I am writing this paper so that I can learn about the process for filing a small claims lawsuit in Santa Clara County. According to the Santa Clara County Superior Court of California website, small claim courts are courts in which plaintiffs can resolve their disputes in the quickest, easiest, and cheapest ways. Small claim courts also have procedures which are straight-forward as well as an informal hearing as part of their process. The form which the plaintiff obtains to file a small claims court against another person, also known as the defendant, is on the website for the California Judicial Branch. When you go to that website, you go to the “Forms and Rules” tab and click on the link for the “Browse All Forms” page. There, you go to the …show more content…
In cases where the defendant is outside the county which the claim is being filed in, a judge will determine whether the plaintiff filed the case at the right court. If the judge thinks that the court where the case was filed was not the right one, the claim will be denied. If the defendants are present at the court and want to have a hearing at the court where the case was denied, then the case will not be denied. One exception to this policy is if the plaintiff wants to file a case in a county where the defendant does not live. In that case, the plaintiff would have to ask their Small Claims Advisor to find out if they can do so. Another exception would be if the plaintiff can file their case in multiple courts. This would require the plaintiff to choose the court which is best for their witness. If the defendant does not reside in the area where the case is filed, they will need extra time to respond and there may be a delay in getting the case to …show more content…
If the individual is under 18, they must be accompanied by someone who is 18 or older. Aside from the SC-100 form described above, there are some other forms which need to be filled. For instance, businesses with fake names also need to file form SC-103. In this form, an official of the business must state that their business has followed the laws for submitting a fake business name in California. These requirements must be met for the business to file a case in a small claims court. Otherwise, certain things must happen before an action gets filed. Someone other than the plaintiff must choose a date for the hearing, search for the defendant, and deliver a copy of the claim to them. Afterwards, that same person must fill out form SC-104, also known as the Proof of Service form. They must mention where and when they sent the claim to the defendant and sign it. Normally, a plaintiff must pay a fee to file their case in the small claims court. However, if they are unable to pay that fee, they can obtain an exemption to the court fees by signing form FW-001 for fee
