John Smith Tax Issues 1. (a) Amount of $300,000 will be treated as self-employment ordinary income.
Self-employment tax is a tax consisting of Social Security and Medicare taxes primarily for individuals who work for themselves. It is similar to the Social Security and Medicare taxes withheld from the pay of most wage earners.
If you use a tax year other than the calendar year, you must use the tax rate and maximum earnings limit in effect at the beginning of your tax year. Even if the tax rate or maximum earnings limit changes during your tax year, continue to use the same rate and limit throughout your tax year. http://www.irs.gov/businesses/small/article/0,,id=98846,00.html 1. (b) Amount of $25,000 was paid to your office as recovery of expenses. If that was previously expensed, it will be considered an income to and will affect your tax rate. If the amount was held in escrow and was not expensed, you may deduct against expenses incurred during the case as business expense.
To give an understanding about “deferred expenses” we will define it as assets used to enable cash paid out to counterpart of goods or services to be received in a latter accounting period when fulfilling the promise to pay is acknowledged.
Even if a location tax incentive were treated as an amount paid to the taxpayer, it is generally not conditioned on the taxpayer’s actual use of the amount to acquire capital assets, and thus does not become a permanent part of working capital. In substance the incentive is simply a recovery of expenses of operations. See, e.g., Springfield Street Railway, supra (state grants based upon excise tax liabilities were reductions in tax liability and not contributions to capital, even though taxpayer acquired capital assets with the grants). The essence of a capital contribution is that it is used to enhance the

...Smith, Thank you for coming to our offices and allowing us to review and discus your concerns regarding your tax questions. I have been assigned to reply to your questions and I have listed my recommendations below. After you both have reviewed these recommendations, please contact me so we can go over any additional questions you may have. Mr. Smith’s questions: 1(a) How is the $300k treated for purposes of Federal tax income? According to the IRC §61(a)(1), “Except as otherwise provided in this subtitle, gross income means all income from whatever source derived, including (but not limited to) the following items: (1) Compensation for services, including fees, commissions, fringe benefits, and similar items”, the $300,000 you received must be included as part of your gross income, compensation for services, and as such it is taxable. 1(b) How is the $25,000 treated for purposes of federal tax income? The $25k you received as a recovery for expenses you paid in advance must also be treated as income. In general, an expense cannot be deducted if paid in advance. This is true for both the cash basis method of accounting and the accrual method of accounting. The prepaid amount is treated as an asset with a useful life extending beyond the current tax year, and carried over to the tax year where the expense applies. The Internal Revenue Service treats your out of pocket expenses, that you incurred in this contingency fee case, as a loan to you and therefore...

Time Management

...Nick Repak Director, Grad Resources http://www.gradresources.org/articles/time_management.shtml You finally decide to sit down to begin your paper. As your computer warms up, you pick up a journal that has sat in the "to be read" pile for a month. There is an interesting article on innovative research methods in your field, so you decide to take notes. Two hours later, the paper is still untouched when there is a phone call from your advisor. It seems that he was given an opportunity for a sabbatical in Europe, and the date for your proposal has been moved up six months. You immediately shove the books aside (for the paper you thought you would work on), and you begin outlining the proposal. After a few moments, there is a knock at the door. You knew your friend was having a difficult personal time but why did it have to turn into a crisis now? Being the sensitive and available person that you are, you set aside your work to listen and comfort your friend. After several hours, you realize, as your friend is leaving, that you haven't eaten, you never started on your paper, the proposal is still mainly a collection of ideas in your head; and that you were so preoccupied with the personal pressures you were feeling that you wonder if you really did your friend any good. However, you decide that the urgent things will always push out things you planned so you start to wonder if you should give up planning. The scenario described is often referred to as "The Tyranny of the Urgent...
