I have to agree that it was Letisha’s responsibility and obligation to have read the entire contract before she entered into the agreement. If she did not want to read the contract, she should have asked a series of questions in which the salesperson for Sudson would have been obligated to answer them honestly. One of those questions should have been how the renewal and termination procedure is conducted after five years. I think Letisha may have some legal arguments that she could present in court if she gets sued for breach of contract. One of these arguments the contract is unconscionable. This contract stating that the renewal had to be canceled 90 days prior to the contract ending and by certified mail is an acceptable clause, however, to automatically renew this lease for three five-year terms or another 15 years is ridiculous. Letisha owns a five unit complex in which all the tenant use one washer and dryer, the amount of wear and tear on these machines over a 20 year period in total it is unlikely that these machines would still be working at that time. One other argument is that the contract is indefinite in which these weren’t the terms that Letisha agreed upon when signing this contract. The arguments for Sudson in support of the enforcement of the automatic renewal clause would to me be the six requirement elements of the formation of a contract. The contract was a legal offer that was made in a legal nature. Letisha agreed to and accepted the contract and signed and dated the contract. I believe there was consideration by Letisha as she listened to the services that the salesman of Sudson provided to her. Letisha demonstrated genuine assent and entered into the contract as being a genuine and did not enter this contract by being pressured or under duress.
