Lucy v. Zehmer, 196 Va. 493, 84 S.E.2d 516 (1954)

Group 2: Cameron Garner, Jay Bangerter
2. Have all of you found your case on LexisNexis and read it? I couldn’t find the case on LexisNexis nor could I find the right site, however, I did find the full case on Wikipedia and have read all of that case.
3. What are the most important facts of the case? The most important facts of the case are whether a contract can be voided because it was not the intent of the contractor to do what was written. In this case the Owner (Zehmer) states that he and his wife were only playing a joke and had no intent to sell the property/farm and they then think that this makes the contract that was written up and signed by the plaintiffs, (Lucy), is null and void because it was not his real intention to sell the farm. 4. What has happened procedurally in this case so far? (For example, what happened in the original trial court? Who appealed? What court did the appeal go to? Did a lower appeals court already make a decision in this case, and is the case now being appealed to a higher appeals court? Which appeals court decided the case you read?) In the original trial court or the lower courts, the ruling was that the contract was not legitimate and was given to the defendants (Zehmer). Lucy then appealed to the Supreme Court of Virginia or the State Supreme Court. The Virginia Supreme court then decided and ruled in the favor of the plaintiff on the facts that both parties were sober enough to know what was being said, what they were doing and in fact did have a business transaction to where the farm was agreed upon a sale value of 50,000 dollars.
5. What is the main legal issue of this case that relates to the chapter in your textbook where the case appears? How did the court answer the question? The main legal issue is

...Developing A Questionnaire Charles R. Zardus Kaplan University Marketing Research MT 355 Professor Richard Caldarola May 30, 2016 Introduction This paper will show a research problem for online grocery shopping case study. We will also provide a brief explanation of the questions that were developed for the survey to assist the research project in developing a marketing plan to develop a software program that is user friendly to the shopper. With this software one may be able to gain that compatible edge. Research Problem For this project the research problem would be “What makes an online shoppers experience satisfying?” Trying to determine what makes a shopper want to return to a service is a key part of the success to a business. You have to understand and know your customers wants and needs to be able to provide them with the service they desire. In this case making a software program that is easy to navigate and have the customer feel as though they are interacting may be beneficial, however we first need to understand what the customer likes or dislikes about the service. Not all customers wants are the same. We will need to create a questionnaire that will help us get to know our customer base and their needs. The questionnaire needs to cover some basic information, however we do not want it to be to complex or long as we may chase off possible responders. That leads us to the questionnaire. ...[pic] Information Security Office Information Security Office Security Assessment Description and Questionnaire The Information Security Office offers many types of assessments to meet our customer’s needs. This document explains the process for requesting an assessment, describes the set of security assessment services that the Information Security Office (ISO) offers to members of the campus community and provides a questionnaire that is used to assist in understanding the target environment. The ISO is not able to assess every possible platform or application. Nor is it possible for the ISO to meet every timeline requirement. In those cases, the ISO may contract with external partners to deliver the requested assessment service. There may be associated costs that will need to be passed along to the requesting organizational unit. Process: The Information Security Office has created a simple process around vulnerability assessments to provide clarity and consistency. The process is outlined and diagrammed below. 1. Contact the ISO (request assessment) 2. The ISO accepts the project 3. A questionnaire (later in this document) is completed by the customer 4. A scoping/kick-off meeting is held • The goal of the meeting is to try to determine which type of assessment is appropriate, the scope of the assessment, a timeline and contact information. The product of the meeting is a Statement of Work that will be agreed upon and...

...which each stage of the research is specified. Such a research plan is only considered adequate if it specifies: the research problem in concise and precise terms, the information necessary to address the problem, the methods to be employed in gathering the information and the analytical techniques to be used to interpret it. The market research brief: Marketing research can be concerned with any of a variety of aspects of the market: the product, sales, buyer behaviour, promotion, distribution, pricing, packaging, etc. Since the researcher cannot investigate everything about a market, he/she must be selective. The question remains as to how the researcher decides where to focus the study, and to what depth each issue should be investigated. The answer should lie in a document called the research brief. The research design is a set of guidelines given to the researcher by the person(s) who have commissioned the research and/or the individual(s) who are to make use of the results in their decision making. The brief must inform the researcher which aspects of the market are particularly important. In particular, the research brief should include: · The purpose of the research · The objectives stated in a clear,...

