Release of Report on Art Industry in India: Policy Recommendations April 2, 2010 Kolkata REPORT
The visual art sector in India has grown exponentially in the recent years with both appreciation and market for Indian art expanding domestically and beyond the national borders. Nevertheless, it has also brought to fore the myriad of challenges that the art ecosystem in India is faced with. Be it for addressing the regulatory issues pertaining to art, beefing up the art education infrastructure, changing the way artworks are looked upon from ‘Instruments of wealth creation’ to ‘Intellectual Property’, a need is strongly felt for developing a holistic policy approach towards the sector as also for better enforcement of the existing policy instruments. It is against this backdrop, FICCI in association with Amarchand Mangaldas and Deloitte has prepared a first-of-its-kind report on ‘Art Industry in India: Policy Recommendations’. The Report makes an attempt to assess the existing legislative and taxation regimes pertaining to visual arts in India, identify the issues and challenges facing the art economy and outlines a roadmap for aligning our policies with the global best practices. “With exponential growth in the volume of art trade in India, what is needed is a broad framework for this sector.” said Mr. Jawhar Sircar, Secretary, Ministry of Culture, Government of India, while releasing the Report at an Interactive Seminar organized by FICCI in Kolkata on April 2, 2010. Talking about the Ministry’s initiatives, Mr. Sircar said, “We are planning museums of modern art in states. A scheme for regional museums is being worked out. The budgets are being upscaled to between Rs. 3-6 crore. Other spheres that are being reviewed are the Antiquities Act, art funds and art authentication.” “Museum and galleries in India need considerable improvement in communication, management, business and publication procedures,” Mr. Sircar said, adding that there was a need to explore possibilities of launching a course on museum and gallery management. In her Welcome Address, Mrs. Rakhi Sarkar, Chairperson, FICCI Committee on Art and Business of Art said “FICCI through FRAMES has opened the world of Indian cinema to global investors and viewership and now through its Committee on Art, FICCI hopes to help the Government to create a comprehensive policy framework and thereby open up the prospect of art and cultural commerce in India.” Citing China’s example, Mrs. Sarkar added that India should expedite speedy development in the area of cultural tourism and unleash the dynamism and creative energy of this nation. “While art is basically a knowledge industry, people have also created a lot of wealth from it. We need to come up with smoother tax systems. Corporate philanthropy in art also needs to be incentivized in India like it is overseas.” said Mr. Roopen Roy, Managing Director, Deloittes and Touche Consulting India Pvt. Ltd addressing the Seminar. According to Amarchand Mangaldas, who contributed the section on legislative framework in the Report, a holistic approach through a National Art Policy was needed to support the growth of the sector. Amarchand Mangaldas was represented by Mr. Suhaan Mukerji and Mr. Aditya Rao at the Seminar. “The national policy is not intended to intervene in artistic and creative expressions but is expected to formulate a public framework to direct investments in art,” Mr. Ashok Vajpeyi, Chairman, Lalit Kala Akademi said. The spending on art in China was nearly 20 times higher than that in India, he pointed out.

