1. Define negligence.
Negligence is the failure to exercise the care toward others which a reasonable or prudent person would do in the circumstances, or taking action which such a reasonable person would not.
2. The 5 elements required for negligence are as follows. Describe each. a. Duty- The obligation of one person to another person. Duty constrains and channels behavior in a socially responsible way before the fact, and it provides a basis for judging the propriety of behavior thereafter b. Breach- implies the preexistence of a standard of proper behavior to avoid imposing undue risks of harm to other persons and their property, which circles back to duty. c. Cause in Fact- provides the central negligence element that links the defendant’s wrong to the plaintiff’s harm. d. Proximate Cause- a reasonably close connection between a defendant’s wrong and the plaintiff’s injury, a connection that is not remote. More broadly, proximate cause is a doctrine that serves to limit a tortfeasor’s responsibility to the consequences of risks viewed fairly as arising from the wrong. e. Harm (damages)- the damage a plaintiff suffers as a proximate result of a defendant’s breach of duty. Harm includes things such as: physical injury, death, and property damage.
3. There are 5 kinds of negligence. Describe each. a. Vicarious Negligence- This is when a defendant is held liable for the negligence of another person. This typically applies in situations where children caused serious injury, when a dangerous animal caused something such as a dog bite or if an employer was negligent in watching the actions of an employee. b. Negligence Per Se- is a doctrine within the law of Unites States of America whereby an act is considered negligent because it violates a statute (or regulation). c. Contributory Negligence- Should the

...Introduction Telecommunication: the transmission of information over long distances. It is a field that has evolved over millennia, from smoke signals and drum beats, to wireless technologies and the Internet. However, over the last two centuries, this evolution has become exponential; the nineteenth century brought forth the semaphore, then the telegraph and culminated with the 1976 invention of the telephone, by Alexander Graham Bell(1). In 1885, the Bell Telephone Company commenced operations in Alberta, Canada. A century later, in 1990, the Telus Corporation is established, via the largest IPO in Canadian history up to this time, raising $896 million (2). Telus is a leading national telecommunications company in Canada providing a wide range of communications tools for individuals and businesses (3). It is governed by the CRTC regulations and in direct competition with Bell Canada Enterprises and Rogers Communications Inc. These three companies represent 95% of the Canadian telecommunications market (4), with BCE leading at 44%, RCI at 28% and Telus a close third, with 23% market share. The company is focused on growing through innovation and efficient utilization of their intellectual capital, their core values, and establishing itself as the Canadian market leader. Bibliography 1. Reflection Instructions

...Reflection Paper Assignments Due Dates: March 20, April 3, May 1 Overview These reflection papers are the chance for you to review your recent journal entries (or the sum total, if that helps) and to synthesize some thread of thinking or learning that you find in there. You might build on a single entry or on something bridging multiple entries, but the point is to capture something that you are learning. We expect the paper to have some over-arching, coherent argument so that it is not simply a string of thoughts. A string of thoughts is fine for your journal entries, but here we do want some synthesis. You should not spend time summarizing your activities, unless that is essential for your argument. Grading Criteria The criteria we will use to evaluate the papers are listed below. Note that you do not have to address all of these criteria in one paper. We want you to address all of them over the course of the semester, but any single paper can focus on only one or two of these. Regardless of what you choose to write your reflection synthesis on, your paper must demonstrate clear, coherent argumentation. 1. Expression of Learning 2. Discussion and/or synthesis of course readings 3. Reflection on assumptions and cultural frames of reference 4. Connection to proposal process Word Count The reflection papers, except for the final one, should be at least 500 words, but not a lot longer than that. The final paper should be around...

Personal Narrative: Art Censorship

...Throughout my 8th grade writing career, I have changed a lot. I used to despise writing assignments, and I always procrastinate when I have to work at home. Now I find myself enjoying some of the writing tasks. I still think some papers are pointless, but I have started to enjoy prompts such as narrative writing. In fact, I have even started to write my own story for fun. As a writer, I’d say I use pretty good language. I can describe things well, I’m good at organization, but I can improve on all of these. I also need to work on concentrating so that I don’t have to work late. A writer always has room to grow. While one may be excellent in some parts of writing, they’re not the best at everything. For me, I’d say I’m good at descriptions,...

