1. What is an adverse impact? How does it differ from adverse treatment?
Occurs when a decision, practice, or policy has a disproportionately negative effect on a protected group. Adverse impact may be unintentional. Adverse treatment though is the receiving of those negative occurrences through performance evaluations and lack of promotions. Adverse, or disparate, impact concerns any consequence resulting in the workplace that discriminates against employees who are members of a specific group. This differs from adverse treatment, which happens when a member of a specific group receives less favorable outcomes in an employment decision than a person who is not a member of a group.
2. What is "business necessity" as it applies to equal employment opportunity?
Business necessity means that you expect your workers to have the necessary skills, knowledge, and abilities required to the perform the essential elements of the job. Even though these skills are important an organization must ensure they look at this equally with each employee.
3. Describe the pros and cons of giving workers advance notice of a major layoff or plant closing?
Allowing the workers to know in advance that the plant is closing helps they make the transition to find new work earlier. It allows for a community to adjust to the changes in revenues and it helps the company maintain a positive look in the consumer’s eyes. Not ever circumstance can be foreseen even though the company alerts its workers ahead of time the company may still feel the impact years after by lack of future sales of products. Plus, the company has to ensure they do everything the law requires of them making the process difficult and time consuming.
