In the Montalvo v. Radcliffe case, a young boy was turned away from karate lessons because he had AIDS and the karate company providing the lessons had discovered this. Michael Montalvo is a 12-year old boy who the Radcliffe’s, James and Donna, turned away from their company to stop the accident of spreading HIV. The boy’s father filed that this treatment was against the American’s Disabilities Act (LexisNexis, 1998). During the trial, they encountered the perspectives of each side. The Radcliffe’s refused in him protection for their other students. While, the Montalvo’s explained of the unfairness Michael was facing just because he had AIDS.
