Licenses and Agreements

...Shrink-wrap agreements are sometimes called shrink-wrap licenses and are the internet equivalent of click-on agreements. A shrink-wrap agreement is an agreement whose terms are expressed inside a box in which the goods are packaged. Normally, a shrink-wrap agreement is not between a retailer and a buyer, but between the user or buyer of the product and the manufacturer of the hardware or software (Miller & Jentz, 2008). Many courts have determined that the seller has proposed a contract by including the terms with the product that a buyer could accept after reading the terms and using the product. A buyer’s failure to object to the terms contained within a shrink-wrap software package constitutes an acceptance of the terms by conduct. In this case the terms of the shrink-wrap agreement will be enforced by the courts. Shrink-wrap agreements will not be enforced by the courts if it is determined that the seller communicates the terms after a contract has been formed with a buyer. Under these conditions the courts would find the terms were not a part of the contract unless the buyer agreed to them (Miller & Jentz, 2008). In Mary DeFontes’ case she purchased the computer which contained an agreement that included the remedies available and the terms of the sale. By keeping the computer and using it for longer than thirty days and failing to object to the terms, it looks as if DeFontes is in acceptance of these terms. Dell’s website included an inconspicuous link at the......

Tenant Landlord Agreements

...Landlord tenant laws, are all state laws the same? The purpose of this paper is to develop an understanding of landlord tenant laws and make a comparison between several states. The majority of the information used in this paper will come from the States of Ohio, West Virginia, and Pennsylvania. However, there are some court cases from other states that will be examined as well. The most important thing for all parties involved to understand is exactly what is expected of them and for these expectations to be defined in a formal document called a lease. A lease is a formal legal document outlining the terms under which one party agrees to rent property from another party. [1] A lease is designed to protect both the landlord and the tenant and serve as a legal binding contract depicting each parties responsibilities. In addition to a lease most state and local governments have requirements that need to be met called standard living conditions. For the most part these living conditions are similar from state to state. In some instances cities have code enforcers who do inspections on homes once they become vacant. Generally this inspection consists of a walkthrough of the apartment or house while it is vacant to ensure that the property meets standard living conditions. Some items that are inspected are windows, doors, handrails on stairs, working heating system and hot water. A person living in the state of West Virginia has the right to live in decent......

Hybrids CONCESSION This is a kind of contract that creates the greatest distance between the government and oil operators. Under this agreement, the Contractor has exclusive rights to explore, develop, sell, and export oil/gas from a specified area for a fixed period of time. The Company is responsible for all decisions concerning production, although the government may require that a production plan be submitted and approved. JOINT VENTURES Under the Joint Venture agreement, the International Oil Companies and the National Oil Companies form a Joint Venture. Pre-Nuptial Agreements

...legally enforceable contracts.” Critically analyse this statement with reference to recent developments in England and Wales, and in other jurisdiction(s) where appropriate. In a society where forty two per cent of marriages end in divorce, marriage breakdown is an unfortunate yet inevitable reality for many. With the development of pre-nuptial agreements in many other jurisdictions, there has been recent pressure on the government here to legislate in the area of the law. Pre-nuptial agreements are entered for many reasons, there are the obvious security benefits such as protecting your wealth in case of marriage breakdown and there are also less cynical reasons such as safeguarding for children of a previous marriage or protecting family wealth. This essay will outline the current law on pre-nuptial agreements in England and Wales, followed by recent developments and views. The US laws on pre-nuptial agreements will be drawn upon as a comparison and the conclusion will focus on what is the best way forward for England and Wales. I propose that this will be updating current legislation to allow pre-nuptial agreements as the freedom to arrange a marriage as they so wish should be reflected in their freedom to make arrangements for the financial breakdown of their relationship. Current law in England and Wales...