Ancient Chinese Contributions

...Ancient Chinese Contributions Kenneth Smith Professor Maxine Brown HUM 111-World Cultures I November 29, 2012 The Ancient Chinese culture has contributed in many ways to the way of life today as we know it. Upon completion of this paper, I will have identified eight to ten useful inventions or contributions that are used in the world today. Some of these inventions include the compass, gunpowder, row planting, deep drilling, and toilet paper and so on. Within those eight to ten inventions, I will choose four that I believe are the most innovative. Row Planting (Feudal period – 6th Cent BC) The Chinese started planting crops in rows sometime in the 6th century BC. This allows the crops to grow stronger and faster. It facilitates more planting, weeding, harvesting and watering. There is also documentation that they realize that as wind travels over the rows of plants there is less damage. This obvious development was not instituted in the western world for another 2200 years. (Steven H 2009) Compass (Feudal period – 4th Cent BC) The Chinese developed a lodestone compass to indicate direction sometime in the 4th century BC. These compasses were south pointing and primarily used on land as divination tools and direct finders. Written in the 4th century BC, in the Book of the Devil Valley Master it is written: “lodestone makes iron come or attracts it”. The spoons were made of lodestone, while the plates were of bronze. Thermo-remanence needles were being produced for...

English 102 Class Reflection

...Perfectly Imperfect Decision,” an argumentative essay, became the bases for learning to support my opinion with aspects from a novel. This became especially challenging in terms of trying to analytically defend and justify the decision of one of the main characters, despite the surface level analyses that the character was “wrong” for her decision. Developing a personal position that was rooted and supported by evidence from the text also helped to strengthen my ability to discern the appropriate voice needed in an argumentative essay. Argumentative essays should not only include a position on the topic, but it should also use emotional and logical appeals directed toward countering the opposing argument. Since originally submitting the paper I’ve made stylistic revisions including, not posing rhetorical questions that I leave unanswered which suggest a different style of writing such as a magazine or something less formal than an academic...

Emergent Literacy

...literacy is the consistency of all parts of language: speaking, listening, reading, writing, and viewing. Some people believe that, up until a child starts school he/she will first learn to read and then learn to write. The process to learning to read and write has to start early in a child's life. Right away they have contact with different types of communication from the start. Most children can identify basic signs and logos by the age of 2 or 3. From there they will begin to experiment with written forms of communicating long before they can read by scribbling. Reading and writing develop at the same time in young children who are unified or consistent. Children love to make marks on paper. As they do this, they begin to realize that the symbols on pages are letters that form words. This will help with the attempt to put their thoughts down on paper as well. The development of writing skills consists of stages that children go through. Parents can promote early literacy development for infants by presenting cloth or cardboard books with bright pictures, reading books that have rhyming words, surrounding children with fiction and nonfiction books, magazines or games, reading simple stories with one main character and a simple plot, responding to questions your child might have about print in your house or elsewhere, and supporting early writing by making sure that paper, crayons, pencils and markers are always available. Parents can also promote early literacy development...

...writer is when I do my papers I have to make sure that I have the correct grammar and no misspelled words. Because when write you want to make sure that your papers flows and that you stay on topic. Because you as a writer wants the people to understand what they are reading. Because your paper have to have so meaning to it and it have to have some clarity to. When I revise my papers it make me look at the things I done wrong. Like when I have misspelled words I can correct them and when I have sentences that don’t make sense and I take the out. When I write I make the mistake of writing a lot of write on sentences. I have to make sure that I don’t do that anymore. I have to make sure that I don’t forget the punctuations because I have the habit of not putting them where they belong and stuff. When I was writing my paper on my mother I think that I did a good job but I think that I could have writing about her goals in life. What she has done with her life right now and what she wants to do right now. I could have talk a little more about what she has done for me when I was growing up. What she had to do to raise three girls on her own. The pattern of errors that I need to work on is run on sentences. Because when I write I can write a sentence that can go on and on forever without a period. A sentence fragment when I write I tend to write a sentence that don’t make any sense. I make sure that I write clear and complete sentences that have some thought to...
