In the case Danny suing Lisa to have her evicted from the land, it is important to examine the facts of the case. Lisa has the gazebo built 15 years earlier, she built the fence soon after between her and Danny’s property. From the beginning the gazebo was thought to be on her side of the fence. It is not known why Danny waited 15 years to have his yard surveyed which lead to the discovery that the gazebo and the fence belonging to Lisa encroached on his property. The primary defense Lisa can use in this suit is Adverse Possession which states that it is a method of gaining legal title to real property by the actual, open, hostile, and continuous possession of it to the exclusion of its true owner for the period
