Barry M. Barash[->4], Barash & Stoerzbach, Galesburg, for Appellee. Justice BRESLIN[->5] delivered the opinion of the court: Everen Securities, Inc., (Everen) filed suit against defendants A.G. Edwards & Sons, Inc. (A.G.Edwards), Sidney Carlson and Loren Wright, alleging damages for breach of contract and misappropriation of trade secrets when Carlson and Wright resigned from Everen and began employment with A.G. Edwards. Everen's claims were subsequently arbitrated. The defendants appeal from the trial court's decision to confirm the arbitration award of $1,131,000 plus fees in favor of Everen. We hold that: (1) the arbitration panel did not exceed its authority in considering the issue of trade secret; (2) the evidence does not show that a member of the panel was prejudiced against A.G. Edwards; and (3) the panel did not commit gross errors of law or fact in awarding damages. Accordingly, we find no grounds for vacating the arbitrators' award. Carlson and Wright...

Pay to Play in High School

...The Issues Surrounding “Pay-to-Play” and its Effect on Students in the United States Outline Science, Technology and Human Values Topic: Pay-to-Play I. Introduction A. About Pay-to-Play 1. “Pay-to-Play” is a policy implemented by school districts to help cover the cost of extra-curricular activities, such as sports, clubs, cheer and dance, and even some honor programs. It dates back to the 1970’s although it became more popular in the late 1990’s and early 2000’s. The fees range from $850 to play football at Oakfield High School in Massachusetts, $350 to participate in band at Fairfield High School in Michigan, to $30 per year total, no matter how many extra-curricular activities the student participates in, at Holton High School in Kansas. The fees vary by state, by school district, and there are some schools who don’t charge a fee at all. In 1984, California passed a law that no school district will charge fees for extra-curricular activities. Stealth versions of pay-to-play exist at many high schools around the country. Sometimes they are clothed as transportation fees, equipment fees or donations. Some schools blanket their fees by asking students to donate $150.00 to their booster club, such as Lakeside High School in Atlanta. Therefore, it is a considered a donation, and not a fee. (Brady) 2. There isn’t a current policy in the United States for pay-to-play in schools. It isn’t governed, nor is it required or uncommon for districts to charge some...

...27 collective effectiveness. This finding illustrates how the impact of social ties on individuals’ perceptions manifests itself in different ways. Moreover, it shows that there is a privileged path (highlighted with bold arrows in Figures 1 and 2) leading to strong participation in social movements. Of all perceptions, individual effectiveness is the factor in the decision process that most closely influences the level of participation in both the Bern Declaration and the WWF. Prospective members with a strong feeling that if they engage in protest, their participation will serve at least to a certain extent to bring about social change will actualize their potential for mobilization at the highest level of involvement. Individual effectiveness is also one of the perceptions of the model that is most influenced by social networks, directly but also indirectly via interest in the political issue and the perception of the organization’s effectiveness . This last result highlights the close interweaving between social ties and individual effectiveness. In other words, it stresses the interconnectedness of relational factors and human agency, and demonstrates that both structuralist and rationalist accounts are indispensable to explanation of individual participation. Conclusion Social networks matter, but they do so by performing various functions in the process of individual participation. They intervene at least three different ways. First, they intervene in the socialization...

History of Puerto Rico

...Identification. Christopher Columbus landed in Puerto Rico in 1493, during his second voyage, naming it San Juan Bautista. The Taínos, the indigenous people, called the island Boriquén Tierra del alto señor ("Land of the Noble Lord"). In 1508, the Spanish granted settlement rights to Juan Ponce de León, who established a settlement at Caparra and became the first governor. In 1519 Caparra had to be relocated to a nearby coastal islet with a healthier environment; it was renamed Puerto Rico ("Rich Port") for its harbor, among the world's best natural bays. The two names were switched over the centuries: the island became Puerto Rico and its capital San Juan. The United States anglicized the name to "Porto Rico" when it occupied the island in 1898 after the Spanish-American War. This spelling was discontinued in 1932. Puerto Ricans are a Caribbean people who regard themselves as citizens of a distinctive island nation in spite of their colonial condition and U.S. citizenship. This sense of uniqueness also shapes their migrant experience and relationship with other ethnoracial groups in the United States. However, this cultural nationalism coexists with a desire for association with the United States as a state or in the current semiautonomous commonwealth status. Location and Geography. Puerto Rico is the easternmost and smallest of the Greater Antilles, bordered by the Atlantic Ocean to the north and the Caribbean Basin to the south. Puerto Rico is a crucial hemispheric access...

