The roots of domestic partnership go back to 1981, when San Francisco considered legislation to provide benefits to unmarried couples. “Domestic partners” soon became a legal term used by private and public employees to extend benefits to an employee’s unmarried partner of the same sex. In 1982 The Village Voice in New York City became the first private employer to offer domestic partnership benefits. In 1995, Vermont became the first state to offer domestic partnership benefits to its public employees. In 1997 Hawaii became the first state to offer domestic partnership benefits to all same-sex couples throughout the state. (Clifford) The first domestic partnership ordinance--implemented in Berkeley, California, in 1984--provided official acknowledgment of the unions of same-sex couples, at a time when legal marriage did not exist elsewhere. There are currently 5 states that allow same-sex couples to marry. In date order, Massachusetts, Connecticut, Iowa, Vermont, and New Hampshire. As of March 3 2010 the District of Columbia now recognizes gay marriage. (William)
This is a very important ethical issue in business. Although most employers are not required to offer benefits to all of its employees, it is hard for the employers to decide to give domestic partners any benefits or even to give the domestic partners all of the potential benefits, and one example would be life insurance. One of the bigger issues for the companies is if they do not offer the benefits, they might lose an employee to another company that does. Public and Private employers are recognizing that to remain competitive in attraction and retaining top talent they must meet the demands of the work force. This means accommodating specific demographics, such as workers with non-traditional relationships. (Health Insurance for Domestic Partnerso) I think the ethical intensity for this issue is a very high. Some people beliefs are if you are to receive benefits of another’s you should be married. But I believe that if you have a partner and you love one another there is no reason to be married, all marriage is, is a piece of paper that binds you to another person. Another factor in domestic partnership benefits is the federal and state governments; they do not tax benefits for spouses, but taxes benefits for domestic partners, because it does not recognize those relationships. Also in some instances, an employee who receives benefits for a domestic partner has to pay for the premium with after-tax dollars and then pay taxes again on the cost of the benefit because it counts as income.
A domestic partnership is a personal relationship between two individual living together and sharing a common domestic life together, but not joined by marriage, civil union or any other type of legal partnership. A domestic partnership can consist of two people who are not of the opposite sex. In some jurisdiction, a domestic partnership is treated the same as a marriage so that the domestic partner can benefit from health insurance. Domestic partnerships can enter into a domestic partnership agreement similar to a prenuptial agreement to contractually agree to matters of finance, property or shared responsibilities. For an employee to get benefits from their employers the employers usually require domestic partnerships to be formally registered in order for benefits to be offered. (Datta) U.S. state or local law accommodates the registration, or certification of a domestic partner relationship. Places where this process is unavailable, the employer may use its own certification process.
There are a lot of peoples live can be potentially damaged by not getting their partners benefits. If you are with someone all of your life, but not married, and have a family and the other person get terribly hurt or even dies what does the partner do? Say they were the main source of income, what is he/she supposed to do if the employer would not offer the benefits that married people are entitled to? That person may have not worked, but did raise the family, what are they supposed to do when there is no one there to provide for them. Those benefits that could have been available to them would have helped in their time of need. Just because some of the people in this word that are in love and have spent many years, and sometimes their whole lives together, doesn’t mean that they shouldn’t be entitled to the things that married people are.

Domestic Partnership Benefits

...Domestic Partnership Benefits Domestic partnership is often defined as a legal or personal relationship between two individuals who live together and share a common domestic life but are neither joined by marriage or a civil union. This includes opposite-sex couples as well as same-sex couples. The laws in some states now permit same-sex marriage, civil unions or registry for domestic partnerships for same-sex or opposite-sex couples. There are many couples out there that cohabitate together sharing expenses such as mortgages or rent and automobile payments however they are not offered the same benefits of those who are traditionally married. The question is, should employers offer domestic partner benefits? There are many pros for an employer to provide benefits to domestic partners. An employer’s policy decisions regarding these relationships are shaped by state and federal laws, business needs and a desire for an inclusive corporate culture. Many employers now voluntarily offer benefit coverage to domestic partners even when it is not required by law. This trend is driven by several factors including changing demographics, the desire to be fair, workplace diversity and the need to improve employee morale. With the number of unmarried households increasing ten-fold from 1960 to 2007, employers find themselves trying to keep pace with the changing profile of the work force. Additionally with all of the recent gay rights controversy and same-sex marriage becoming......

