Question 1
All legal systems are conceived with the idea of providing a body of laws that are to be adhered to by nations and the individuals residing in them so that a sense of social order and growth can be achieved in a way that may ultimately lead to prosperity for the nation (Kritzer 2003) . Different countries employ many varied legal systems in an effort to ensure this stability and growth. Two such legal systems used by a great number of countries today are the Common Law and
Civil law systems (DFAT 2012) . The origins of Common Law extend back almost a thousand years to the Middle Ages in England, and has slowly developed to become a widely used legal system all over the world, implemented in first world western nations such as Australia, America and Canada as well as developing economic powerhouses such as India (Kritzer 2003). The roots of Civil Law can be traced back even further to the accumulation of Roman law in the 6 th century CE.
Much of Europe still uses the Civil law system as it has for hundreds of years.
(Dainow 1996 ). As with all legal systems both Civil and Common law systems have their differences, which in turn makes up what you could call their strengths and weaknesses. The main difference between the two is how cases are decided within the system. The use of Common law sees cases decided mainly on the precedent of cases that have come before as will further be demonstrated whereas Civil law relies on the use of codes, principles and statutes to create and uphold the law when deciding cases. When deciding

which is ‘better’, or perhaps a more fitting term ‘more reliable’, these strengths and weaknesses should be looked at in conjuncture with how they affect the nation as a whole and more specifically the economic implications of each legal system. From this analyses it could be possible to

Premarital Sex Premarital Sex and Religion The Catholic Church teaches that premarital sex is wrong, yet it is still widely practiced around the world. The reason marriage was created was to join two people of the opposite sex together in a holy sacrament that would make the couple one. God's reason for marriage is quoted in the bible when he said, "For this reason a man shall leave his father and his mother and be joined to his wife, and the two shall become one flesh" . The Sacrament of marriage is one of the most sacred Sacraments in the Catholic Religion. By performing premarital sex, the couple is breaking a covenant with God and is performing a sin. Marriage is the joining of a couple in the eyes of God and in the eyes of the State. When two people are joined into marriage they become...

Otherwise known as "Fraternity files". these essay banks were practices in which students shared term papers and submitted work that had been done by other students.[2] These essay banks inspired the commercialization of ghostwritten essay-writing practices. As early as the 1950s, advertisements were circulating college campus that described services that included ghostwritten work for dissertations, theses, and term papers.[2] In conjunction with this practice, the changing attitudes of students in the 1960s and 1970s started to stray away from diligent and engaged course work because they saw an emphasis on the benefits of community involvement. Gun Control

...Gun Control Essay 1 Gun Control Essay 06/14/2015 The right to bear arms is guaranteed in the constitution by the Second Amendment. Many politicians are looking to amend the constitution any way they can to ban handguns or at least Gun Control Essay 2 restrict sales. The argument between pro and anti gun control has been debated for years, both with valid points. Many studies and factual data shows that strict gun control only removes guns from law-abiding citizens, but does not actually help reduce crime. Studies have shown that gun control cannot stop people from committing the crime because if a handgun ban were issued, there is evidence that citizens would not comply with the law, strict gun control does not reduce homicide rates, and studies have found that high crime rates have stimulated purchasing of guns rather than high gun ownership stimulating crime. While the Founding Fathers of this country were developing the system of government, as set forth in the Constitution, many feared that a standing army controlled by a strong central government would leave them helpless. The Federal Constitution contained no provisions to prohibit a standing army or allow states to create their own militias. The Constitution was signed by thirty-nine men from the twelve states represented at the Constitutional Convention on September 17 1787; three delegates refused to sign because of the absence of a bill of rights. Two years later, the First Congress agreed on...

One of the reasons for that is the shocking fact that the poor often pay more taxes, relatively, than do the rich. In Britain, for example, “the tax burden of the top fifth of earners has fallen from 37 percent to 35 percent in the last twenty years. In contrast, the tax burden of the bottom fifth has risen from 31 percent to 38 percent.” The other reason for social inequality nationally is imperfect income distribution. Thus, whereas 23.5 percent of all American workers received only poverty level wages in 1973, this had risen to 28.6 percent by 1997. Looked at another way, real wages for relatively low-paid workers fell by 22 percent between 1973 and 1995, and 10 percent for middle-range workers. Low-paid jobs grew by 22 percent in New York City between 1993 and 2000—four...

We Need Truth

...We need truth in order to live.  Although sufficiently available to us, truth has become elusive for many people.  So how is it that we need truth but not seem to find it?  The answer lies in our rejection of the underlying order of the universe, which we speak of as law.  For us to recognize law is to recognize truth.  It is law that causes the earth to revolve around the sun and men to bleed when cut.  It is also law that speaks from our inmost depths, commanding the love of God and neighbor, the honor of parents and the protection of our children from harm, to the cost of our lives. The articles on this page touch on various topics.  In one way or another, however, they all deal with the moral law, particularly with regard to the protection of innocent human life.  It is our hope that these writings will assist those in the trenches who are fighting the "good fight," as well the many who are confused about truth and law and have lost their way.    What About Abortion An essay written by Larry Bohannon.  This essay briefly explains the realities of abortion, and is written for college students and young adults. Criminology is a social science; its main aim is to research crime and individuals who commit crime, while also looking at the criminal justice system in the hope that this information can be transformed into policies that will be effective in handling, or even eliminating crime. Although it is a specialty, it's not a single discipline. It combines the efforts of sociologists, psychologists, psychiatry, biology, law and statistics. It produces findings that can support, judges, prosecutors, lawyers, probation officers, and prison officials, giving them a better understanding of crime and criminals, and to develop improved and more appropriate sentences and treatments for criminal behaviour. Criminology centres its attention on the criminal as a person, his or hers behaviour, and what has led him or her to a life of crime. It also looks at society's reaction towards breaking laws. Task 2: Explain the difference between macro and micro theories used by Criminologists. Macro theory and Micro theory are both detailed theories that pay close attention to different aspects of crime and criminal behaviour. The Macro theory of crime and criminal behaviour explains the larger scale of crime across the world...
