The Legal Standards for Selection requires that the selection process be conducted in a way that avoids discrimination and provides access to employees with disabilities. The Equal Opportunity law affects the information that organizations may gather from an applicant. (Noe, Hollenbeck, Gerhart, & Wright, 2008). The Legal Standards for Selection would have a great impact on any organization. The Human Resource professional must abide by the laws to provide an equal opportunity to their potential hires. If the Human Resource professional is not knowledgeable with the equal opportunity laws, they in turn could be a great liability for their organization and leave a negative impact. Upholding the equal opportunity laws, a Human Resource professional will ensure that there will be no room for discrimination. There are a number of questions that a Human Resource professional may ask a selected candidate as a part of their selection process. There are also impermissible questions that a HR professional can ask that would violate a candidates’ rights and would make them also in violation of the law which are some common mistakes that managers make in their selection process. These problems can occur when the HR professional does not understand the equal opportunity law and how it affects their organization. These problems can all be eliminated by the HR professional making sure that they are adept in the laws regarding employment and candidate rights.
