MOTIVATION, STRESS, AND COMMUNICATION LaTonya Woodrow Professor Thomas Schaefer BUS5200 August 12, 2012

As a kid, I remember wanting to be lawyer. I used to defend any kid that was being picked on in the neighborhood or if an argument breakout I was that kid that tried to resolve the issue. I couldn’t even tell you why I did. I remember my mom always telling me to be a lawyer while I grew up. Although, I followed in her footsteps and became a nurse deep down I wanted to be that lawyer. Now, one day I’m hoping it becomes a reality. The other day, a friend asked me why I wanted to be a lawyer, and I was a bit surprised by the question. I never really even asked myself that question.
Why do I want to be lawyer? What kind of law should I practice? Talking to individuals in the field, it seems to be a process of give and take. The private sector, although lucrative, is time consuming. If I want to go that route, I will have a six figure salary and live well, but I doubt I would have time to enjoy it my first ten years. With first year associates needing to acquire anywhere from 1800-2100 billable hours a year, you’re looking at a 60-80 hour workweek. However, there are government and non-profit work that may be quite fulfilling but with the average salary I’ll be paying be student loans for a while.
As a lawyer, I will look at both sides to every issue, as I do now as a nurse. For this issue, I look to combine both career paths. I want to be a part of that fast pace lifestyle as well as give my time and energy to help those who cannot afford legal services. Hopefully I can find a job that satisfies both aspirations of mine. The more I learn about the law, the more frustrated I get with it. This only reinforces my desire to know about the law and what we can do to fix it.
I want to manipulate the law in my favor, while effectively doing my part in fixing it. Being a lawyer is a job that our Founding Fathers believed to be so important to a free society that they wrote it into our Constitution. There is a part of the Sixth Amendment that says, “…and to have the assistance of counsel for his defense” (http://legal-dictionary.thefreedictionary.com). My mission is to defend the client and not being motivated by their back ground or economic status. I am still ignorant, and I know my opinions will change as I learn more, but my core beliefs will remain the same.
Once again, I know I am an idealist, but if something you want to do is within your grasp; then grab it! Embracing it and striving to achieve it is not an easy task. I have learned this through my experiences and am better for it. I can challenge the laws that we all abide by and hopefully, by changing it, help more people than just myself, I will be happy. I will wake up every single day of my life thrilled and honor to be a criminal defense attorney.
The Government has a vast unlimited amount of resources against a person accused of a crime; someone like me is guaranteed a chance to stand up for the accused. It is a fundamental principle of our freedom. How strange it is not so self-evident to many of the people who enjoy the freedom they created today.
One organization I would love to be a part of is the National Chair of WILEF. The WILEF is an, “organization for women in law exclusively dedicated to women from the largest law firms and corporate law departments in the United States”. WILEF mission is to increase leadership roles at large law firms and help women choose firms that have demonstrated success in incorporating women into positions of leadership. WILEF has been working to aid women in this pursuit for several years now and its Gold Standard offers a purposefully targeted hand by providing increased transparency, and by offering recognition to firms where women represent a meaningful percentage of positions that reflect power, leadership, and top compensation within the firm (http://www.wilef.com/sponsorship_pg2.html).
The law firm that I want to start my career off is at Perkins Coie. Perkins Coie was founded in 1912 in Seattle; Perkins Coie has more than 850 lawyers in 19 offices across the United States and Asia. The firm is celebrating its 100th anniversary of representing great companies ranging in size from start-ups to FORTUNE 50 corporations. It is dedicated to providing an inclusive work environment that provides all employees the opportunity to succeed. For nine consecutive years, the firm has been named to FORTUNE magazine's list of "100 Best Companies to Work For." Also, for the past three years, the firm has received a perfect 100% rank by The Human Rights Campaign Foundation, the educational arm of the nation’s largest advocacy group for gay, lesbian, bisexual and transgender Americans, in the Corporate Equality Index and Best Places to Work Survey. In addition, the firm has been named to the Yale Law Women’s “Top Ten Family Friendly Firms” list in 2008, 2010 and 2011. Earlier this year, the firm received a Gold Standard Certification from The Women in Law Empowerment Forum (http://www.perkinscoie.com).
Most private lawyers start off around $37,000 a year, but in some large firms, starting salaries got as high as $80,000 per year. The top salaries are received by good lawyers in top firms reached $1 million a year. But the average lawyer in a good firm makes around $115,000 per year, which I might, add is not bad at all to say the least. The other factor is whether or not you are good at being a lawyer. The largest benefit in this career is probably the money, but a benefit can be if you handle pressure well or not, and if being a lawyer is something you really want to do (www.impactpublications.com).
The reason for that is the demands are very high. You must be willing to work irregular and long hours, and be able to work well under pressure, especially when a case is being tried. Anyone who chooses this career needs to realize that the entire legal system is based on adversity. Negotiations, court appearances, and dealing with clients and with other attorneys are often very bitter. These interactions require you to be tough, emotionally detached and sometimes even heartless. The stress has a lot to do with the fact that almost everything you do is urgent and has a serious financial impact. These types of stressors can be very hazardous to your mental state because of all the pressure and stress you must deal with on a consistent base.
The chronic, unpredictable and uncontrollable nature of events experienced by lawyers can lead to a downward spiral, culminating in burnout (low grade depression, anxiety, dissatisfaction, lack of motivation and negative perceptions) and major depression. Indeed, lawyers report substantially higher levels of burnout, depression and suicide than most other professions. Unfortunately, some lawyers may seek relief from these symptoms by abusing alcohol or other drugs, which puts the lawyer at risk for disciplinarily action, as well as legal and financial troubles (http://www.cba.org/cba/practicelink/bwl/stresscoping.aspx).
Practicing law may be intense, repetitive and done in a highly negative environment. Most of your time is spent writing intimidating and threatening letters to others or answering threatening letters others have sent you, arguing your case against others in court, or making sure your client is well represented in negotiations and in their final outcome: contracts. Surrounded by all this adversity and negativity, you have to become highly aggressive, if not you will be eaten alive by other lawyers.
The legal system still requires paper proof in many cases, so you have to keep everything and have it neatly filed away. Lawyers keep copies of every correspondence, every document, and even electronic copies. Many legal documents are required to be an original with the original signatures. If the document has to be notarized, it is required that the seal is applied to the original document. In addition, original documents can’t be photocopied or a scan is not good enough because it's too easy to tamper with a document that way. Computers are useful tools for processing data. They are not really the best or most secure way of storing or archiving data.
Being a lawyer affects your relationships and your personality. You become more aggressive, impatient, and cynical. One of the biggest emotional obstacles to making this career change is a sense of obligation. My legal career will probably cost a fortune and I know that I also have to invest a lot of time in it.
As time goes on, and eventually by the time you can retire, my situation again can largely depend on whether I work privately or not. Either way things will get better as time goes on, but the paces will be different. For example, in a private firm, I may have a very slow start where I may have to work other jobs to keep the income steady. But in a larger firm, I will probably start out faster. Also, later in my career, I may want to become a judge, seeing that most judges were once lawyers. A plus in a private firm is that I could retire early if wanted. However, knowing me and the multitude of people that I would be helping, I will practice law and die in a court room.
Being a lawyer would be a great experience, not just because of the money, but you would get to interact with many different kinds of people.
