...greater than Gianni Sport’s, and in this industry, buyers were “in the driver’s seat.” In June 1980, Gantos submitted to Gianni Sport a purchase order for women’s holiday clothing to be delivered on October 10, 1980. The purchase order contained the following clause: Buyer reserves the right to terminate by notice to Seller all or any part of this Purchase Order with respect to Goods that have not actually been shipped by Seller or as to Goods which are not timely delivered for any reason whatsoever. Gianni Sport made the goods in question especially for Gantos. This holiday order comprised 20 to 22 percent of Gianni Sport’s business. In late September 1980, before the goods were shipped, Gantos canceled the order. Was the cancellation clause unconscionable?” (Mallor 433). According to the doctrine of unconscionability, the cancellation by Gantos was unconscionable. Gantos was a larger company, and therefore was able to determine the terms of the contract, and Gianni Sport, being the weaker of the two, had no practical choice but to adhere to the terms. Under the UCC, the courts have the power to manipulate the provision containing the unconscionable terms to make the contract just. In this case, I believe the courts would take out the clause that the order can be cancelled at any time before shipping and would make Gantos pay for the order to Gianni sports. Writing Is Hard

...For me, writing is frustrating. Many times I have trouble writing about anything. The main reason why I have so much trouble when writing, is because I don't concentrate on my work enough. Even when I try my hardest to concentrate, my mind seems to wonder around to a different direction towards another thought. After that, I forget all about my work and just think about various things such as people, places, and different times I've had in the past. For example, even while I'm writing this small paragraph, my mind keeps on slipping into other thoughts. I dont know if this happens to lots of people, but this is one problem that I have trouble the most in. Maybe this is why I'm a slow writer and don't like to write. When I write, I'm usually in my house sitting right where my computer is. One thing about me is that I hate writing anything with a pen and a paper. Most of the time when writing an essay, report, or anything else, I type it on my computer. I can probably type 50 times faster than writing by hand. I guess it's just something that I'm better at. I can type about 80-85 words per minute. If that isn't fast, then I dont know what is. When writing, I can write when it's quiet, loud, during the day, during the night, and during whatever atmosphere I'm in. Even if the whole house is quiet, I usually listen to music while typing an essay. However, the best time and the best atmosphere for me to write anything would be during...

...want to verified who's the cheater. 2. What does Wenke see as a possible negative consequence of cheating among students today? She said that students cheat because they want an excelente grade or a good job but they dont learn anything so in a future when they need to put on all that knowledge in the real life, they can´t do anything because they dont learn. ‎3.- Wenke says that the solution to decline the cheating problems is to appreciate the knowledge of a person, rahter than by the grades, this way the student will find it easier to learn for it will be a much easier task to learn and be granted for it, than to just simply be graded over and over again. Questions in writing strategy 1.- The opening paragraph is clearly intended to students who have cheated more than once, it really can catch the attention of anybody that has a related person that cheats. I think that the opening paragraph was very well made and it clearly states the purpose of the entire essay. ‎2. Wenke cites several outside sources in the course of her essay. What do these sources Contribute to her argument? The references she used, corroborate the arguments of why education has been raped from its own moral awareness, the act of copying, but that also means that people have corrupted the student policies. 3. ...1 test, students will have 15 minutes to study a stimulus text linked to the general topic area they have chosen. Students must not write on this stimulus, but can make notes on a separate piece of paper. (Notes on key words you have or want to use- these were previously learnt by you). Both the stimulus and any notes must be taken into the exam room, and students can refer to these at any point during the test. (Preferably not for higher marks but if needed referring to them wont be an issue) However, students must not refer to dictionaries or any other resources during the preparation time. (You wont need a dictionary at this point so no problem here right!) * Begin by reading the entire text through (two, three or even 4 times) * Make bullet point notes of the main points of the text * Make a note of any vocabulary from the text which might be useful in discussion of this topic * Do not waste time writing out complete sentences; you will not be allowed to read out long prepared statements anyway (marks are awarded for spontaneity and fluency so please try not to use your notes) * Consider the types of questions which might be asked about the text, and your answers to these questions * Identify any vocabulary you already know that might be useful when answering questions on this topic. Exploiting Interns

...the material covered in my Women Studies class. In the article, Greenhouse points out that since 1985, the unemployment rate for graduates twenty-four years old and younger has risen 9.4 percent (Greenhouse, 2012). Speculators estimate that this number is increasing so rapidly because of students’ willingness to work for free in internship positions. The article explains this phenomenon stating that many students feel this is the best way to get a foot in the door with a possible future employer. More and more businesses are refusing to hire students who have not completed an internship program. However, Greenhouse explains that even after the completion of an interning program, many students are left uneducated about the type of work done in the field they are hoping to pursue. This point of the article can tie in with an essay read in class titled “Claiming an Education” by Adrienne Rich (1977). In her essay, Rich explains how students must not simply go to school to receive an education, but instead should claim one (1977). Similarly, a student partaking in an internship program that feels unfulfilled in his or...