Partnerships and Domestic Corporation

...a business founded on friendship.” [ (Rockfellar) ] Partnerships are defined as the relationship existing between two or more persons who join to carry on a trade or business. Each person contributes money, property, labor or skill, and expects to share in the profits and losses of the business. [ (IRS) ]. There are two different type of partnerships limited, and general. Domestic Corporation is defined as a U.S. corporation doing business in the state in which it is incorporated opposite of foreign corporation [ (Answers.com) ] Partnerships John D Rockefeller stated that partnership is “A friendship founded on business is better than a business founded on friendship, but 70% of business partnerships fail (according to Harvard Business School); the fastest way for a business to succeed is to ignore the dynamics between yourself and the other partners. According to the National Center for State Courts, there were a whopping 14,957,085 civil suits filed in 2001 and that number is increasing every year. The shocking statistic is more than $200 billion dollars a year are poured into fending off litigation [ (National Center for State Courts) ]. Partnerships are used to minimize the disadvantages of a sole proprietorship and maximize the advantages of having more than one owner. Most states have a model law governing partnerships based on the uniform partnership act [ (Ferrell, Hirt, & Ferrell, 2009) ]. Partnerships are typically larger than sole proprietorships but......

Gay in America

...Name Instructor Houston English 205 September 2, 2013 Gay in America In today’s society Gay men and women have to fight for everything, including the right to marry and have a baby. Gays face many challenges which include a job, a loved one, a family; the right to life, liberty and justice, all these rights are given to all but Gay people. I ask you; is this fair; are Gays not people to? Sometimes even before a gay person comes out they get teased, ridiculed, punished, assaulted and you wonder why some people try to hide it. For a Gay person it can be a constant struggle, just to live and be happy. Everything in a gay person life is a challenge, they must fight for everything. A person that is born has no choice on who they are or what sex they find attractive. Being gay is no different then being attracted to the opposite sex. ABC News reports, “Northwestern University psychology professor Michael Bailey has spent years studying human sexuality. He says sexual orientation is something people are born with, and this orientation makes some gay men more feminine” (1). Yet we blame and punish the families of these gay people. We even try to limit Gay people’s rights. Society believes that being gay is wrong and disgusting. Dr. Berggren claims that “It has long been asserted, primarily by various religious and politically conservative groups, that homosexuality is detrimental to the well-being of any society in which it occurs” (1). Being gay......

Sexual Orientation Discrimination

...Sexual Orientation Discrimination Introduction to Human Resources Management HR 353 2/25/2011 Matthew D. Hall Instructor: Joyce Willhite   Sexual Orientation Discrimination “I believe all Americans who believe in freedom, tolerance and human rights have a responsibility to oppose bigotry and prejudice based on sexual orientation (King).” This quote by Coretta Scott King is how the workplace should feel about discrimination against those who have a different sexual orientation. Sexual orientation discrimination is a rapidly growing issue in today’s workplaces. Just like sex, age, and race discrimination it is becoming one of the major issues that is present in the workforce. With the growing news media issues like gay marriage and “Don’t ask don’t tell”, this is becoming another one of the areas employers are and have been discriminating against workers. There are many state laws to discourage this type of discrimination, but as of right now there is not a federal law that protects against sexual orientation discrimination. I am sure in time there will be some form of federal protection, but only time will tell. As part of the Lesbian Gay Bi Transgender (LGBT) family, I have seen firsthand how this discrimination has and continues to negatively affected people’s lives. When people are singled out for any reason and discriminated against, it makes me think “are we really in the land of the free?” Just as Ms. King’s quote stated, if we believe in......

Gay Marriage

...Bobby Flashman Flashman 1 January 22, 2012 CEP # 1 Gay Marriage in Washington The controversy of gay marriage has always been an issue, whether mentioned in the confines of a home, a school or even, as stated by David Masci, the hallways of the U.S. congress, white house and courtrooms. As times change and generations pass, gay and lesbian relationships are becoming more acceptable, but that does not mean the problem is completely solved. Gay marriage has been legalized in six states as well as the District of Columbia, while twenty nine states have passed a constitutional amendment prohibiting same sex marriage in that state (Masci). Each side of the argument is very black and white. Either you believe that there is no right to tell someone they cannot be legally bonded with the one they love. While the counterpart, mostly religious aspects, is that it is not morally right for two members of the same sex to be together. Whether or not gay and lesbian couples should be allowed to wed is only part of the problem. The other issue at hand is whether the law should be decided by a peoples vote, or by a proposition to legislature by the Governor. Most states rest this choice with the people, deciding the content of their states constitution themselves. But the Governor also has the power to decide if their state is mature enough to be passed, though it would still not be a for sure thing. In the midst of this budget crisis in Washington State, there is also......

