A prosecutor and a defense attorney are different in a lot of ways. The prosecutor works for the plaintiff and the state's case, and they show the gathered evidence that proves that the person accused of the crime is guilty of committing it. The defense attorney's job is to give evidence that proves that the accused is not guilty. If you are accused of a crime, you will share a table at the trial with the defense attorney. The prosecutor tries to prove your guilt, while the defense attorney does their best to prove that you are innocent. The defense attorney works on their own for you, but the state pays the prosecutor. A person can, and would, hire a defense attorney, but never a prosecutor. Even though public funds are paid to prosecutors, they are not employed by the government. The person who they defend pays the defense attorney – the prosecutor is responsible for representing the government when they bring a suit against an accused criminal. The prosecutor's job title is different in each jurisdiction, but they are often called the district attorney, county attorney, state attorney, city attorney, or United States attorney. The prosecutor is charged by the public with punishing people who commit crimes, so that they can protect law-abiding citizens. The defense attorney has to protect the rights of people who are accused of a crime. If I was to become a lawyer I would definitely want to be the prosecutor so that I can represent people that might not be here anymore to tell their side of the case. It would give me great pride to help people and prove that they were the victim of a crime, and that the person that committed the crime is going to serve his punishment. The prosecutor controls the flow of the cases by deciding which ones are ready for trial, which ones need more investigation and on which cases there is sufficient evidence to convict. Then you have the judicial resources that are available. Typically most courts are overloaded. Then you have the Defendant who often wants to delay the case as long as possible or either wants a quick trial, depending on the circumstances. However, it is the prosecutor that has his thumb on the cases and decides which ones will actually go to trial, which ones to plea bargain and which ones to dismiss. Which is another reason why I would want to be a prosecutor.

Insanity Defense Paper

...Insanity Defense Paper Team B CJS/305 June 1, 2015 David Harper Insanity Defense Paper Mr. Stu Dents is charged with the murder of his girlfriend and a legal team has been chosen to represent him. At the time of his arrest, Mr. Dents was witnessed by police yelling such things as “Alien” and “I am God, let me go! I am God!” Now facing not only homicide but several other criminal charges such as burglary, assault on police, and kidnapping, Mr. Dents has made the choice to plead insanity. However, the question remains as to whether or not there is enough for an insanity defense. Should Mr. Dents stand trial? What are the state requirements for an insanity defense? What steps must be taken to prove insanity? Trial Mr. Dents’ defense team needs to decide if he should stand trial or not. Based on his arrest information a reasonable person would believe Mr. Dents to suffer from some sort of mental illness. However, when deciding if a defendant should stand trial or not the decision is not based on their mindset during the crime or the arrest. The decision is based on the mental state of the defendant at the start of trial. According to Criminal Law Today, “a person is competent to stand trial if he or she, at the time of trial, has sufficient present ability to consult with his or her lawyer with a reasonable degree of understanding and a rational as well as factual understanding of the proceedings” (Schmalleger, Hall, & Dolatowski, 2014). Mr. Dents has already consulted...

Insanity Defense Research Paper

...Insanity defense is a legal provision Insanity defense, which is also referred to as the mental disorder defense, is a defensive mechanism that is based on excuse in criminal trials. In the insanity defense, the defendant is alleged not to be responsible for the criminal actions because they have a persistent psychiatric illness or episodic. The insanity defense is one of the oldest fixtures of the Anglo-American legal tradition (Ewing, 2008 p. 188). Most of the cases that relate to the insanity defense are normally highly controversial, contested and time consuming. Consequently, in insanity defense, the defense is based on the information given by the accused in a criminal prosecution; the action is made this way to avoid defensive liability...

Defense Paper

...On December 24, 1968, a 10-year-old girl went missing in Des Moines, Iowa. That same day, a man named Robert Williams was seen carrying a burlap bag with what looked like human legs hanging from the bag. A warrant was issued in Des Moines for Williams’s arrest and two days later, 160 miles away from Des Moines, he turned himself in for questioning. Williams was properly Mirandized and an attorney in Des Moines told him to not say anything until he could talk to his lawyer back in Des Moines. Two detectives who were in the car with Williams engaged in a casual conversation with him. Knowing about Williams’s religious background, the detectives explained to Williams how the little girl’s family at least deserved to give the little girl a proper burial. Williams then lead the detectives to the body. I believe that Williams is guilty in this crime and that the detectives did not break any of Williams’s rights. Some may say that the detectives violated Williams’s right to counsel, others may say that the detectives even took advantage because of Williams having severe psychological problems, but I disagree. Williams was properly read his rights and was told not to speak until he was able to talk to his lawyer, so it’s not like he was unaware. The detectives technically did not question Williams. Instead, they recited the “Christian Burial Speech”, talked about how hard it would be to find the girl’s body due to all the snow from the bad weather, and that if Williams knew where...

