BOOK ONE CRIMINAL LAW - that branch or division of law which defines crimes, treats of their nature and provides for their punishment.
CHARACTERISTICS OF CRIMINAL LAW 1. GENERAL - it is binding on all persons who live or sojourn in the Philippine territory (Art. 14, NCC) EXCEPTIONS:
a) Treaty stipulations
b) Laws of preferential application
c) Principles of Public International Law.

The following persons are exempted:
a. Sovereigns and other chief of state
b. Ambassadors,ministers, plenipotentiary, minister resident and charges d’affaires.

Consuls, vice-consuls and other commercial representatives of foreign nation cannot claim the privileges and immunities accorded to ambassadors and ministers. 2. TERRITORIAL – penal laws of the Philippines are enforceable only within its territory.
EXCEPTIONS: (Art. 2, RPC) i.e., enforceable even outside Philippine territory. 1) Offense committed while on a Philippine ship or airship
2) Forging or counterfeiting any coin or currency note of the Philippines or obligations and securities issued by the Government.
3) Introduction into the country of the above-mentioned obligations and securities.
4) While being public officers or employees should commit an offense in the exercise of their functions.
5) Should commit any of the crimes against national security and the law of nations defined in Title One of Book Two. EXCEPTION TO THE EXCEPTION: Penal laws not applicable within or without Philippine territory if so provided in treaties and laws of preferential application. (Art.2, RPC) 3.

PROSPECTIVE
GENERAL RULE: Penal laws cannot make an act punishable in a manner in which it was not punishable when committed.
EXCEPTION: (it may be applied retroactively) When the new law is favorable to the accused.
EXCEPTION TO THE EXCEPTION
a) The new law is expressly made inapplicable to pending

...This week was a difficult one for me, a lot of new concepts and a lot of information was thrown at me but with the media tools I used this week it made it a little easier to get through this week and hopefully the next couple of weeks. One media that helped me in this week’s assignments was the direct chat section on the schools web page. Being able to be in communications with other students helped me understand some sections of this week that I did not understand. It also allowed me to bounce ideas and calibrate on this week’s assignment. Using the discussion board is great but being able to instantly communicate with our team allows us to work better with each other. Another media that helped me big time as the E-book, using the eBook from book shelf makes it easier to navigate back and forth between section and the highlighting section helps keep track of things that I might have to go back and read again or to highlight important section that I think will be needed. I believe this will come in handy later on down the line when it comes time to take the final. These two media tools where very useful this week as this week for some reason felt a little more challenging to me, being able to reach out to team members and have parts that where a little fuzzy helped somewhat clarify certain sections of the chapter.