“We need proper guidelines and frameworks to foster the growth of art in the country. Any policy has a definitiveness that goes against the principles of creativity. Artists would like to remain outside government inventions,” Mr. Gautam Sengupta, Director General, Archaeological Survey of India said. Addressing the Seminar, Dr. Rajeev Lochan, Director, National Gallery of Modern Art highlighted insurance and valuation of artworks as a major concern area. He also urged the need for simplifying the export procedures for antiquities. Mr. Jogen Chowdhury, Artist and Trustee, Kolkata Museum of Modern Art (KMOMA), requested the Ministry to consider creating a separate structure for faculty recruitment in art colleges and institutions outside the purview of UGC. He also suggested that locker facilities could be provided in different cities where artists could store their art works. Lalit Kala Akademi, through its regional offices could take the lead in this initiative, he added. Commending the Report, Secretary, Culture said, “I am very pleased to see such a systematic collation of ideas, proposals and desirables covering such a wide variety of issues pertaining to the world of art.” Among the key recommendations the Report put forwards include: • A National Art Policy (“Policy”) to be formulated after due consultation with all industry factions/participants, with the overall objective of fostering the growth of art and promulgation of cultural ideas through artworks. World class Art Institutes/Centres for Excellence need to be established on a PPP basis The existing provisions relating to Percent for Art in Public Places should be enforced An Independent Regulatory Organisation (IRO) be set up by the Ministry of Culture with the objective to promote and ensure orderly growth of while protecting the interest of industry, artists and consumers. It is imperative to create state-of-the-art specialised channels for carrying fragile objects including artworks at airports, railway stations and ports to ensure safe and undamaged movement of art. A full expense deduction for the amount of donation made to the art sector by corporate establishments may be considered To adjust for the income fluctuations that artists experience, an income averaging concept may be evolved for tax purposes in line with practices prevailing in Australia, Germany and other countries Abolition of customs duty on import of artwork A uniform 1% VAT on artworks across states in the country A single window clearance system needs to be set-up for the art industry so that one is required to approach only one authority which in turn would internally co-ordinate amongst the different forums and the import/export of artwork is done seamlessly

Taxation of Cross Borders Mergers & Acquisitions: Vodafone Hutch Deal

...repatriated to the Indian Company by the IHC or to the IHC by the target company would attract double taxation. Double taxation is a situation in which two or more taxes are paid for the same income/transaction which arises because of the overlap between different countries tax laws and jurisdictions. The liability is then mitigated or off settled by tax treaties between the two countries. An ideal location for an IHC would be one with low/nil withholding tax on receipts, on income streams and on subsequent re-distribution as passive income. Some of the jurisdictions preferred for repatriating back to India include Mauritius, Cyprus, Singapore and Netherlands, which have relatively better tax treaties with India. Essentially the Vodafone Hutch deal involved transfer of shares of a non-resident Cayman Islands based entity...

Knara Prime: A Short Story

...“Well that was a quick change of heart,” commented Daryn who had come to sit in the copilot’s seat to view the activity in front of their ship and to better hear the conversation between Hutch and the patrol ship. With a sigh and a grin, Hutch smugly said, “I’ve delivered here before, Despite the ludicrous amount of credits spent to go to school here, and how well stocked the cafeterias are, the parents still worry that their particular child’s needs aren’t being met or that the pillows aren’t soft enough, the blankets, not warm enough. The largest obstacle the administration has to deal with here, isn’t in the curriculum or daily management. It from parental interference.” “Huh, I didn’t know that. I’ve never been to a university before…,” Daryn said a bit wistfully. “Don’t be jealous my friend. While these kids are learning a great deal, they are not getting any practical knowledge you can only get by doing. If you want to truly earn something, I find...

...http://www.slideshare.net/hemanthcrpatna/a-project-report-on-comparative-analysis-of-marketing-strategies-of-vodafone-and-airtel In 2002, the leading Indian telecommunications company, Bharti Cellular Limited (Bharti) signed the famous cricket player Saurav Ganguly and leading movie stars, Madhavan and Kareena Kapoor as endorsers for its brand, Airtel Magic (pre-paid cellular card). Its objective was to create the highest recall for Magic in the pre-paid cellular telephony segment by cashing in on the two biggest passions of India - movies and cricket. Bharti also changed the tagline for Magic from 'You Can Do Magic' to 'Magic Hai To Mumkin Hai' (If there is Magic, it's possible). The move attracted considerable media attention, as it was unusual for a company to spend so lavishly to promote a single brand. In October 2002, Bharti launched a television commercial (TVC), featuring Shah Rukh Khan (leading actor, already endorsing Magic since a couple of years) and Kareena Kapoor. The TVC, developed by one of India's leading advertising agencies, Percept Advertising, was the first of the series of four TVCs for Magic's new campaign. According to Bharti, the TVCs aimed at attracting young adults in SEC B and C categories of the Indian market1. | | Commenting on the new developments, Hemant Sachdev (Hemant), Director, Marketing and Corporate Communications, Bharti Enterprises, said, "The aim is to be relevant to the masses and make all their dreams, hopes and desires come...