...Strategic Planning: What does it Mean?, and How is it done Effectively? Most business owners or managers recognize that a strategic plan is a directional map for where their companies are headed and how they intend to get there. However, it is much harder for them to understand what goes into the strategic planning process, how the strategy-making task is best performed, and the full impact of the process the planning team goes through to develop the strategic direction of their organization. Strategic planning is best done when a company looks at its past, present, and future in light of its related environment. It is the process of thinking about the company and its related environment as an integrated whole. A process during which an executive "planning team" is organized to consider three key questions on a continuous basis: 1. What is our business? 2. Where do we wish to arrive, and when? and 3. How do we get from here to there? In a personal interview, Karen Poppe, Vice-President of Human Resource Management at Wall Drug, discussed the importance of organizing a strategic planning team to guide the long-term direction of a company. The planning team at Wall Drug consists of six key management people covering finance, personnel, and marketing. Clearly the success of those planning efforts is reflected in Wall Drug's average annual growth rate of 25% over the last five years. What is our...

Keats File

...John Keats John Keats (/ˈkiːts/ 31 October 1795 – 23 February 1821) was an English Romantic poet. He was one of the main figures of the second generation of Romantic poets, along with Lord Byron and Percy Bysshe Shelley, despite his work having been in publication for only four years before his death.[1] Although his poems were not generally well received by critics during his lifetime, his reputation grew after his death, and by the end of the 19th century, he had become one of the most beloved of all English poets. He had a significant influence on a diverse range of poets and writers. Jorge Luis Borges stated that his first encounter with Keats was the most significant literary experience of his life.[2] The poetry of Keats is characterised by sensual imagery, most notably in the series of odes. This is typical of romantic poets, as they aimed to accentuate extreme emotion through the emphasis of natural imagery. Today his poems and letters are some of the most popular and most analysed in English literature. 1 1.1 Biography Life mask of Keats by Benjamin Haydon, 1816 Early life John Clarke’s school in Enfield, close to his grandparents’ house. The small school had a liberal outlook and a progressive curriculum more modern than the larger, more prestigious schools.[11] In the family atmosphere at Clarke’s, Keats developed an interest in classics and history, which would stay with him throughout his short life. The headmaster’s son, Charles Cowden Clarke, also became an important...

Descriptive Essay

...Headnote This two-part exploratory study utilized a social cognitive theory framework in documenting gender portrayals in teen movies and investigating the influence of exposure to these images on gender-based beliefs about friendships, social aggression, and roles of women in society. First, a content analysis of gender portrayals in teen movies was conducted, revealing that female characters are more likely to be portrayed as socially aggressive than male characters. Second, college students were surveyed about their teen movie-viewing habits, gender-related beliefs, and attitudes. Findings suggest that viewing teen movies is associated with negative stereotypes about female friendships and gender roles. Research examining the effects of media exposure demonstrates that media consumption has a measurable influence on people's perceptions of the real world, and, regardless of the accuracy of these perceptions, they are used to help guide subsequent attitudes, judgments, and actions. For example, these results have been yielded for viewing media representations of race,1 the mentally ill,2 and the elderly.3 Past research additionally indicates that watching televised gender portrayals has an effect on individuals' real-world gender-based attitudes, beliefs, and behaviors.4 Based on this research, and the tenets of social cognitive theory, it would be expected that consumption of teen movies would have an analogous influence on audience members' gender-based attitudes and beliefs...
