TAX FILE MEMORANDUM

SUBJECT: Mr. Aaron Research

Independent Contractor vs. Employee

Aaron, a resident of Minnesota, has been a driver for Green Delivery Services for the past six years. Aaron leases a truck from Green and his compensation is based on a percentage of the income resulting from his pickup and delivery services. Green allows its drivers to choose their own shift and does not exercise any control over how the services are carried out. In the agreement with Green, it labels its drivers as independent contractors, maintains no health or retirement plans for its drivers, and each year reports the drivers income by issuing Forms 1099-Misc rather than Forms W-2. Lastly, Green requires its drivers to maintain a commercial driver’s license and remain in good standing with the state highway law enforcement division.

Issue: The issue in question is whether Aaron should be classified as an employee of Green Delivery Services or if he is an independent contractor and therefore, should be subject to self-employment tax.
Section 3121(d) contains three separate and independent tests for determining who employees are. In general one can be classified as an employee if under the usual common law rules the relationship between him and the person for whom he performs services is the legal relationship of employer and employee. Generally such relationship exists when the person for whom services are performed has the right to control and direct the individual who performs the services, not only as to the result to be accomplished by the work but also as to the details and means by which that result is accomplished. That is, an employee is subject to the will and control of the employer not only as to what shall be done but how it shall be done. In this connection, it is not necessary that the employer actually direct or control the manner in which

There are countless, unseen individuals who make this happen each day, but how do they operate? How do they accomplish all of this? We live in a complex world. Behind the scenes, researchers are steadily developing new theories and testing their outcome. For them, statistics serves a very different purpose. In the next few paragraphs, the role of statistics is explained as their role in the psychological community. Statistics itself is then further subdivided into two different methodologies; descriptive and the inferential (Aaron & Aaron & Coups, 2009). Each method utilizes data for a different purpose, and in each method, data may be gathered differently. Lastly, an example of each of the two types of statistics which helps the reader to distinguish clearly between the descriptive and inferential types of statistics which researchers use to conduct their work. It will further be shown how the two methods of statistics relate to each other in research. It is by understanding the two different roles of each of these types of statistics that researchers are able to gather meaningful data, which is testable and provable and keeps us on a forward moving trajectory...

The Critique

...Final Paper Today I will discuss my final peer critique of Aaron, as written and evaluated by me,. As I set and prepared for Aaron’s speech, I notice his dress and demeanor. He appeared well to do with his jacket and slacks. As I further examined him I couldn’t help but notice that he was wearing a pair of work boots. I took this as to be the way Aaron is and nothing else. For if you know Aaron, you know he has a casual attitude and always ready with a smile. Before the class started that day we talked about our speeches and if we could convince ourselves of the topics we had decided on. He seemed a little nervous about his topic because he did not fully agree or disagree with the appearance of tattoos. We talked about both pros and cons of this idea but could not agree on one side. He told me that he had chosen the topic and was going to do what he could to convince us, though you could tell he was nervous. As Aaron stepped up to do his speech, that’s when I noticed his nerves set in on him. He didn’t seem as if he could loosen up and I believe the main reason why was because he wasn’t too sure of his topic. I do believe if he was convinced about it himself, he would have delivered a much better speech. His speech was well organized and prepared and followed the main ideas of what a speech should be, yet he was allowing his nerves to make him loose eye contact. As his speech proceeded Aaron settled down enough to allow his words to flow better. Here is where...

Budget Deficit

...unemployment, poor planning, increased military spending and poor projection and underestimations result in the budget deficit. During periods of economic recession in some country budget deficit is also likely to be experienced. Expansionary fiscal policy may lead to budget deficit since it involves increase in government spending. Such condition is very challenging to the economic growth and development and may also increase the rate of borrowing of a country to surpass its budget (Aaron, 2014, pp. 1). Budget deficit can be explained as the difference between the government revenue and the government expenditure calculated over some set period (one year). It occurs when the expenditure has exceeded the income for some set period of time. In most cases the result is an increase in government borrowing as was the case in the UK. When the government is operating at the deficit and still the economy is strong, it becomes the challenge to most of the citizens and the government dealings as well (Aaron, 2014, pp. 1). Short run deficit may be caused by the government having decided to run some temporal deficit to...

Academic Integrity and Ethical Procedures as They Relate to Students, Scholarly Research and Practice

...The purpose of this paper is to address the issues surrounding academic integrity and ethical procedures as they relate to students, scholarly research and practice. We will take a look at the viewpoints of two articles that tackle this issue. When I think about the word “ethics”, morals and doing the right thing come to mind. In life there is a constant struggle between making good and bad choices, especially if the choice you choose can make or break your career. In the first article, Aaron and Roche, (2013) highlight several levels of academic dishonesty being displayed and the repercussions that followed as a result. Together Aaron and Roche, try to identify where academic dishonesty can begin and how society plays a major role in its flourish. From an early age, we are taught to be competitive and to always strive to be the best at what we do, at least that’s what most parents expect from their children. There is an enormous amount of pressure placed on children in the elementary and high school grades to achieve high scores on standardized test. Unfortunately, this type of pressure if continued can lead to cheating on the collegiate level (Schellenbarger, 2013). Academic dishonesty or “cheating”, has become a common standard amongst specialized high schoolers and prep school students. In one scenario, involving a specialized school in New York, high school students devised an organized plan to cheat on a Regents exam. Of course the students involved were caught and...

I also take a look at how there is a trade off between the exchange rate regime and trade activity shapes up. Fixed exchange rates are a monetary regime used by around 50% of the world’s economies. The advent of fixed exchange rates is not common in the developed world. One exception to this is the EU which maintains a very stringently monitored monetary policy. Fixed exchange rates are a popular policy tool in the emerging economies, where the governing elements are more interested and inclined towards keeping the rate of inflation low so that maximum public welfare can be provided (Rowlands 2009). ...The relationship between individual values and psychological contracts Aaron Cohen Department of Public Administration, School of Political Science, University of Haifa, Haifa, Israel Abstract Purpose – This paper seeks to examine whether individual values are related to perceptions of psychological contracts and psychological contract breach when justice perceptions are taken into account. Design/methodology/approach – The study sample comprised staff employees of one of the largest banks in Israel. The sample included 311 employees in the head office of this bank. Data were collected from the employees over a period of about three months. Findings – The findings show a modest relationship between individual values and perceptions of a relational type of psychological contract. The findings show weaker relationships between the values, perceived transactional-type contracts, and perceptions of contract breach. Research limitations/implications – The study relied upon a cross-sectional design. Such a design consists of a single observation with no control groups, and so cannot be used to draw conclusions about causal relationships between the variables. In addition, the study examined only one professional group in one culture. Practical implications – The significant relationship between conservation and self-transcendence values and perceptions of relational-type contracts suggests that organizations should take this into account when making hiring and human...
