Summary of Elaine’s Behavior
Elaine, a stock broker, decided to retaliate against her perception that society took a portion of her life by unethically tricking George into buying/selling stocks based on her insider information as a stock broker. She intentionally left notes for George to find that identified which stocks were performing well, and those that were dropping. George used the information to invest his savings to invest in the market, leaving a huge trail hinting at insider trading. Next, Elaine used an assumed name and reported him to the SEC, who investigated, and charged George with violation of Securities Act. Under testimony, she lied stating that she gave no implicit or explicit information to George. However, the Justice Department found him guilty, and sentenced him to prison time. Next, Elaine received the reward for turning in George for violating section 10(b) of the Security Act. Finally, Elaine was unethical, again, when she convinced George grant her access to his accounts as an offer to “build them” in anticipation of his release in 15 to 20 years, as well as to grant her General Power of Attorney (GPOA) for all his assets.

Next, this paper will discuss her fraudulence by not reporting to the Security and Exchange Commission (SEC) the sales of stock, clearly a violation of section 10(b) of the Security Act. Additionally, it will discuss Elaine’s perjury by lying in her testimony. Also, this paper will discuss Elaine’s violations associated with misrepresenting herself to a government agency.