Perimeter Defenses Paper

...IS411 Network Security Perimeter Defenses * What is the OSI model and why is it important in understanding networking? The OSI model is an internationally accepted networking model that describes and illustrates how networked devices communicate. The model describes how data is packaged for transmission and how it is handled on the reception side. The model is composed of seven layers the seven layers being; the physical layer, the data link layer, the network layer, transport layer, session layer, presentation layer, and the application layer. (Ciampa, 2012 pgs207-212) Each layer in the OSI model has a specific function and has protocols and applications that run in those layers. For instance; the physical layer, layer 1 encodes and signals for data transmission and reception, in addition network hubs are a layer 1 device. The data link layer, layer 2 is responsible for addressing, data framing, error detection, and handling, switches are layer 2 network device. The network layer, layer 3 is responsible for logical addressing, routing, fragmentation, and reassembly, routers are a layer 3 device. (Ciampa, 2012 pgs207-212) The transport layer, layer 4 manages connections, their establishment, termination, acknowledgment, and retransmission (when necessary). The session layer, layer 5 enables devices to establish and manage sessions. The presentation layer, layer 6 is where translation, compression, and encryption take place. Finally the application layer, layer 7 is where...

History of the Table Tennis Paddle

... and made a drum like sound when you hit the ball with it. The first paddle was also around 19 inches long, which is unheard of nowadays. As we neared the start of the 20th century, the paddles then started to become made of wood covered in sandpaper, followed by a “cork-faced” racket, which players liked because they thought it, improved their overall performance. As we neared the middle of the 20th century, the changes in the racket increased significantly due to a first time impact from Japanese technology. They tried adapting the racket so it would help a player either on the offensive or defensive side. For example, it says that they made a racket that was wide and had a “pimpled rubber” surface that was preferred by players on defense. Next, they developed a sponge type racket. When the sponge racket was implemented with rubber and was 1mm, it was said that it was more difficult to create spin on the ball. I found it interesting that they finally stuck with this type of material and instead went to a 2mm “pimple rubber racket” while they also tried ways to increase the spin and the way to defend the spin. And from then on, the table tennis paddle has stayed the same for the most part. The only changes could be customizations, where people had grips put on to the handle. According to the ITTF Handbook’s rules on the racket, it can be any size or shape, it just has to have a...

Perimeter Defense Research Paper

...Mr. Cameron, Sir, I would be happy to discuss our perimeter defenses. When defining the perimeter we must first ask, are we discussing a physical or a logical (computer) layer of defense? When you observed the guards, fences, and TV cameras, you were observing the physical perimeter defenses. When your colleague mentioned his network perimeter, he was referring to the defenses established to protect your information technology systems (networks, computers, data storage devices, and information). Network defenses include a variety of both hardware and software resources that mimic the function of guards, fences, and TV cameras, but focus on the protection of computer systems and information. What follows is not an all-inclusive list of network defenses, however, they are some of the more common examples that support information security. Like traffic cops, routers direct electronic media traffic in and out of our networks. A router is typically the first and last line of defense as it is commonly on the outskirts of the network defense perimeter. Picking up where the router left off, a firewall operates on a specified set of rules which determine what is allowed to pass. The different types of firewalls include: (a) static packet filters, (b) stateful firewalls, and (c) proxies. Firewalls do not necessarily know what legitimate traffic...

...Italian merchant and explorer Marco Polo exclaimed, “The houses of the citizens are well built and elaborately finished, and the delight they take in decoration, in painting, and in architecture, leads them to spend in this way sums of money that would astonish you” (Sayre, 2012, pg 497). One of the oldest civilizations in history, China is for these reasons revered for its many achievements throughout history. Following Rome’s fall during the beginning of the Common Era, China emerged as the strongest nation in the world (Sayre, 2012, pg 226). China’s many dynasties each brought technological, cultural, and intellectual advances. Included among these are gunpowder, the compass, printing, paper, tea, acupuncture, spaghetti, the utilization of animals for agriculture, the abacus, and paper money (Ray, 2004). Prosperous and peaceful dynasties such as the Han Dynasty encouraged spans of intellectual and cultural advancement that lead to the creation of many of these inventions (Sayre, 2012, pg 215). These inventions and ideas gradually reached the rest of the world through trade and exploration. Though Chinese engaged in trade...
