Boswell Technologies is a computer software development firm located in Akron, Ohio. Michael Carl, vice president for human resources at Boswell Technologies, has just returned from San Benedetto, Italy. It seems that Boswell is soon going to become Boswell International. The company has just acquired a successful software firm located in San Benedetto. The purpose of the acquisition was to quickly allow Boswell to become a premier supplier of new and innovative computer software in Europe. On his first day back in Ohio, Michael has been called into the office of Boswell’s president, David Randolf, to give a status report. David Well, Mike? How soon can we get our management team into place over there in Italy and phase out their current staff? I’ve heard how slow and inefficient Italian businesses are, and I don’t want to waste time getting our company’s policies in action. Maybe we can get a head start on the European competition with good old American know-how. It’s not going to be that easy, Dave. I think it might be a mistake to send our people. ...FACTS Interspousal immunity is a common law doctrine which prohibits spouses from suing each other. The married couple shares the same identity in law, specifically under the husband name. In Callow v. Thomas, the wife tried to file suit against husband but could not due to the relationship of the parties. Her husband was negligent while driving which caused an accident in which she was injured .The marriage was annulled because she tried to file her claim. Once marriage was annulled she was able to get money from the accident. Interspousal immunity doctrine was modified by The Supreme Judicial Court of Massachusetts in the case, Lewis v. Lewis, decided in 1978. The wife sued the husband for her injuries caused by negligent driving. Under M.G.L.A. c. 209 § 6, “a married woman may sue and be sued in the same manner as if she were sole; but this section shall not authorize suits between husband and wife except in connection with contracts entered into pursuant to the authority contained in section two.” In Brown v. Brown, the wife filed suit against her husband. He was in “control of the premises and responsible for sanding, salting or shoveling after a snowstorm, that his failure to do so caused the wife to fall, and that she suffered fractures and incurred medical expenses in excess of $2,500.” The facts of the case based on the cases prior cases before did “not trench remotely upon privileged or consensual aspects of married life.” The couple in this case had an agreement...

Office Art Memo

...Office Art Memo Office Art Memo I have decided upon the six paintings or sculptures that will reside in the CEO’s office building. Out of the six, three are 19th Century Impressionist paintings and the other three are Post-Impressionist paintings or sculptures. The first one I selected was the Regatta at Sainte-Adresse by Claude Monet. This is a nice, relaxing photo that I would set up in the break room. It falls under the impressionist style because it captures the vision as if I was standing on the beach looking out over the water. Another painting for the impressionist era that I would put in the office building is A Matador by Edouard Manet. I would set this painting up in the conference room because it would remind the employees that sometimes we must stand our ground in order to accomplish the mission. The final painting from the Impressionist period is A Road in Louveciennes by Auguste Renoir. This one, much like the first one would be set in an environment to trigger relaxation. The first of three painting or sculptures I would select from the Post-Impressionist period is Starry Night by Vincent van Gogh. This is a powerful piece of art and very famous. It is meant to capture the transcendent essence of the stars and the night. Another painting from the Post-Impressionist period is The Scream. This painting was done by Edvard Munch. This is a great painting because it reminds anyone who sees it about the struggles of life. The last painting I would select for the...

I have added a brief description of each painting. The first impressionist painting is Monet Family in Garden by Edouard Manet. In the left side of the painting, Claude Monet is gardening with a chicken and duck. Sitting under a tree in the center of the piece is Claude Monet’s wife, with their daughter lying next to her. Trees and shrubs form the outline of the garden along the sides and in the background. This piece of art has historical significance as it is...

The following are my findings. Please let me know if you have any additional questions regarding this matter. 1. Does the website have to list the state where s/he is licensed to practice? Yes, the website needs to state the states each attorney is licensed to practice. First and foremost, the intent of the website is to make it user friendly for the firm’s primary audience. The website needs to be organized and provide key points. A major key point would be states licensed to practice. Regents of the univesity of california | date: | March 27, 1976 | | | As everyone knows there is a new ruling for the Tarasoff v. Regents of the University of California. The ruling two years ago caused a debate on the ruling of professionals getting charged and those that weren’t, so changes have now taken affect. As professionals in the human service field it is important for us to know that now if a client expresses they have a plan to kill someone, it is our obligation to break confidentiality and inform the potential victim and or the police of the thoughts of your client. This may be a tough thing for some of us to do because of the ethical responsibilities we have with our clients but now this is a part of our legal responsibilities to protect the welfare of the society by having the duty to protect individuals who are bing threatened with bodily harm by a client naming it “duty to warn and duty to protect” (in the previous ruling it was only known as “duty to warn”. This is also known as a “Tarasoff warning” in place, meaning where a mental health professional is required to warn of a credible danger to a reasonably identifiable victim. Duty to protect includes clients that may be suicidal. Human services code of ethics entitles us as professionals to let the client...

Inter-Office Memo

...SALEM, OREGON INTER-OFFICE MEMORANDUM To: All Departments, and Officer Employees From: Colonel Pat Bacon, Director of the State Police Department Date: May 21, 2014 Subject: Planting Evidence, Perjury, and Falsifying Police Reports It has come to the attention of this department that there have been reports of questionable conduct from some of our officer employees. Police officers that are supposed to enforce the law, at times become more aggressive than the criminals themselves. How much corruption there is and knowing its characteristics are important steps to understanding corruption and then being able to successfully control corruption without illegal means is what is done. We uphold the laws, not bend them or break them to apprehend suspects, and criminals, “the bad guys.” Because of these reports, there is a serious threat to our law enforcement, which could compromise the values of our profession and our high ethical standards, and it is called “Noble Cause Corruption.” Noble Cause Corruption Noble cause corruption policing can be thought of as “doing something bad that will have a good end.” Peter Northouse This happens a lot when good police officers care too much about their job and the people of the community, and in order to get criminals off the streets they begin to do bad things because they truly believe that the overall “outcome will be good or justify the means.” Peter Northouse Examples of noble cause corruption can...

