MILLERSBURG — Accused of making threats against a Holmes County probation officer, an Orrville man is back in jail after allegedly violating bond conditions — failing to report to probation and testing positive for metamphetamine.
John R. Harig Jr., 36, of 2030 S. Kansas Road, has pleaded not guilty Holmes County Common Pleas Court to a single count of intimidation, a third-degree felony, which carries a potential sentence of up to three years in prison.
He was in court Thursday on the state’s motion to revoke bond, filed after he reportedly failed to check in with adult probation several times since July 20, according to Holmes County Assistant Prosecutor Chris Oehl.
Visiting Judge Edward O’Farrell indicated he would simply continue Harig’s pretrial bond on condition he passed a drug test. But, then field testing of his urine indicated the presence of meth. …show more content…
In the wake of Harig’s suggestion, through defense attorney John Johnson Jr., the test had to be inaccurate, O’Farrell ordered advanced lab analysis of the sample and said he would release Harig if that testing identifies the presumptive result as being a false positive.
Probation officer Sean Hoxworth, a 20-plus-year veteran, said it’s rare the presumptive field test is wrong, and he is personally unaware of any false positives for the presence of meth.
Harig, advised of the consequences of lying under oath, including the potential of a perjury charge, elected not to testify on the drug use allegation. He indicated, through Johnson, his failure to report to probation was a consequence of transportation issues and an unrelated incarceration in Wayne County.
His case is scheduled for a jury trial set to begin on Sept. 19.
