...Did Jim and Laura Buy a Car? Kanise K. Kelley Strayer University Professor Montano Business Law 100 November 8, 2015 Some good friends of mines, Jim and Laura Buyer they currently visited the local dealership because they are interested in buying a new car. The car they currently own is on its last leg, its aging and starting to have mechanical problems. Jim and Laura would share the new car, and use it to go back and forth to work and school. Before going to the dealership, they decide that they can only afford $400.00 a month in car payments. Once at the dealership, Jim and Laura meet Stan Salesman. Stan shows them several vehicles and Jim and Laura test drive several of the cars. Jim and Laura particularly like a blue 4-door sedan. Therefore, they agreed to give Stan Salesman a $100.00 deposit to hold the car for a day. Stan Salesman does not give them the receipt but guarantees that the $100.oo is refundable. No documents were signed before leaving the dealership. They then say the next day, Stan Salesman calls them to ask them when they would like to take delivery of the car. But Jim and Laura decided they didn’t want the car any longer after leaving the dealership, so they tell Stan Salesman that they wanted their $100.00 deposit back. Stan insists that the $100.00 was a deposit on the car and was meant to be part of the contract. Stan is very persistent and insistent that they have contracted to buy the car, therefore the $100.00 will be applied...

Did Jim and Laura Buy a Car

...clear manifestation of willingness to enter an agreement made by another person with full understanding that their assent to the bargain is an invitation and is concluded. As to whether there was an offer in this case, yes there is an offer. When the salesman offered the buyers time for a test drive and they finally chose and agreed to buy the blue car it was a clear offer. Acceptance. This basically means that the terms of the offer have been clearly understood and agreed to through consent and assent and at no time will the terms be changed. When the buyers agreed to the terms of sales and even agreed to pay a deposit, it clearly shows that they have accepted the seller’s offer. Legal purpose. It means that the reason for the contract must be legal. In this case, the sale and purchase of a car from a licensed dealer is legal and done under the regulations specified by law. Mutuality of obligation. This refers to the parties’ mutual understanding and also assents in expressing their agreement. They must both agree to the same sense, same thing ant also the same time. When the two buyers approached a dealer seeking to purchase a car, there was both an offer and acceptance. There was clear communication between the terms of the buyer and the seller and were both in mutual agreement. Consideration is basically the benefit to the person making a promise or the person to which the promise is intended for. In this case, both the buyers and the seller agreed to the terms and conditions...

Huck Finn

...could easily be fixed in our world today. Most characters in this novel fall guilty to this one time or another and some fall more than others do. Two big examples of this theme in the book Huckleberry Finn are the King and the Duke. Huck and Jim first encounter the King and the Duke when they are on the raft and the King and Duke being chased out of a town and they jump aboard the raft. As soon as they are on the raft the King and Duke make up stories on how they are royalty. The Duke does his story first saying he is the rightful Duke of Bridgewater by decent of his great-grandfather who was the eldest son of the old Duke of Bridgewater. The Duke because he was a “Duke” had Huck and Jim call him names like “Your Grace” “Your Lordship” and etcetera. After hearing this, the King then tells a story on how he is the late Dauphin “Looy” the seventeen, son of “Looy” the sixteenth and Marie Antonette. He also goes on saying how he should e the rightful king of France. The King made them call him names like “His Majesty” and another names fitting of a king. He also had Huck and Jim give him special privileges like waiting on him to eat first at meals. After the King and Duke establish who they “are” they become quite the team. They use Huck and Jim to boat them around and cater to their needs. The King and Duke also took advantage of the people Bricksville’s simplicity and ignorance with the Royal Nonesuch scheme, in which...

How to Contrast and Compare in an Essay

...How to compare and contrast essay As you generate points of comparison, consider the purpose and content of the assignment and the focus of the class. What do you think the professor wants you to learn by doing this comparison/contrast? How does it fit with what you have been studying so far and with the other assignments in the course? Are there any clues about what to focus on in the assignment itself? Here are some general questions about different types of things you might have to compare. These are by no means complete or definitive lists; they’re just here to give you some ideas—you can generate your own questions for these and other types of comparison. You may want to begin by using the questions reporters traditionally ask: Who? What? Where? When? Why? How? If you’re talking about objects, you might also consider general properties like size, shape, color, sound, weight, taste, texture, smell, number, duration, and location. Two historical periods or events When did they occur—do you know the date(s) and duration? What happened or changed during each? Why are they significant? What kinds of work did people do? What kinds of relationships did they have? What did they value? What kinds of governments were there? Who were important people involved? What caused events in these periods, and what consequences did they have later on? Two ideas or theories What are they about? Did they originate at some particular time? Who created them? Who uses or defends them? What...

