Challenges of Being an Advocate and Neutral Facilitator
In some circumstances an advocate or mediator may face the potential of a dual relationship in which said advocate or mediator most likely will face ethical, moral, and legal challenges. Dual relationships occur when professionals assume two roles simultaneously or sequentially with an individual seeking assistance (Guthmann, Heines, & Kolvitz, n.d.). Dual relationships include sexual intimacy with a client and (or) providing the service to a friend or relative. Within this paper an exploration of the ethical, moral, and legal challenges advocates and mediators may face regarding dual relationships will occur. A personal opinion concerning the integration of advocacy and mediation within the human services field will also be presented as well as a personal philosophy and approach to advocating and mediating within a child welfare agency setting.
Challenges of Dual Relationships
An advocate or mediator offering friendship or love to a client outside the purview of his or her duties, or if the exchanges goods or services with a client has occurred, indicates professional boundaries have been violated and a dual relationship has been formed (Mediation Council of Illinois, 1999). A Dual relationship is considered a conflict of interest and crosses the ethical boundaries issues set forth in most advocacy and mediation code of ethics. Advocates and mediators should respect clients’ integrity and protect the well-being of clients with whom they provide a service. ...We are taught in nursing school to be patient advocates, respect all patient rights, so cultural competence is very important. We experience diversity between most of our co-workers in the hospital, with our patients and society. As nurses, we may not always believe or understand our patient’s beliefs but we need to respect them.  Knowledge, attitude and skill are important when caring with the different cultures with our patients. When I was in high school at 11th grade, I was selected to represent my school in a debate competition. The chairman gave the topic of the debate to my co-debater two weeks prior to the debate. However, it is believed that one in four girls and one in six boys will be sexually abused before the age of eighteen ("Breaking the cycle," 2005). As a future advocate for children I want to work directly with children who have experienced trauma as a victim of child abuse. As an advocate it would be my responsibility to provide information on domestic violence and child abuse. Sometimes I would accompany the victim to Municipal and Domestic relations Courts, link victim to helpful community resources, and provide information about domestic violence and child abuse and legal options available to the victims. I might also conduct community meetings and speak on the topics such as the different types of child abuse and the cycles of a perpetrator and how to recognize the signs and get help. There are crisis intervention services that help children who have witnessed violence. The purpose of those programs is to help children/youth overcome the effects of exposure to violence and trauma. There are also resources in the community that are helpful for families. There is a growing awareness of child sexual abuse therefore increasing the number of child abuse cases reported and the numerous children undergoing investigations in court procedures.
