“Preemptory challenges are “the right to dismiss prospective jurors for any reason at all except race or gender” (Smith, Jun 22 2005, Para 2). During jury selection preemptory challenges are used by getting rid of a juror who may be qualified to be part of the jury, but for the opposing party. For example, a juror member may be pro-death but opposing side is looking for an individual who is against the death penalty. This results in removing the juror member because it can work against the opposing side. Additionally, in Massachusetts and California courts they differ in their use of pre-emptory challenges. First, in Massachusetts it “allows twelve peremptory challenges in the trial of life felonies--where conviction can result in a life sentence
