While conducting the main compartment search I also would ask Johns to empty the outer compartment. However if the T-shirt is the only item that turns up I would inform John that he is not permitted to wear the T-Shirt to school because it violates one of the school’s rules, but he could have it in his backpack. Afterwards I would stop the search and have John's put his item back into his backpack. Final step I would inform the parents of the search and why the search was performed.
To be sure when making a decision to unzip or not to unzip the outer compartment of the backpack I would refer to the Morse v. Frederick case. For the reason that the case discussed that schools may take steps to safeguard those entrusted to their care from speech