The syllabus constitutes no part of the opinion of the Court but has been prepared by the Reporter of Decisions for the convenience of the reader. See United States v. Detroit Timber & Lumber Co., 200 U. S. 321, 337. SUPREME COURT OF THE UNITED STATES Syllabus SKILLING v. UNITED STATES CERTIORARI TO THE UNITED STATES COURT OF APPEALS FOR THE FIFTH CIRCUIT No. 08–1394. Argued March 1, 2010—Decided June 24, 2010 Founded in 1985, Enron Corporation grew from its headquarters in Houston, Texas, into the seventh highest-revenue-grossing company in America. Petitioner Jeffrey Skilling, a longtime Enron officer, was Enron’s chief executive officer from February until August 2001, when he resigned. Less than four months later, Enron crashed into bankruptcy, and its stock plummeted in value. After an investigation uncovered an elaborate conspiracy to prop up Enron’s stock prices by overstating the company’s financial well-being, the Government prosecuted dozens of Enron employees who participated in the scheme. In time, the Government worked its way up the chain of command, indicting Skilling and two other top Enron executives. These three defendants, the indictment charged, engaged in a scheme to deceive investors about Enron’s true financial performance by...

...Forms of Data: Observations, Interviews and Questionnaires Natasha Dean EDU 675 May 24, 2016 Dr. Shannon O’Day Action research is a form of research that is normally used to solve the resultant and immediate grievance. In this case therefore this practice is mostly done on community based agendas and several people come together so as they can work together as team towards finding means of improving the way people solve their grievances as well as address their issues. The purpose of my study therefore is to involve myself in this mode of research as an active member who is ready to change the situation more so in the organizations with the aim of addressing strategies they can use to combat various problems they encounter in their surroundings prior the operations within which they practice their obligations. The following are my research questions: * Will the strategy be useful in various organizations to help in time management among the employees and the administration? * Will the strategy be vital in making the students change their study skills as well as their habits? * How will the plan be crucial to the community? Will it be beneficial to the Home Owners organizations’ meetings? In this case I am going to use three forms of data based on how they will serve towards making my research very informed. These forms of data include interviews, observations as well as questionnaire questions (Mackie, 2000). Firstly, interview is a conversation...

...HOOKUPS,COLLEGE STUDENTS “Hookups”: Characteristics and Correlates of College Students Spontaneous and Anonymous Sexual Experience By: Authors: Elizabeth Paul, Brian McManus, & Allison Hays ProQuest 2000 Kourtney Reed Section 1 Hookups can be defined as a sexual encounter which may or may not include sexual intercourse usually, occurring on only one occasion between two people who are strangers or brief acquaintance (Paul, McManus & Hayes, 2000 ). The terms "friends with benefits" and "casual sex" are also used as synonyms for hooking up.To college students this definition doesn’t mean anything. When they hear the term hooking up, they think of only two things having fun and worrying about the consequence later. According to Time Magazine “hooking up” is becoming a trend-an epidemic, amongst students entering college and adolescents' and young adults' across the border. Sexual attitudes and behaviors have gotten a lot less traditional. Trends show a decline in traditional forms of dating suggesting that casual sexual interaction is becoming an alternative to traditional exclusive sexual relationships. This social issue is becoming more prevalent in college students culture and social experiences. This research study was based on 555 undergraduate students who attend a state college in the northeastern part of the United States. The students were selected randomly from a number table. This number table came from a student roster of all the full-time students...

...our findings. For example, perhaps the way in which tests are graded is either altered or changed, would the perceptions towards academic testing of the respondents differ? This may well be the case. Therefore, we will take care in that any generalisations potentially lack a lasting longitudinal element to them. Having previously decided on our research proposal, we then have to derive a suitable sample. Within our proposed region of BELB primary schools (those who are classified under the Belfast Education and Library Board) there exists 31 schools. This was then formed as our sample frame, with the intention of getting the co-operation of as many schools as possible in order to make generalisations about the wider population as a result of our findings. As previously mentioned, BELB was chosen due to logistical and time issues we anticipated to keep to a minimal, in comparison to what a wider sample population would have created, Having previously decided on a questionnaire as the tool for our proposed method of survey; we then agreed on what questions to decide based on our background knowledge of the topic. ( A copy of the questionnaire can be found at appendix ). We were influenced by elements of a positivist perspective by focusing on a ‘closed-question’ style questionnaire. The advantages of this will be that it should allow for us to easily quantify our findings and as a result create Visual aids to help give increased understanding of our findings about the phenomena...