...George Martinez Hum-112  Professor Montgomery Assignment 2 – Office Art Memo George Martinez Hum-112  Professor Montgomery Assignment 2 – Office Art Memo This assignment was right in my corner. Ironically, as Assistant Directors of Operations for my company, I was tasked to do this very assignment a year ago to date. Impressionism can be considered the first distinctly modern movement in painting. Developing in Paris in the 1860s, its influence spread throughout Europe and eventually the United States. The term, first used sarcastically, was derived in part from the title of a painting, Impression, Sunrise (1872, Musée Marmottan-Claude Monet, Paris), by Claude Monet. (nga.gov) The Impressionists loved painting outdoors, the ever-changing face of nature lent itself perfectly to their interests in capturing the moments of light and color. During my search, I choose the route of adding paintings rather than sculptures because the abundant selection of landscapes and patriotism pieces that are very desirable by our CEO Mr. Lee; who is also a New York City, Hamptons native. Mr. Lee has been a huge fan of works of Childe Hassam, because of this I decided to keep the theme throughout the interior of the office common areas and the chose to keep the post impressionist art within inside the executive offices. The three top choices for the impressionist period were selections from Childe Hassam, Flags, Fifth Avenue, Geraniums, and Lower Manhattan. (These selections chosen represent...

Misunderstandings

... Encode/misspoke Feedback- manger, supervisor, myself in office discussion First misunderstanding example took place on one of my last days of work where I was called into the office by my manager. The manager had heard a message from one of his supervisors that I made a negative comment during work. The supervisor contacted the manager and he called me into the work office. I came in, sat down and was told that I was being negative at work that day and that I must be unhappy. The manager proceeded to tell me what he had heard I had said from the supervisor on duty. The comment that I made was somewhat negative yet I had meant it as a joke. The supervisor heard it differently, not as a joke and was upset. So the comment that I had said was misunderstood first by my supervisor and then she proceeded to tell the manager my comment what she conveyed her perception of what I said rather than what I meant. The comment became all misconstrued by the time I went into the office. We all sat down. I was told what I did wrong before I had a chance to give feedback and that I was going to be written up. Finally, I had the chance to explain myself (feedback) and correct the misunderstanding that had taken place. We all listened to each other and made sure we all understood what had occurred and then had constructive feedback to resolve the issue. The second misunderstanding example took place at an office. There was a meeting to brief staff on...

... BUSINESS MEMO IT TRAINING OUTLINE INTRODUCTION: There must be a methodology implemented for training and a strategy developed along with that methodology. These two aspects will be successful if we do not waste training resources. These resources will not be undermined once we address a number of issues The company policies, infrastructural issues, and cultural issues within the company may all need to be noted before a well-oiled training session can take place. It is, however, important to note that no matter the schema chosen for training, the path needs to be clear for the users. The training that the users will require will rely of their background, the purpose of the training, features of the system, any types of new user interfaces, etc. This project is an outline for a presentation given by a mixture of HR and IT professionals, streamlining company policy and procedures, for a company-wide compliance system. The head office will implement the training, with training conducted in a central location. This will be conducive to all the other satellite offices, making them easily reached by the managers that will be attending the training sessions. ...Memo 1: The purpose of the work is to get the customers safety. Student’s Name University Affiliation Date The purpose of the work is to get the customers safety. We have different capabilities that help us accomplish various activities in our life. Every person has a way of doing things, and the approach used in handling an event matters a lot. We are unique in our perception and the way we process information. All these and many other differences among us are determinants of our productivity. The reports from the Bureau of Labor Statistics shows that it is not necessarily you work for long hours to increase your productivity. You just get more tired and can even contribute to lower outcomes. The best thing is to find your appropriate and active hours and stick to them. Your body will learn and adapt completely to the golden hours and as a result, the output will be more, and the individual will ever be energetic when doing the daily duties. The humorist; Erma Bomebeck said that we should never seek assistance from the doctor whose office plants are already dead. The same applies to our workplaces. We should not work without a sort of greenery at our desk or cubicle. In simple terms, the greenery should be somewhere close to our vicinity. The plants have psychological and physical benefits, and they help in boosting the productivity in the office. The biology of the plants is that they assist in air circulation creating a stimulating environment by refreshing the air...

...Introduction I am currently the project manager for ZAP Pharmaceutical Company. Currently, I am managing a large IT project in the healthcare industry for ZAP. My project objectives are to refurbish an existing office building, install the IT infrastructure, and outfit the area for use as a new telephone answering hub for the company. All contracts associated with this project are fixed price contracts and we have three main issues that need resolution. Issues 1. Bear’s Construction Company is making a claim that it is not responsible for inspections required by the local township. Bear has produced a memo signed by John during negotiations that states that ZAP is responsible for all permits and inspections. The contract shows that Bear is responsible for all inspections. 2. The contract states that carpeting must meet a specific wear rating. It also prohibits the use of any non generic materials within the work of the contract. This would include carpets with special wear rating, because these would be non generic materials. Anne has already purchased and begun the installation of the generic carpet that does not meet the wear rating. 3. Sheba’s Office Equipment has informed you of a minor typographic error in the contract with you to provide office equipment for this project. In the contract, it states Sheba shall be paid as follows $350,000 (Three hundred and fifty thousand dollars) Sheba apologizes for any inconvenience this may have caused and is awaiting...
