In the month of October, 2014, a woman by the name of Laura Jones applied at a Baltimore, MD Wal-Mart for employment. The hiring procedure was going normally until the process reached the drug testing. The woman was asked to submit to a urinalysis within 24 hours in order to be further considered for employment at the company. Mrs. Jones went down to the drug testing facility to submit a sample but was unable to provide a urine sample due to her particular condition. She then returned from the drug testing facility to speak with a supervisor at the company to let them know that she was unable to provide a sample, because she had been diagnosed with end stage renal disease. The woman’s particular medical condition of end stage renal disease rendered her unable to provide a urine sample. The supervisor asked her to return to the testing facility and ask if they could let her take an alternate test instead of the urinalysis. The woman returned to the drug testing facility like the supervisor told her. When she asked the testing facility about the alternate test, the facility told her that they could administer an alternate drug test with the permission of the hiring company. Mrs. Jones then relayed the information back to the Wal-Mart supervisor, but the supervisor declined to order a different test. The supervisor informed Mrs. Jones that they would be unable to offer her employment because she was unable to complete a urinalysis drug test. The result of this was that her application was closed due to her not completing the drug test within the 24 hour window ("U.S. EEOC Wal-Mart Press Release", 2014).
This conduct from Wal-Mart resulted in a lawsuit from the EEOC. Mrs. Jones was awarded $72,000 and Wal-Mart is required from taking any adverse actions on employees on the basis of

...How often should a construction worksite be inspected? Provide the rationale for your recommendation. In the military we have to inspect all of our equipment daily prior to using it. This may sound a little excessive but we have to know we can rely on our equipment. I think the actual worksite should be inspected a minimum of every six months by management and daily by the worker. It is easier to correct a problem if it is spotted early. It can also prevent damage to equipment or injury or a fatality. Here is a good schedule I found on how often inspections should be conducted. • “1-2 per month for Senior Management such as Plant Managers and Executives • (Predictivesolutionscom, 2012). • 1-2 per week for Line Managers, Superintendents, Directors, and Workers • 3-5 per week for Safety staff” (Predictivesolutionscom, 2012) The inspections should be more frequent if there are a lot of accidents. I still think that the worker needs to do at least a quick look around his work area everyday especially if there are other shifts that use the same work area. A little housekeeping can prevent a lot of accidents. OSHA is not able to inspect every business yearly. Their first priority is on the employers with a poor safety record, fatalities or a hazardous job. Other employers will be inspected regularly.