...Arizona Senate Bill 1070 Support Our Law Enforcem ent and Safe Neighborhoods Act Abstract On April 23, 2010 Arizona Governor Jan Brewer signed Senate Bill 1070 into law in order to resolve immigration problems in her state (McFayden, 2011). It is one of the toughest pieces of legislation in the nation. SB 1070 allows Arizona law enforcement to stop, detain, and arrest any undocumented immigrants if the officers have a “reasonable suspicion.” This law not only makes it a crime to be in the Arizona illegally, but also a crime to transport or hire someone for employment as well (McFayden, 2011). Judicial Watch (2011) pointed out that Arizona has a right to defend itself under the Constitution if the federal government fails to stop illegal immigrants from crossing its border. In addition, this article confirmed that the creating of SB 1070 complied with the relevant federal, state and local laws, the Arizona Constitution, and the U.S. Constitution. The SB 1070 complements the immigration law rather than usurping the federal jurisdiction. It protects the American citizens and the legal immigrants in Arizona through a legislation that is enforceable against the illegal immigrants, the employers who engage in hiring the illegal immigrants, and those who are involved in transporting the illegal immigrants. ...domestic rabbit, and you will understand its appeal. Recognize it as an animal that thrives almost anywhere and is inexpensive to obtain and easy to maintain. Add its legend any prolificacy, its unmatched cleanliness, and a steadfast refusal to bark at the moon at midnight or crow at the neighbor at 6 A.M. Consider, above all, its versatility, and you will readily comprehend it’s steadily, zooming popularity. If you going to start a rabbitry you will first need to be able to find out if u have the space for a 35 by 24 rabbit hutch for indoors or outdoors. Once u get all that figured out, u need to find out what kind of bedding u will be getting. The three best bedding u can get is straw, hay, and wood shavings. In the summer u would probably want to mix wood shavings and hay. You could also put a frozen water bottle in there so they can lie on it to cool down. It’s a good idea to have the bedding about 3 inches thick through out the hole box of the hutch. In winter line the whole cage with stray or hay. If it is possible get the straw or hay stacte on the sides of the walls. The next step of building a rabbitry is to build your herd. There is multiple different rabbits to choose from. You could pick the small breeds, like the Nether Land Dwarf or the large breeds, like the German Grey Giant. You also need to know what you are raising rabbits for. The top three things for rabbits are meat, show, and breeding. If you choose to raise them for meat you want to go with the giant...

Argument

...Hannah Hatfield Mr. Newell English 101-066 12 November 2009 What Language Am I Speaking Now? After becoming a Christian every person is granted a spiritual gift through the Holy Spirit. It is in these gifts one’s talents and abilities inside and out of the church are magnified tenfold to be used for the glory of God. Although some would deny the actuality of the spiritual gifts all together most would agree the existence of such gifts as wisdom, teaching, leading or compassion. However it is with the more controversial gifts that most evangelical Christians have suspicions towards, such as prophecy, the discerning of spirits and the working of miracles. However it is the gift of tongues which is the cause for most arguments concerning the spiritual gifts. In more conservative churches, the gift of tongues is not practiced, however in Pentecostal, as well as other charismatic churches the gift of tongues is considered accomplished. By discrediting those who speak in tongues, establishing the language itself and by citing Paul in his letter to the Corinthian church shows the gift of tongues or formally known as glossolalia, is no longer existent in today’s world but rather an outlet for emotion. Being able to disprove the gift of tongues through a psychological stand point by finding information correlating to glossolalia may be difficult however it is Daniel S. Smith and J. Roland Fleck in “Personality Correlates of Conventional and Unconventional Glossolalia” who finds...