Aggressive Driving

...about her. If those people that comment mean things talking about her where not just a profile and was someone face to face we usually wouldn't say things like that. Also in the Vanderbilt’s essay he talks about the road rage and the different types of communication while driving. Many people while driving get very upset with other drivers if they need to be somewhere quickly, or even if the person is driving slower then they want to drive, which cause the person that is behind the person that is going slow to speed up and cut them off. I have seen a lot of incidents where people cut someone off and they want to get pay back on they so they try to cut them off back, then it turns into an accident. Citizens do not understand how dangerous cars and truck are when we are behind the wheel, they can hurt someone very badly plus even kill them. We as people need to understand that our ethical compilations need to help us from being cyborgs, to understand that we have to live our own life without having to use all the new technology. People today are totally cyborgs we use technology in everything we do. We hardly do this that does not consist of new technology advancements. Whenever, people have questions that we need to find answers for we go on our phones or computers to google the answer. New technology has made greater openness possible, but has this...

Cars

...still going to cost you a tidy five-figure sum to buy the necessary parts, materials and paint supplies needed to transform an old car from a worn-out relic to a dazzling show beauty. If you've decided to restore a particular old car because you have a longstanding attachment to that model and are not concerned about its value or whether parts can be easily found, then we applaud you--that mindset should be the primary focus of this great hobby of ours. However, if you enjoy old car restoration but prefer your projects to be easy and relatively cheap to do--with, perhaps, the added bonus of making a few dollars on it when it's done--then these are the cars you should consider for your next venture. Of course, the majority of these cars won't make you stand apart from the crowd at a show or cruise-in, but you will be able to complete their restoration far faster and a whole lot cheaper than if you chose a car that was rare, or had only been made for a few years. Another factor to consider is the actual purchase price of the car. While some of the cars listed here can be bought for around $5,000, others will cost four times as much even if they're basket cases--but keep in mind that those higher-priced cars will also bring four times the money when sold, so it kind of equals out. But the one common feature enjoyed by most of these cars--and the main reason why they are on this list--is that they're backed by a huge parts supply, making them a lot easier to restore...

Oft times just putting new batteries in the transmitter will allow them to resume working flawlessly, but at times a repair is needed. There is amazing cars all over the world I have lots of cars I really like. Cars are an art. Nothing is better than the bond you can make by building your own car. It’s a whole other feeling. Cars are amazing. For three reasons. First reason is that they are fast. In my opinion of a good fast car. I would get a 1967 Ford Mustang Shelby GT500. Just because that’s my style. This car is rolling fast yea there is faster imports, but this is classic, friendly but crazy fast. This is a beast on 4 wheels. 271 horse power you bet its fast. This car goes from 0-60 in 4.3 seconds. This is just one of the millions of cars out there. Cars are legit the best past time because of their incredible speed. Another fast car is the 1987 Grand National. This car is fast and slick, you need a getaway car this is your car. Its precise steering with the right driver you can drive miracles. Visionary Leader

...[Title Here, up to 12 Words, on One to Two Lines] Jim Jones Visionary Leader/Ethical Leader Synthesis Essay In this essay I will explain why Jim Jones was a Visionary Leader but by no means an ethical leader. In many ways Jim Jones was decades ahead of his time with regards to social issues. His leadership helped many disadvantaged people in Indianapolis, Indiana. At first glance it may appear he used his Visionary Leadership for a higher cause; however his unethical pursuits, ultimately resulted in the downfall of his church, his followers and himself when 914 members of his congregation committed suicide after “drinking the Kool Aid”. Visionary Leadership From early in his life Jim Jones had a vision of the world he wanted to live in. Jim Jones was born the only child of a disabled veteran father and working mother during the Great Depression. His poor upbringing shaped his vision of a world in which all people were equal. As an adult he began to attend uni-racial churches in Indianapolis. In 1961 he became the first white man to adopt and African-American child in Indiana (Ryan, 2011). Shortly thereafter he became disenfranchised with the segregation, of the congregations, in the churches he attended. In response to this social norm of the time, Jim Jones visionary leadership began. He started by establishing the Peoples Temple and invited all races and social demographics to join his congregation. Jim Jones encouraged Demographic Diversity (USAF) because...

Jim Morrison

...How Jim Morrison’s Poetry Lead A Movement The United States of America found itself in a peculiar situation near the closing of 1959 and the beginning of 1960. There was a tremendous split between two very different generations. The older generation was a collection of people that witnessed the terrible acts of communism and the reign of Hitler, they fought bravely to expel Nazi Germany from the world and witnessed an attack on their own nation. They were a nation of go-getters that believed in the American Dream and worked to fulfill it. The children of this noble and brave generation found themselves questioning the world they lived in and the powers that held control over them. This new, counter-culture generation was later coined the Hippie Generation. Through the Celebration of the Lizard, Jim Morrison reinvents the idea of freedom, excess, and the search for individual identity at a time where the counter-culture movement was gaining massive popularity. This new culture, created out of America’s individuality, later went on to become the biggest and most widespread movement that preached the importance of the individual and expelled any belief in capitalism. “The road to excess leads to the palace of wisdom..” was a quote taken from William Blake, an English poet, that Jim Morrison held close to him. This quote is more than a line from a poem but a motto for a generation that strayed away from contemporary thought and forged a path that was their own in each and every way...
