The roots of domestic partnership go back to 1981, when San Francisco considered legislation to provide benefits to unmarried couples. “Domestic partners” soon became a legal term used by private and public employees to extend benefits to an employee’s unmarried partner of the same sex. In 1982 The Village Voice in New York City became the first private employer to offer domestic partnership benefits. In 1995, Vermont became the first state to offer domestic partnership benefits to its public employees. In 1997 Hawaii became the first state to offer domestic partnership benefits to all same-sex couples throughout the state. (Clifford) The first domestic partnership ordinance--implemented in Berkeley, California, in 1984--provided official acknowledgment of the unions of same-sex couples, at a time when legal marriage did not exist elsewhere. There are currently 5 states that allow same-sex couples to marry. In date order, Massachusetts, Connecticut, Iowa, Vermont, and New Hampshire. As of March 3 2010 the District of Columbia now recognizes gay marriage. (William)
This is a very important ethical issue in business. Although most employers are not required to offer benefits to all of its employees, it is hard for the employers to decide to give domestic partners any benefits or even to give the domestic partners all of the potential benefits, and one example would be life insurance. One of the bigger issues for the companies is if they do not offer the benefits, they might lose an employee to another company that does. Public and Private employers are recognizing that to remain competitive in attraction and retaining top talent they must meet the demands of the work force. This means accommodating specific demographics, such as workers with non-traditional relationships. (Health Insurance for Domestic Partnerso) I think the ethical intensity for this issue is a very high. Some people beliefs are if you are to receive benefits of another’s you should be married. But I believe that if you have a partner and you love one another there is no reason to be married, all marriage is, is a piece of paper that binds you to another person. Another factor in domestic partnership benefits is the federal and state governments; they do not tax benefits for spouses, but taxes benefits for domestic partners, because it does not recognize those relationships. Also in some instances, an employee who receives benefits for a domestic partner has to pay for the premium with after-tax dollars and then pay taxes again on the cost of the benefit because it counts as income.
A domestic partnership is a personal relationship between two individual living together and sharing a common domestic life together, but not joined by marriage, civil union or any other type of legal partnership. A domestic partnership can consist of two people who are not of the opposite sex. In some jurisdiction, a domestic partnership is treated the same as a marriage so that the domestic partner can benefit from health insurance. Domestic partnerships can enter into a domestic partnership agreement similar to a prenuptial agreement to contractually agree to matters of finance, property or shared responsibilities. For an employee to get benefits from their employers the employers usually require domestic partnerships to be formally registered in order for benefits to be offered. (Datta) U.S. state or local law accommodates the registration, or certification of a domestic partner relationship. Places where this process is unavailable, the employer may use its own certification process.
There are a lot of peoples live can be potentially damaged by not getting their partners benefits. If you are with someone all of your life, but not married, and have a family and the other person get terribly hurt or even dies what does the partner do? Say they were the main source of income, what is he/she supposed to do if the employer would not offer the benefits that married people are entitled to? That person may have not worked, but did raise the family, what are they supposed to do when there is no one there to provide for them. Those benefits that could have been available to them would have helped in their time of need. Just because some of the people in this word that are in love and have spent many years, and sometimes their whole lives together, doesn’t mean that they shouldn’t be entitled to the things that married people are.
