Lemon Law Lemon laws were another way for consumers to get some sort of compensation for a vehicle. This law is enacted in several states including California, the basic premise of this law is that when you purchase a car and the car does not meet standards or constantly breaks down then they have a right to go to return to the manufacturer. The only way that this will work out is if the car is still under manufacturer’s warranty. The manufacture is given several opportunity to fix the problem whether it is replacing the parts, or fixing the automobile in a timely manner if this does not work the manufacture has to give the consumer the money for the car. With this being said this law will only work if the automobile manufacture is not in bankruptcy. What is the case when the only safety net that is there for the consumer is taken away? How are people going to go out with the same confidence?
“Under the California law, new or used vehicles that have a defect that can't be repaired after four attempts -- or two, in the case of life-threatening defects -- or that have been out of service for 30 days during the warranty period may be designated "lemons." That triggers an obligation for the manufacturer to either pay the owner a cash settlement or buy back the vehicle.” This is the safety net California consumers keep in mind when they buy a car. Buying an automobile is a big decision one that cannot be taken lightly since there is a large amount of money on the line knowing that is the car is not up to standards and there is a possibility to get their car fixed or money back for it gives them more confidence when buying the car. Can you imagine if consumers had fears about not being able to get money?

Lemon Laws

...Lemon Laws The Lemon Law applies to cars, motorcycles and other noncommercial vehicles that are used strictly for personal use. A lemon is considered a new car that has one or more problems that impair the use, value or safety of the vehicle. The problems must be occur in the first year or 18,000 miles whichever comes first. (ohioattorneygeneral) If the problems occur during this time you should take it back to the dealer you bought it from. If the problem is not fixed, you might qualify for a refund or replacement. Under the State and Federal law consumers have many legal rights as far as Lemon Laws. All 50 states have laws that will let customers return vehicles with major defects. (Soldiers Magazine 2003) One good way to know the condition of your car vehicle before you buy it is to get a Carfax. A Carfax report will give you valuable information about the vehicle before you purchase it. (Carfax) The report would include * Vehicle Registration * Title Information * Odometer Readings * Accident History * Damage * Repair Information * Recall Information Carfax Inc also offers a car buyback program if they give it a good report and you find problems after buying the car. If you want to request a refund you must first send a certified letter to the manufacturer. It must list the problems you have had with the car and what attempts you have taken to fix the problem. Once the manufacturer realizes the vehicle hasn’t been fixed there are a...

Lemon Law

...the “burden of proof”? Support your answers. (75-100 words) (3 marks) I think there are tow points of aim. The first point is consumer protection. Consumers could be better protected against unfair business manufacturer accountability. The second point is to hold manufacturers accountable for the products that they produce and ensure that they will be safe to use by consumers. The Lemon Laws not only protect consumers from negligent manufacturers but also those that do make an effort but simply miss a problem while not in the market. The laws oblige manufacturers and dealers alike to have an appropriate response to consumer claims. (90 words) Question 3: What do you think are the practical problems that can arise in passing the Lemon Law? How do you think it can be managed? Support your answers. (250-400 words) (10 marks) Although the Lemon Law was taken effect in some countries on the world from many years ago, in Singapore, it has just been passed on March 9, 2012 and will come into effect in September this year. Certainly there are some problems can arise in passing of the Lemon Law. Firstly, there are many dishonest customers who try to seek repairs or replacement for a product that have become defective due to misuse or wear and tear. There have been instances where irresponsible customers buy winter clothing for a holiday and then seek a replacement when they return for something from the spring collection, claiming that a button has come off or the fur has...

Federal Lemon Law

...Magnuson Moss Warranty Act (a/k/a Federal Lemon Law) Abstract As established by the Magnuson-Moss Warranty Act of 1975, all written warranties require a title of either “full” or “limited” and be specific as to coverage. In some states, the limited warranty is required to have an “as is” disclaimer so as to be very clear to the buyer. Otherwise, the implied warranty of merchantability is applied. In the case study at hand, the sales contract between Raymond Smith and the new car dealer, assuming it was titled “limited”, did set specific limitations to the coverage. However, in many states, the Act does prohibit the seller from modifying or disclaiming implied warranties so that the consumer retains basic protection of the implied warranty of merchantability. Consumer Protection and Warranties Although there is a still a belief in the doctrine of caveat emptor, often thought of as the most important protection for a consumer, the government has recognized that consumers need greater protection and has passed several laws/acts to do just that. “Article 2 of the Uniform Commercial Code, adopted in whole or in part by all 50 states, establishes certain warranties that apply to the sale of goods.” (Cheeseman, 2013, p. 343). Implied Warranty of Merchantability The implied warranty of merchantability is essentially a merchant’s promise that the goods sold will do what they are promised to do and that there is nothing significantly wrong with them. Merchant, defined by the...

Business Law Final Essay

...Business Law Final Essay Question #2 Unfortunately, it sounds as if Carol was knowingly swindled. Whereas it would seem that Carol would be able to get John’s statements, “was a creampuff” and “this car runs like it was driven by a little, old lady”, she would not be able to. The comments that John made would be seen as puffery most likely. Puffery is unfortunately legal in the United States. A seller is allowed to make statements asserting their opinion of value that the buyer cannot rely on as the basis for the bargain. This is almost a “buyer beware” situation where John’s statements cannot be proven and are speculative in nature. “Creampuff” and “driven by a little, old lady” could also be open to interpretation. However, the statement that John made to Carol, “Definitely would pass inspection” is most definitely an express warranty. “Express warranties are specific promises made by the seller and include oral representations, written representations, descriptions of the goods or services, representations in samples and models, and proof of prior quality of the goods or services.” John made a promise to Carol and represented the car as being “definitely” able to pass inspection. The kid was also acting as an agent for Shady’s when he promised to fix Carol vehicle. Carol may run into the problem of not having a witness hear John’s statements to her and having his statements being considered hearsay. John’s statements about the car being able pass inspection could...

I allow my pets to join me in the room, but I pet them and sit them down on their pillow or close to my feet. I enjoy the natural lighting from the window instead of the harsh desk lamp at night. The breeze that blows through the window is relaxing to me. I keep a diffuser of lemon oil going most of the time, lemon smell makes me happy and peaceful.
