While on a vacation, Bernadette Scarfo Airuyuwa was the victim of burglary in her single family home in Palmdale. Giving her son Lenaris, the only one with permission to enter the home while she was on vacation, responsibility of checking on her home every couple days. The appellant, Kevin Latham, should not be given new sentence due to the efficient evident stated that appellant committed burgulary (page 6 in argument 1).
The appellant claims the evidence presented was not valid and proceeded in argument 1 that there is no proof he ever had possession of the stolen items in addition to knowing the crime was committed (page 11). Appellant is arguing the fourteenth amendment that "protects a defendant in a criminal case against conviction