Obamacare

...Medicare and Medicaid passed in 1965. In this paper, the key points that will be discussed are obamacare policy, it pros and cons, if it raises any issues with federalism and the policys effectiveness. Obamacare is aimed at helping the underinsured to gain insurance. With this plan everyone would have health insurance regardless of income, or anything that would stop the person from attaining health insurance. The Affordable Care Act is a watershed in U.S. public health policy. Through a series of extensions of, and revisions to, the multiple laws that together comprise the federal legal framework for the U.S. health-care system, the Act established the basic legal protections that until now have been absent: a near-universal guarantee of access to affordable health insurance coverage, from birth through retirement.(Rosenbaum, 2010) Obamacare is a name used by critics of President Obamas efforts to reform health care. Its a common term used to describe the Patient Protection and Affordable care Act of 2010. ObamaCare contains many benefits, especially for low and middle income families and businesses. ObamaCare also contains some obstacles for larger firm that dont insure their employees and certain aspects of the healthcare industry. The Pros and Cons boil down to this, Obamacare the average American has a lot to gain and little to lose, while some larger firms and consequently their employees may notice negative...

Look at what I am doing right now, I am doing this essay on my lap top which is recommended to have in college these days. No writes out their essay's by hand any more, its all through computers and technology which is disappointing in a sense, because its the easy way out of things as I see it, I am not saying that technology does not have its benefits it does, but what ever happened to the old classic hard working satisfaction people use to do, people managed fine and did many great things before there was technology like there is today, Its laziness the easy way of doing everything, if their is an easier way of doing things, where people can do things faster but with less work, they will develop it, but what about the long term affects of all this, dont people see what is happening to our society? My Relationship With Writing

...The hate side of my relationship with writing stems from school. This is because most of the writing assessments dont allow me to have creative freedom. 9 times out of 10 we have to write about something like why we love school (we don't) or sometime you had to do something specific that you can't remember ever doing. And then when you get to write something that has a plot instead of a 5 paragraph essay about why school shouldn't be start earlier, you have to write from a prompt that sounds like something you would find in a children's story contest. I understand why we are given prompts, i just wish we could have more creativity with them instead of writing with a specific prompt. That is why i partly hate writing. The love side of my...

Brain and Motivation Paper

...Incentives are things that encourages or motivates one to do something because of a future reward. Two examples of incentives are school and work. School is an incentive for me for two reasons. The first reason is because when my father passed I promised him that I would get my bachelors because that was his dying wish. Everytime I dont feel like working on homework or turning in an essay, I always just think about him and that gives me the motivation because I know he would be so proud of me. He will be looking down from heaven when I graduate. The second reason is for my daughter. I want to provide the best life for my daughter that I can. I plan on in the years to come to get my Ph.D. For right now, Im just focusing on my Bachelors. I had a very good life growing up. I want my daughter to have the same thing. Looking at her gives me motivation to not just sit around and do nothing. Work is another incentive for me because it helps me pay my bills. It provides me with the nice life I have now. Thats pretty much the reason I work anyways. I do it for the paycheck. Incentives describe the things that motivates and encourage individuals to do something that will give them the reward. For example college for me is my incentive would be college because, I want to work hard to complete my course and my reward would be my graduation. School is very important to me because of a few things which are my son and I and family. I’m the first college graduate on my side of things when...

Attachment Security

...Laura Morales Psychology 102 Professor Frederic Halper Attachment Security, Compassion and Altruism In psychology there has always been an argument between whether certain things are learned or whether they are innate (born with). It can be many things like personalities, beliefs, emotions, desires, values etc. According to John Bowlby and his theory, when it comes to survival of the human species one of the things we do as infants is try to capture the attention of our caregiver in order to receive care and attention. Attachment security is the term we would use for describing this. This of course would be something innate, something natural that we as babies would use for protection "The propensity to make strong emotional bonds to particular individuals, a basic component of human nature". (Bowlby) Sometimes this is not always provided to an infant, and if it isn’t, it will supposedly affect the individual later in life. According to Bowlby "The operation of this system is affected by an individual’s social experiences, especially with early caregivers, resulting in measurable individual differences in attachment security". Attachment is a special emotional relationship that involves an exchange of comfort, care, and pleasure. Not only does attachment security aid in survival but it also has a huge influence on development, our behaviors and relationships later in life. In the article Attachment Security, Compassion and Altruism a...

...Essay Topic: use of cellphones in school Cell phones should be allowed to use in every school in the united states. Although cell phones can be a distraction during class time also can be helpful for students and teachers. There are many reasons to allowed students use their phones during school. The cellphone can provide safety to students and also it can be used as a learning tool for them. Instead of having schools wasting time trying to get rid of cellphones, we need more schools giving cellphones an educational usage for their students. Now almost every teenager own a cellphone, tablet, or a device used for entertainment. Many schools since these devices appeared have watching it as a problem for their institutions. Schools don't realize the real capacity of the cellphones. If schools start making students to use their cellphones to learn, research, and read it would be easier to learn. Students would not text or play with their phones because they would be learning on their phones. There are a lot of educational apps like electronic books, calculators, word processors educational games and they can access to educational websites. These things would improve every school and student of America. Not only better education improves a school also a very important factor is the safety. The main reason some parents buy cellphones to their children is because it provides safety to them. You dont know what can happen during school, students could have an accident , an attack...
