Ucp 600

...UCP 600 UCP 600 are the latest revision of the Uniform Customs and Practice that govern the operation of letters of credit. UCP 600 comes into effect on 01 July 2007 The 39 articles of UCP 600 are a comprehensive and practical working aid to bankers, lawyers, importers, and exporters, transport executives, educators, and everyone involved in letter of credit transactions worldwide. ICC Uniform Customs and Practice for Documentary Credits (UCP 600) Foreword This revision of the Uniform Customs and Practice for Documentary Credits (commonly called “UCP”) is the sixth revision of the rules since they were first promulgated in 1933. It is the fruit of more than three years of work by the International Chamber of Commerce’s (ICC) Commission on Banking Technique and Practice. ICC, which was established in 1919, had as its primary objective facilitating the flow of international trade at a time when nationalism and protectionism posed serious threats to the world trading system. It was in that spirit that the UCP were first introduced – to alleviate the confusion caused by individual countries’ promoting their own national rules on letter of credit practice. The objective, since attained, was to create a set of contractual rules that would establish uniformity in that practice, so that practitioners would not have to cope with a plethora of often conflicting national regulations. The universal acceptance of the UCP by practitioners in countries with widely divergent economic and judicial...

Constitution Time Line

...are five important documents that have had an impact on the evolution of the United States Constitution. These documents include the Magna Carta (1215), the Mayflower Compact (1620), the Declaration of Independence (1776), the Articles of Confederation (1777), and the Federalist Papers (1787-1788). Significant documents in their own right these papers laid the framework for the creation of the modern day United States Constitution. The inception of the constitution was born partly from the successes and failures these previous ruling documents brought to their countries. The Magna Carta or “The Great Charter” was created by Great Britain in 1215. It consisted of 63 clauses that dealt with the rights, customs, and administration of justice. It was put in place because of King John’s abuse of his people. He created chaos and did inhumane things to his people against the justice system. Only 3 of the original 63 clauses still remain which consist of “the clause confirming the privileges of the city of London and other towns; and the most famous clause of all which states that no free man shall be imprisoned, dispossessed, outlawed or exiled without the lawful judgement of his equals or by the law of the land” (Magna Carta 2008) The others have been replaced by modern laws and the original clauses were put in place so that limits were set on royalty and so that the King adhered to the law just like the rest of the people in Great Britain. This document has an impact on the...

Incoterm 2012

...RULES FOR ANY MODE OR MODES OF TRANSPORT EX WORKS EXW (insert named place of delivery) Incoterms 2010 GUIDANCE NOTE This rule may be used irrespective of the mode of transport selected and may also be used where more than one mode of transport is employed. It is suitable for domestic trade, while FCA is usually more appropriate for international trade. “Ex Works” means that the seller delivers when it places the goods at the disposal of the buyer at the seller’s premises or at another named place (i.e., works, factory, warehouse, etc.). The seller does not need to load the goods on any collecting vehicle, nor does it need to clear the goods for export, where such clearance is applicable. The parties are well advised to specify as clearly as possible the point within the named place of delivery, as the costs and risks to that point are for the account of the seller. The buyer bears all costs and risks involved in taking the goods from the agreed point, if any, at the named place of delivery. EXW represents the minimum obligation for the seller. The rule should be used with care as: a) The seller has no obligation to the buyer to load the goods, even though in practice the seller may be in a better position to do so. If the seller does load the goods, it does so at the buyer’s risk and expense. In cases where the seller is in a better position to load the goods, FCA, which obliges the seller to do so at its own risk and expense, is usually more appropriate. ...

