It will review ethical principles, business considerations, stakeholder impact, and the company’s internal policies related to preventing environmental damage. The thesis of this research essay is that Duke Energy did not only suffer financial loss due to being made to pay a fine for environmental damage, but also the company’s actions negatively affected its reputation and share price. Therefore, companies should carry out ethical practices and risk assessments to best serve the needs of all stakeholders. BACKGROUND INFORMATION In February, 2014, Duke Energy released a high amount of coal ash into the Dan River, Rockingham County, N.C., which violates the Clean Water Act (CWA) (1972). The CWA is a waste-water and pollution reduction programs, setting guidelines and regulatory standards for different industries (EPA). Specifically, The CWA of 1972, amended in 2002, states that “it is the national policy that the discharge of toxic pollutants in toxic amounts be prohibited” (Clean Water Act, SEC. 101.3). Duke Energy was found guilty on nine misdemeanor violations (Smith) and was ordered to pay compensation. The story concerned a small group of undervalued professional baseball players and executives, many of whom had been rejected as unfit for the big leagues, who had turned themselves into one of the most successful franchises in Major League Baseball. But the idea for the book came well before I had good reason to write it—before I had a story to fall in love with. It began, really, with an innocent question: how did one of the poorest teams in baseball, the Oakland Athletics, win so many games? For more than a decade the people who run professional baseball have argued that the game was ceasing to be an athletic competition and becoming a financial one. The gap between rich and poor in baseball was far greater than in any other professional sport, and widening rapidly. At the opening of the 2002 season, the richest team, the New York Yankees, had a payroll of $126 million while the two poorest teams, the Oakland A's and the Tampa Bay Devil Rays, had payrolls of less than a third of that, about $40 million. A decade before, the highest payroll team, the New York Mets, had spent about $44 million on baseball players and the lowest payroll team, the Cleveland Indians, a bit more than $8 million. Across the developed world, most particularly the US, the UK and the Eurozone, decades of stagnant real wages, accumulating debt and flagging innovation had left the middle class acutely vulnerable to the financial storm that swept the globe. In the wake of the Great Recession, a sizable stratum of spent consumers has materialized where an aspirational middle used to be. Overlooked—or just ignored— during the boom preceding the global recession was clear evidence that the position of the middle class in developed markets was increasingly fragile. The New York Times reported in early 2008 that “[t]he European dream is under assault, as the wave of inflation sweeping the globe mixes with this continent’s long-stagnant wages.” A recent report from the UK-based Resolution Foundation Commission on Living Standards documents the failure of wages in developed markets since the mid-1970s to keep pace with economic growth, as shown in Figure 1. This statement from the Office of Minority Health not only captures the tragic problem of health related issues of African Americans, it also applies to the social welfare problems of these children and their families. Each year over 2,000 children die at the hands of their parents or caretakers (U.S. Advisory Board on Child Abuse and Neglect, 1995). Abuse and neglect in the home are considered one of the leading causes of death for children four years of age and younger and the largest number of child abuse fatalities is due to severe head trauma. Homicide statistics are only part of the grim reality, with near–fatal abuse and neglect accounting for more than 18,000 permanently disabled children, and approximately 142,000 serious injuries (Baladerian, 1991).
