Alex Wubble, the head nurse at University of Utah Hospital’s burn unit, was violently arrested after refusing to obtain a blood sample from a patient for a police officer without any of the three requirements. The three requirements which is an electronic warrant, patient's consent, or patient under arrest, which is also something that the police station agreed to follow with the hospital. The patient could not consent, the officer told Ms. Wubble he didn't have a warrant, and the patient wasn’t under arrest. After politely explaining that to the officer, he angrily grabbed her and shoved her out of the hospital doors and aggressively put her in handcuffs while shoving her against the wall claiming she was interfering with an investigation. …show more content…
Anyone can use it as for Police Officer, EMT’s, Nurses, etc. as long as the patient is under arrest but that wasn't the case in this situation. Implied Consent would not have applied under the circumstances because the officer was trying to prove that the patient WAS NOT under the influence according to criminal law professor Paul Cassell. Meaning Wubble was doing the right thing and was simply following protocol. During the arrest the officer also failed to read her Miranda Rights, which most people would see as a problem but in fact an officer is only required to read someone their rights if he/she is under arrest and is going to be questioned about a crime. The problem with that is Wubble wasn’t being questioned, it was more of a lecture on how she was wrong for doing her job and “preventing the officers from doing their