...information should be archived is so that it frees up space in the workplace to ensure that the place is not cramped with information that is not required frequently and to make sure that it is a pleasant clutter- free place to work in. 1.2 The purpose of agreeing retention dates is to ensure that the organisation has compliance with the Skill Funding Agency which requires learner files to be held on to for 5 years. It is important for staff to know the retention periods before archiving so that there is no risk of archiving information that is not relevant and can be destroyed and also to ensure that there is no risk of destroying information that is still within its retention period which could cause huge problems to the organisation. Another purpose for agree retention periods is so that the archiving system can be kept organised and space on the hard-drive is not being wasted in information that doesn’t need to be kept anymore and it makes it easier for specific information to be found and accessed when needed as there are less files to look through. 1.3 When archiving information it is vital that it is filed in the correct place in the hard-drive so that authorised staff can access it easily, it is securely protected and there is no risk of the information becoming lost within the system. Ethical Concerns

...When creating a document on a computer, information about the document is automatically generated. This is considered metadata, also known as hidden data. This information is not visible in the document, but is considered to be part of the document. An author can place comments about the document in the metadata, meaning this hidden data can be inserted deliberately. This data can be hidden in many different places within the document. Metadata can be accessed by anyone who can open the electronic file, this includes clients and opposing counsel. There is a conflict concerning legal ethics when viewing the metadata of opposing attorney’s documents. According to Florida, Op. 06-2, settled “[a] lawyer receiving an electronic document should not try to obtain information from metadata that the lawyer knows or should know is not intended for the receiving lawyer.” Although, looking at your opposing attorney’s metadata is wrong, it is still permissible. Many firms use removal tools or “scrubbers” to remove private information from documents before sending them to a third party. Despite the most reasonable precautions, and even with the best intentions, it may not be possible to completely erase (scrub) potentially harmful metadata from documents before it is conveyed electronically. The sending lawyer would be “at the mercy” of the retrieving attorney. Lawyers sending communications or other documents electronically, need to know such activities have an inherent risk. A lawyer...

...ARTIFICIAL INTELLIGENCE Artificial intelligence is the intelligence of machines and the branch of computer science that aims to create it. AI textbooks define the field as "the study and design of intelligent agents where an intelligent agent is a system that perceives its environment and takes actions that maximize its chances of success. John McCarthy, who coined the term in 1956 defines it as "the science and engineering of making intelligent machines. The field was founded on the claim that a central property of humans, intelligence—the sapience of Homo sapiens—can be so precisely described that it can be simulated by a machine. This raises philosophical issues about the nature of the mind and the ethics of creating artificial beings, issues which have been addressed by myth, fiction and philosophy since antiquity.Artificial intelligence has been the subject of optimism, but has also suffered setbacks and, today, has become an essential part of the technology industry, providing the heavy lifting for many of the most difficult problems in computer science. AI research is highly technical and specialized, and deeply divided into subfields that often fail to communicate with each other.]Subfields have grown up around particular institutions, the work of individual researchers, the solution of specific problems, longstanding differences of opinion about how AI should be done and the application of widely differing tools. The central problems of AI include such traits as reasoning...

Checkpoint: Knowing Where You Placed Your Document

...CheckPoint: Knowing Where You Placed Your Document By: Juan C. Williams University of Phoenix- IT 206 Dr. Chris Barrett, PMP 07/28/2011 From my experience, many individuals when saving a document save their documents into any random folder that comes up. Unfortunately this is cause for misplaced documents when trying to locate them at a later date. Thankfully, there are many helpful ways to locate recently saved documents. One step would be to click on the Office button which is located at the top left of your Microsoft Word document, and once the box drops down to the right-side panel will be the top nine recently saved documents. A quick reference would be to click Save and that will take you straight to your default Save designated folder. There are some various ways which have been utilized to lessen the routinely misplaced saved documents which will ultimately make it effortless to locate your recent and/or old files. First, you should create a title for your document, something that you will easily remember in the future to be able to locate it. Now if the document is important, it is best to save it in an accessible file such as your “My Documents” folder or your desktop. One recommendation would be to create a New Folder for example “School” that way you can create a less cluttered work space which will Inevitably help you end up locating files quicker. It is understandable to be in a hurry to save, but, in order to create...