...2011 Economic Motives for Adopting LGBT-Related Workplace Policies Introduction This study evaluates the economic impact of corporate non-discrimination and benefits policies by analyzing the extent to which economic reasons motivate corporations to adopt such policies. The past decade has seen a large increase in the number of corporations adopting LGBT-related workplace policies. In 1999, 72% of Fortune 500 companies included sexual orientation in their non-discrimination policies, and only a handful included gender identity.1 By 2009, 87% of such companies included sexual orientation and 41% included gender identity in their non-discrimination policies.2 Over the same time period, the percentage of Fortune 500 companies offering domestic partner benefits increased from 14% to 59%.3 This study reviews statements issued when adopting such policies by the top 50 Fortune 500 companies and the top 50 federal government contractors. Since companies began to adopt these policies, and state and local governments began to amend their laws to prohibit sexual orientation and gender identity discrimination, arguments have been made that the requirements are costly and burdensome for private businesses. As recently as May 2011, the Tennessee legislature repealed an ordinance passed by the city of Nashville requiring city contractors to include sexual orientation and gender identity in their non-discrimination policies.4 The Tennessee Chamber of Commerce initially supported the......

...There are a lot of legal forms for businesses. In this paper, I will talk about these forms; sole proprietorship, partnership, limited liability partnership, limited liability company, S corporation, franchise, and corporate form. I will try to develop scenarios in which each of these forms of business would be the preferred form. For each scenario, I will justify why the corresponding business form is preferred. Sole proprietorship is the first form of businesses and it is the simplest form of business organization. The Sole proprietorship and the owner of the businesses are representing the organization. Forming the sole proprietorship is very easy and does not cost a lot and this is why it is the most common business in United State. The businesses owner is the manager and he takes all the decisions and the responsibilities including the hiring, and firing the employees. The sole business owner owns all of the business and has the right to obtain all of the business’s profits. For the past points, the sole business would best a good form. Lastly, the only disadvantage is that the sole business owner is responsible for the entire business obligation. Also, banks are terribly hesistant to loan money to this type of business for lack of credibility if the business ends up failing. General Partnership is a form of business where two or more people share the ownership of one business. Each partner contributes to all aspects of the business including money, property, labor and skill. In return, each partner shares in the losses and gains of the business. Partnerships entail more than one person when it comes to decision making. It is very important that the parties involved discuss a wide variety of issues up front and develop a legal partnership agreement. This agreement should document how future business decisions will be made, including how the partners will divide profits, resolve disputes, change ownership (bring in new partners or buy out current partners) and how to dissolve the partnership. Strategic Alliance

...CHAPTER ONE 1. Introduction to the study The purpose of study is to evaluate the effects of strategic buyer-supplier alliances and partnerships in the South African clothing stores, sector and industry. Strategic Alliances, Partnerships and Joint Ventures involve the establishment of informal and formal relationships with other individuals or businesses to share resources, ideas or capital (Hugo, Badenhorst-Weiss & Biljon 2007). The research indicates that during the past decade, companies in all types of industries and all parts of the world have elected to form strategic alliances and partnerships to complement their own strategic initiatives and strengthen their competitiveness in domestic and international markets (Thompson Jr, Gamble & Strickland, 2006), the statement confirms that some of the companies realize the importance of strategic alliances and partnerships. The current situation in South Africa indicates that the government is imposing Quotas on Chinese imports with intent to influence the South Africa retailers to buy from local suppliers (Sandrey & Fundra, 2008). The quotas have encouraged the major retailers in South Africa to procure more from local suppliers than ever before given the growth in their collective businesses over the last four years. Preliminary investigation between the retailers and clothing manufacturers confirm the retailers’ expectations that local companies will be unable to make up the expected shortfall the quotas will......
