Sexual Harassment In Texas Public Schools

As an employee of a school district, all teachers and staff have a right to be safe from harassment. In Texas public schools, harassment can include threats to cause harm or bodily injury, including sexually intimidating conduct, or other malicious acts that can cause substantially harm to a person’s physical or emotional health or safety. The Texas Education Code requires all public schools to prohibit, and take steps to prevent harassment, including sexual harassment. As stated in local school board policy, sexual harassment of an employee is defined as “unwelcome sexual advances; requests for sexual favors, sexually motivated physical, verbal, or nonverbal conduct; or other conduct or communication of a sexual nature.” (DH, DIA, p. 29) The local policy manual provides examples of sexual harassment and other types of prohibited harassment for clarification purposes. …show more content…
If the campus principal or supervisor is the subject of the complaint, the employee is to report directly to the superintendent. If the complaint is against the superintendent, the employee is to report the incident directly to the school board. According to the district policy, a school employee is to report the harassment in a timely manner, so the school district is able properly investigate and address the harassment in a prompt manner. It is also the responsibility of a school employee to follow all reporting procedures aligned in the district’s board policy manual and employee handbook, and is available in the school district’s administrative office, campus offices, and school district
