INTRODUCTION:
This case involves Suspect Sonny Joyal being arrested for H&S 11550(a)-Under the influence of a controlled substance and unable to care for himself in public.

INVESTIGATION:
On 06-25-16 at 1828 hours, I responded to Lake Avenue and Orange Grove Boulevard to assist Officer Marin #5450 and Officer Woolford #9226 with an unconscious male White. Upon my arrival, I saw that the Pasadena Rescue Engine #33 and Pasadena R/A #33 was on scene. The paramedics were evaluating Robert MacConnell (DOB 12-19-67) at the northeast bus bench on Lake Avenue and Orange Grove Boulevard. I saw that Joyal had an empty beer bottle in his right hand. I escorted Joyal away from the paramedics and smelled a mild odor of an alcoholic beverage emanating from his person.
I observed Joyal was fidgety and was unable to maintain his balance. I believed Joyal may have ingested some sort of stimulant and decided to conduct an under the influence investigation.
I checked Joyal’s eyes for horizontal gaze nystagmus, vertical gaze nystagmus and lack of convergence and confirmed that three were present. I also saw that Joyal’s pupils were bouncing up/down and left/right as I checked his eyes. I found that Joyal’s pupils compared to 3.0 mm (normal is 3.0 mm to 6.5 mm). I checked Joyal’s pulse rate which was at 110 BPM (normal is 60-90 BPM). I asked Joyal if had taken any narcotics or drank any alcoholic beverages today. Joyal denied doing either.
I demonstrated the Rhomberg test to Joyal before he performed the test. Joyal estimated 30 seconds as 9 seconds. Joyal was also swaying approximately 2 inches in a circular motion during the
