Shelby County Case Summary

In Shelby County v. Holder, the State of Alabama challenged two provisions of the Voting Rights Act (“Act”) that regulated voting laws at the state level. Section Five of the Act required state and local governments with a history of voter discrimination to obtain preclearance from the federal government before implementing changes to their voting laws. Section Four set forth a coverage formula to identify states that would be subject to the preclearance requirement. In 2006, Congress voted overwhelmingly to reauthorize the Act for another twenty-five years. The Senate voted 98-0 in favor of re-authorization.
Alabama challenged the constitutionality of Sections Four and Five and argued, among other things, that current incidents of voter discrimination were no worse than in states that were not subject to the preclearance requirement. …show more content…
Put differently, the Court’s decision in Shelby County can – and should -- have lasting implications for a doctrine that was not even at issue: Article III standing. In situations where elected representatives are unable or unwilling to resolve matters that, among other things, implicate fundamental constitutional rights, the Court should intervene to protect citizens who lack recourse through the legislative process. As one court explained, “the judiciary must bear a hand and accept its responsibility to assist in the solution where constitutional rights hang in the

...Shellie Liggins Dr. Luis Garcia-Fierro PAD 525: Constitutional and Administrative Law October 21, 2012 Learning by Doing 2 The Tennessee Public Records Act is found in Tennessee Code Annotated 10-7-101 and the sections that follow it. For purposes of access to public records, the operative provision is found in TCA 10-7-503, which says: “All state county and municipal records ... shall at all times, during business hours, be open for public inspection by any citizen of Tennessee, and those in charge of such records shall not refuse such right of inspection to any citizen, unless provided by state law,” (TN.gov, 2012). In summary, documents that come into possession of a governmental agency either by virtue of receipt of the documents by the agency, or creation of the documents by the agency, are public records that must be made available for public inspection unless they are exempt from the disclosure by state law. TCA 10-7-505(d) says the law “shall be broadly construed so as to give the fullest possible public access to public records”, (TN.gov, 2012). Pollock v. Farmers’ Loan and Trust Company of 1895 was a case in which the Supreme Court of the United States ruled that the unapportioned income taxes on interest, dividends and rents imposed by the Income Tax Act of 1894 were, in effect, direct taxes, and were unconstitutional because they violated the provision that direct taxes be apportioned (Pollock v. Farmers’, 1895). In short, U.S. Supreme Court ruling declared...

Slo County Hr

...San Luis Obispo County: Human Resources in Government Shelby Cowell Robert Griffith Bernard Salgado GSB 583: Managing Human Resources Instructor: Calvin Stevens California Polytechnic State University Part I The Organization and its Mission San Luis Obispo County was one of the first counties in California, created in February 1850 as residents were preparing for California’s statehood (CSAC). It was created to govern the coastal region between Salinas Valley and the Santa Maria River, writing, implementing, and enforcing local laws and regulations for this region to ease the burden of work on the California state government. The county’s residents elect a Board of Supervisors that has authority to pass laws, and the Board entrusts a County Administrator to oversee the 24 departments, organized into six functional groups, that administer the county’s governance on a day-to-day basis (SLO County). The County government has a decentralized structure, according to Tami Douglas-Schatz, the County’s Director of Human Resources. She says the Board and Administrative Office handle overarching policy, but day-to-day operational matters are handled by the departments themselves. When it comes to organizational planning, the Human Resources is “the architect of systems” (Douglas-Schatz), with final say over what structure the organization will have. The County’s relationship with the California state government and U.S. federal government is very impersonal. These higher-ranking...

He is a firm believer that health care through the government will not work, but has proven through his Church Health Center in Memphis that there is a real way for health care to work. See figure 1 in the appendix for a picture of Dr. Morris. Focus on the Leader The GOOD Dr. Morris’s leadership of the Church health Center in Memphis is outstanding. When the governments’ health care program is incapable of functioning effectively, from Dr. Morris’s book, Health Care You Can Live With, (see Figure 2 in the appendix for a view of the book’s cover), we have learned that his nonprofit health care center is treating 55,000 patients a year with only a 13 million dollar budget. Entrepreneurship and Innovation

...Executive Summary Entrepreneurs play a vital role in economic development as key contributors to technological innovation and new job growth. Further, entrepreneurs help build communities in ways such as providing jobs, conducting business locally, creating and participating in entrepreneurial networks, investing in community projects, and giving to local charities. Realizing both the economic and social impact of entrepreneurship, many states and local communities have implemented aggressive strategies aimed at cultivating and nurturing entrepreneurs. In order for governments to effectively develop policies that will foster entrepreneurship, they must first understand the difference between entrepreneurs and small business owners, common misconceptions about entrepreneurs, and where entrepreneurs are located. Using this information, combined with entrepreneurial strategies outlined by the National Governors Association (NGA) Center for Best Practices, state governments can develop specific and effective measures to support entrepreneurs. While cursory inspection shows entrepreneurial growth companies (EGCs) and small business owners have a lot in common, there are certain distinct differences between the two. Controlled growth and continued profitability are the goal for many small businesses while EGCs are generally geared toward rapid growth and productivity gains. In addition, EGCs often have significant economic effects on a community, accounting for a large...

Coor's Light Promotion Plan

...08 Fall Promotional Plan Executive Summary Naturally brewed with no added preservatives in Golden, Colorado, the heart of the Rockies, Coors Light is the eighth leading beer brand in the world. As Molson Coors’ largest brand, the new parent company after the 2005 merger, Coors Light has established itself as the biggest selling brand in both the US and Canada. The merger, however, left the company heavily indebted and with limited capital suffered a loss of partnering and sponsorship for major sporting events. Coors Light has worked extremely hard to maintain the positioning as ‘The Worlds Most Refreshing Beer” withstanding the susceptibility the brand faces with only a single brewing site and third party distributors. This promotion plan includes the following objectives for the upcoming year: * To attract non-users and create brand awareness among 90% of females aged 21-30 seeking a refreshing tasting light beer, * To retain the 18-24 year old male target currently held by Coors Light. * To engage the mobile community through the use of Mobile Insider, connecting the brand to consumers. The objectives should be met through various promotional activities tied closely to the company’s long-standing brand image, and mobile promotions to increase accuracy in reaching target markets. Over the next 12 months it is recommended that Coors Light continue to use the Maxim Golf Experience to maintain the current target...

Preface This isn’t really a teacher’s manual, not, at least, in the sense of a catechism of questions and correct answers and interpretations. Because the questions provided after each selection in Rereading America are meant to stimulate dialogue and debate — to generate rather than terminate discourse — they rarely lend themselves to a single appropriate response. So, while we’ll try to clarify what we had in mind when framing a few of the knottier questions, we won’t be offering you a list of “right” answers. Instead, regard this manual as your personal support group. Since the publication of the first edition, we’ve had the chance to learn from the experiences of hundreds of instructors nationwide, and we’d like to use this manual as a forum where we can share some of their concerns, suggestions, experiments, and hints. We’ll begin with a roundtable on issues you’ll probably want to address before you meet your class. In the first section of this manual, we’ll discuss approaches to...
