether Anna or her parents. Both sides argue that they are right and have a right to do so. From the parents’ perspective, the mother, Sarah fitzgerald strongly stick with ethics of care which a person should take care of the person close to him or dependent upon him. In this case, Kate depending on Anna for her living and Anna should help her out in every possible way. During the court session, Sarah make statement that people give their kidney to total stranger and this is the strong reason why Anna should give her kidney because they are family and not a stranger. However, from Anna point of view during court session is she believes in the right’s perspective. It is the positive right of Anna to protect and save her body organs and no one in the world can compel her to donate it to anyone forcefully. Anna also say that she want to be able to make decisions about what to do with her own body.
In ethics field, the justice and fairness concept is act as important concept. Therefore, Anna should been given justice and fairness from her family but it turn out Sarah only stand for Kate. In this movie, compensatory justice must take into account, according to which a person should be restored or compensated with whatever the person has lost, but in this case her parents can never compensate her blood, marrow or kidney. Besides, her mother is forcing Anna to donate the kidney to her sister without her willing and this forcing is invading in Anna liberty to live the way she want to. This is what we call the principal of equal liberty which mean that no one in the world is allowed to invade in any person’s liberty. Ethical dilemma can happen anywhere and anytime in our live whether in workplace, school, hospital or even in a family. So, how this problem can be resolve? The philosopher has two approaches in handling ethical dilemma. One approach focuses on the practical consequences of what we do; the other concentrates on the actions themselves. Therefore the three step-strategies have come out to combine both approaches. The first step is analyzing the consequence, it started by looking the consequence might happen in both range negative and positive by asking who will be helped by what you do?, who will be hurt? And what kind of benefits and harms are we talking about? The second step is analyzing the action; the action is about how they measure up against moral principles like honesty, fairness, equality, respecting the dignity of others, respecting people’s rights, and recognizing the vulnerability of individuals weaker or less fortunate than others? The last step is making a decision, the decision can be making by taking both part of the analysis into account. Back to the movie, the ethical dilemma is been resolved by adopting this approaches whether they realize it or not. In Anna context, she fully understand the negative and positive consequence might happen if she sue her parents for medical emancipation, she will be able to help her sister to fulfill the wish to die who do not want to suffer anymore because she know the surgery will not help in fully recover and only prolong the life of sickness. The one who will be hurt most is her parents and this might ruin family relationships. Sarah doesn’t want to let Kate to die early because she loves her too much and it is her responsibility as a mother to keep Kate alive. After knowing the consequences, Anna makes decision and takes action to hiring a lawyer and filed a law suit of medical emancipation against her parents which is the best way to solve the entire problem. Finally, Anna won the case and officially granted medical emancipation. The result gives positive impact toward her family after Kate die. Sarah began again her career as a lawyer and earns more money for the family and the son going to Art College to continued study.
