Is it ethical for employers to look on social media sites to investigate a potential job candidate? In this paper I will argue that these online background checks are not only unethical but they may also put the employer in a legal jeopardy of violating State and Federal Laws, for example a Chili’s server whom was fired after a Facebook post by a 2012’s article in The Huffington Post “Chili’s server fired after Facebook rant,” also according to a 2010’s article “Workplace Privacy-Labor Relations Board Files Complaint against Company over Facebook Post,” found on Epic.com, an American Response Member who was consequenced after postings towards her supervisor on her Facebook, I will write about a survey conducted online with the U.S. and Canada …show more content…
The now widespread use of social media sites being used to screen applicants over the years, it’s more than expected that this will continue affecting many job candidates in the upcoming years such as in promotions, recruitment, termination and management opportunities. For example a young lady who was a server at a Chili’s restaurant in California had been fired over her Facebook post which she threatened to spit on a customer when she sees him next time for leaving a poor tip. Despite the fact that her being fired maybe job related and is considered as a personal assault in California (The Huffington Post, “Chili’s server fired after Facebook rant,” 2012). Although other posts that have had attention on Facebook are not as job related as the prior story. …show more content…
Whatever I post on Facebook is indeed public domain, but people have had private lives since the beginning of time. The only difference now is that the employer can see more of it. How does an employer being able to see your Facebook change how much of a professional, trained employee I am? It doesn't. Discrimination is around us whether we like it or not but it’s quite unethical, whether done purposely or non-purposely. When judging the persons abilities to performing tasks on a job from information from social networks can be incorrect and irrelevant information, people would be rejected from jobs they could be very successful at. The server from Chili’s and the Medical Response member both posted something that yes was work related but it was their personal account, which should not have been considered a wrong of doing. Going back to the other ethical aspect of things, if information such as this is allowed in the hiring process, it can limit a individuals ability to express themselves freely in their private life. In so many cases information found online lacks factual information and is misinterpreted when taken out of context.
