"Members of the Jury, you will rise, hold up your right hands, and be sworn to try this case." It is the responsibility of the jury to judge the evidence and information of the case objectively in order to reach a just verdict. In this case of Steve Harmon vs. the state of New York, lots of evidence is provided. It is imperative that the jury disregards all factors that could create a bias in them, such as race, age, or surroundings. The jury should come to a just conclusion after they finish thoroughly examining the evidence presented. The information in this case can only lead to one true conclusion. Steven Harmon is innocent of felony murder because he is a good citizen, an accomplice and influenced by his surroundings.
Felony murder applies …show more content…
Steve was merely an accomplice. Steve Harmon is not guilty of felony murder.
Steve is a good citizen, a good kid. He never meant to be wrapped up in all of this, never saw himself serving jail time. When a preacher came to visit the jail, steve wanted to share a moment of prayer with him, as he felt that it would help connect him with who he really was. “I want to look like a good person, I want to feel like I’m a good person because I believe I am.” (Myers page 53). Family was something very important to Steve. He cared very much about his parents and his little brother. Somebody with a heart as big as his is not guilty of felony murder.
Steve’s surroundings were not the best. The people around him were involved in many different types of crime. Steve was surrounded by people, such as Peaches and James King, and he succumbed to their corruption. Steve’s surroundings, the people he grew up with, and the stereotypes accompanying his race do not define him, nor make him guilty of felony

...The Guide to the Business Analysis Body of Knowledge™ Version 2.0 Framework www.theiiba.org Introduction Purpose This document is intended to provide an overview of the framework developed for version 2.0 of the Business Analysis Body of Knowledge™ (BABOK™). Scope The term “scope” is used to mean a number of different things, but two definitions predominate: • Solution scope is the set of capabilities a solution must support to meet the business need. • Project scope is the work necessary to construct and implement a particular solution. When the BABOK refers to “scope”, the solution scope is meant unless we specifically say otherwise. The definition and management of the solution scope is central to business analysis, and differentiates it from project management (which is concerned with the project scope). Key Concepts Business Analysis Business analysis is the set of tasks and techniques used to work as a liaison among stakeholders in order to understand the structure, policies, and operations of an organization, and recommend solutions that enable the organization to achieve its goals. The BABOK is intended to describe and define business analysis as a discipline, rather than define the responsibilities of a person with the job title of business analyst (which may vary significantly between organizations). Business analysis may be performed by people with job titles such as systems analyst, process analyst, project manager, product manager, developer, QA...

Role of Information Technology

...The History of Information Technology March 2010 Draft version to appear in the Annual Review of Information Science and Technology, Vol. 45, 2011 Thomas Haigh thaigh@computer.org University of Wisconsin, Milwaukee Thomas Haigh The History of Information Technology – ARIST Draft 2 In many scholarly fields the new entrant must work carefully to discover a gap in the existing literature. When writing a doctoral dissertation on the novels of Nabokov or the plays of Sophocles, clearing intellectual space for new construction can be as difficult as finding space to erect a new building in central London. A search ensues for an untapped archive, an unrecognized nuance, or a theoretical framework able to demolish a sufficiently large body of existing work. The history of information technology is not such a field. From the viewpoint of historians it is more like Chicago in the mid-nineteenth century (Cronon, 1991). Building space is plentiful. Natural resources are plentiful. Capital, infrastructure, and manpower are not. Boosters argue for its “natural advantages” and promise that one day a mighty settlement will rise there. Speculative development is proceeding rapidly and unevenly. But right now the settlers seem a little eccentric and the humble structures they have erected lack the scale and elegance of those in better developed regions. Development is uneven and streets fail to connect. The native inhabitants have their ideas about how things should be done, which sometimes...

Matching Dell

...Harvard Business School 9-799-158 June 6, 1999 D Matching Dell O N Between 1994 and 1998, the revenue of Dell Computer Corporation rose from $3.5 billion to $18.2 billion, and profits increased from $149 million to $1.5 billion. The company’s stock price rose by 5,600%. During the same period, Dell grew twice as fast as its major rivals in the personal computer market and tripled its market share. In the first half of 1998, Dell reported operating earnings that were greater than the personal computer earnings of Compaq, Gateway, Hewlett1 Packard, and IBM combined. On Forbes magazine’s list of the richest Americans, Michael Dell, the 33-year-old founder of Dell Computer, ranked fourth with an estimated worth of $13 billion. He trailed only Bill Gates, Warren Buffett, and Paul Allen on the list and was worth more than Gates had 2 been at the same age. O Dell Computer had pioneered the widely publicized “Direct Model” in the personal computer (PC) industry. While competitors sold primarily through distributors, resellers, and retail sites, Dell took orders directly from customers, especially corporate customers. Once it received an order, Dell rapidly built computers to customer specifications and shipped machines directly to the customer. T The success of the Direct Model attracted the intense scrutiny of Dell’s competitors. By 1997, headlines such as “Now Everyone in PCs Wants to Be Like Mike,” “Compaq Reengineers the Channel: Will...

Accounting

...P R E FAC E THE ACCOUNTING ENVIRONMENT Accounting is the most employable, sought-after major for 2009, according to entrylevel job site CollegeGrad.com. One reason for this interest is found in the statement by former Secretary of the Treasury and Economic Advisor to the President, Lawrence Summers. He noted that the single-most important innovation shaping our capital markets was the idea of generally accepted accounting principles (GAAP). We agree with Mr. Summers. Relevant and reliable financial information is a necessity for viable capital markets. Without it, our markets would be chaotic, and our standard of living would decrease. This textbook is the market leader in providing the tools needed to understand what GAAP is and how it is applied in practice. Mastery of this material will be invaluable to you in whatever field you select. Through many editions, this textbook has continued to reflect the constant changes taking place in the GAAP environment. This edition continues this tradition, which has become even more significant as the financial reporting environment is exploding with major change. Here are three areas of major importance that are now incorporated extensively into this edition of the text. A New Way of Looking at Generally Accepted Principles (GAAP) Learning GAAP used to be a daunting task, as it is comprised of many standards that vary in form, completeness, and structure. Fortunately, the profession has recently developed the Financial Accounting...

A Pattern-Oriented Approach to Fair Use

...School Scholarship Repository. http://scholarship.law.wm.edu/wmlr A PATTERN-ORIENTED APPROACH TO FAIR USE MICHAEL J. MADISON* ABSTRACT More than 150 years into development of the doctrineof "fairuse" in American copyright law, there is no end to legislative, judicial, and academic efforts to rationalizethe doctrine. Its codification in the 1976 CopyrightAct appearsto have contributedto its fragmentation, rather than to its coherence. As did much of copyright law, fair use originated as a judicially unacknowledged effort via the law to validate certain favored practicesand patterns. In the main, it has continued to be applied as such, though too often courts mask their implicit validation of these patterns in the now-conventional "caseby-case" application of the statutoryfair use "factors"to the defendant's use of the copyrighted work in question. A more explicit acknowledgment of the role of these patterns in fair use analysis would be consistent with fair use, copyright policy, and tradition. Importantly, such an acknowledgment would help to bridge the often difficult conceptual gap between fair use claims asserted by individual defendants and the social and cultural implications of accepting or rejecting those claims. In immediate terms, the approach should lead to a more consistent and predictable fair use jurisprudence. When viewed in light of recent research by cognitive psychologists and other social scientists on patternsand creativity, in broader terms, the approach should...
