BI really think countries have to determine whether a gift is a bribe or a friendly gesture. This where it gets tricky for countries because they do not want to offend anyone or start a conflict between cultures. In some places, such as Japan, it is considered courteous to give a gift before doing a business deal. The questions start to arise now because the company has no idea how to take this gift.
Japan has a unique culture where giving a small gift is a nice gesture before doing business. I think this is the same for South Korea because most of your Asian countries like giving a small gift before doing business. The Netherlands somewhat shocked me because of how much business is done with them. We get most of our trucks from them and even some alcohol products.
Countries really need to set a specific definition of bribery and have questions to ask yourself if you are being bribed. This can really help a company because it looks good on their part. It shows people that they cannot be bought or paid off. It is also good to have a punishment if a violation is found. The FCPA fines companies or even gives the person or persons jail time. This a good law to look at because it gives a good definition of bribery, making payments to foreign officials for the purpose of obtaining or retaining business.
