LEG100: Business Law

Florida is a state which has been endowed with immense potential in regards to companies which offer their services (Jennings, 2008 ). On top of the list of some of the renowned companies within this state are companies which are in the transport sector. Businesses and those who own interests need to know their rights and obligations. What is legal? Where can I find the laws I need to know? How do I make decisions about legal conduct that, personally, is morally or ethically troublesome to me? This is because these are aspects which enable the businesses to grow and gain momentum. It is important for businesses to know the aspects of businesses which are of value. This is because these aspects enable the businessmen to work in accordance with the law. In this case, there are several purposes of business law. It is worth noting that there are two types of law. Public law includes laws that are enacted by some authorized government body. State and federal constitutions and statues are all examples of public laws, are the federal constitutions and statutes are all examples of public laws, as are the federal securities laws, state incorporation and partnership procedures, and zoning laws (Jennings M. , 2005). Private law, on the other hand, is developed between two individuals. For example, landlords usually have regulations for their tenants, and these regulations are private laws (Jennings M. , 2005). First, purposes of the law include the fact that they carry some form of penalty for their violation. Traffic violations carry a fine or imprisonment, or both. Violations of civil laws also carry sanctions. A driver who injures another while driving intoxicated must pay for the damages and the costs of the injuries of the other entire person. These laws prevent feuds and other less civilized ways of settling disputes (Beatty & Samuelson, 2009). Laws also influence the conduct of the society’s members. For example, securities laws require certain disclosures about securities before they can be sold to the public. Businesses commit resources, people, and time with the expectation that the contracts for those commitments will be honored and enforced. Investors buy stocks knowing that they have protection in that investment through securities laws. Knowing we have protection in the law allows us to trust, contract, and invest. Laws have been used to achieve equality. For example, the equal opportunity employment acts were passed to bring equality to the job market. The social welfare programs of state and federal governments were created to further the cause of economic justice. The antitrust laws attempt to encourage competition and support the free enterprise. A final and very important purpose of law is to act as the great compromiser. Law serves to mesh different views into one united view so that all parties are at least partially satisfied. When disputes occur, the courts use laws to resolve two opposing views. In relation between labor and management, the law serves as the mediator (Jennings, 2008 ). One of the companies which offer moving services is the Allianz the Diligent Movers. This is a company which serves customers from all over the United States of America. The company has been in the business for over fourteen years. It is a company which depends on the expert staff who are professional in their business undertakings. It focuses on residential moves. In this case, it enables people who are moving from one residence to another especially when you are within the state. This company has excelled because it has thrived on experience and professionalism. These are the key aspects which have ensured that this company is rated as one of the premier courier companies in the United States of America. Business moves, in this case, when an organization or a company is relocating from one place to another there is need to ensure that there is little disruption. This company offers these services at affordable costs. Long distance moves, this company offers solutions to long distance moves. The company also offers courier services. It is the company which serves customers across the United States of America, by ensuring that their parcels are delivered on time and in the best possible condition.

This company has a major development plan to ensure that it gains an edge over other companies in the same area. Essentially, there are several areas which the company has set up strategies to ensure that the set goals are realized. One of the major initiatives which this company is working on is to introduce an elaborate approach towards transportation. Venturing in this sector entails understanding the statues within the state. In this case, this is in line with the Florida Transportation department’s strategic plan. The Florida Transportation plan is a updated every five years and about to be updated to a 2025 plan which is a 20 year project specific transportation with a wide range of transportation agencies and stakeholders. It is important to note that transportation whether or not considered as a public utility, whether performed by publicly or privately owned enterprises, is usually subjected to specific laws which set the industry apart from most other businesses which are governed only by general business law. Thirdly, to enlarge the courier service industry it entails creating more avenues and routes to disseminate the courier services. As a major contender in this sector, much is expected from the customers. This is especially so with emerging markets which are within the reach of the company. In addition, to develop a training facility for the employees, this is in line with the company’s future projections to ensure that it is the leading provider of transport services in various aspects. For example, with the introduction of the transportation department, this means that the company will have to train the drivers and any other stakeholders who are involved in the business. To establish international partners in the same line of business in order to diversify their local and international operations is the fourth dimension. This implies seeking partners in other continents to ensure that they share similar interests and business objectives. This will call for this company to seek to apply international business law with regard to business mergers. It is important for the company to ensure that it complies with the regulations which govern business mergers. In this case, the company is seeking horizontal merger. This means that the merger under consideration is a horizontal merger (Miller & Jentz, 2010 ). That is a merger between firms that compete with each other in the same market. In this case, it is important to note that a horizontal merger which creates an entity with a significant market share, the merger will be presumed illegal because it increases market concentration. It is important for the company to take note of the Federal Trade Commission and the U.S Department of Justice established guidelines indicating which mergers can be challenged and which can be permitted (Miller & Jentz, 2010 ). Lastly, the company is working towards establishing an excellence center to recognize the employees and the customers who have made remarkable impression upon the company. This calls for regulations which will ensure that the procedures which are followed or upheld are within the regulations set. In conclusion, it is important to note there are a myriad of regulations which the management should put into consideration before venturing out to implement the ventures. In addition, any venture which the company is engaged into should be subject state and federal business objectives (Miller & Jentz, 2009). Without these the relevance of these advancements are brought no nil. Regardless of how law is defined, knowledge of business law is essential for any businessperson. To make business decision, business persons must have some basic knowledge of the laws and regulations governing those decisions. Furthermore, in today’s world, businesspersons and organizations are expected to make decisions that are ethical as well as legally sound. Thus, the study of business law involves an ethical dimension which ensures that the business goals are realized within the set legal regulations.
