Miscarriage of Justice
The right to a safe abortion and the right to determine when and if to become a parent should be choices that can be made without being penalised. Women should have the right to make decisions about their own bodies. Making abortion illegal does not reduce the number of abortions. It is estimated that there are between 10000 and 14000 abortions in Queensland every year compared to approximately 17000 in Victoria where abortion is legal . Access to safe abortions and the legislation allowing abortion can prevent unnecessary suffering both physically and emotionally.
To accept the High Court Judge, Justice Kirby’s statement that ‘no human justice system is perfect’ is unsatisfactory and would allow for the legal system …show more content…
The emotional impact that abortion can have on women is substantial and going to court to request an abortion can add to the stress. Also, other external circumstances, such as financial and social issues, can contribute to more emotional harm. The partner would be affected as they would have to accept her decision. The healthcare practitioners are impacted as they do not want to go to court for performing an abortion illegally as the law is unclear. The Courts would be affected as there are more people requesting abortions which would use up the judges time when they could easily go to a doctor to make the same decision. Most abortions occur in a private hospital or clinic which means that they are expensive. This cost is usually higher for women in rural areas who have to travel in order to have an abortion as well as taking time off work. Rural women would have to pay in excess of $2000 to have the same abortion as women in metropolitan areas who would only have to pay around $500. Even the lesser of these two amounts can be a barrier for some women to access. The law currently impedes access for abortion services to disadvantaged women. Women who are pregnant after being sexually assaulted, have serious health conditions, experiencing severe violence, who have little access to financial and social support and who are homeless, are finding hard to access services and are being turned away from public hospitals in Queensland after requesting an abortion. Abortion access shouldn’t be based on the postcode of women. Women deserve equal access to health services regardless of where they live or how much money they earn
